GRANT OF UTILITY EASEMENT
THIS INDENTURE, made this 28thday of September, 1992, between LAKE
MARY RESIDENTIAL JOINT VENTURE, a Florida joint venture partnership, whose
address is Post Office Box 300789, Fern Park, Florida 32730-0789
("Grantor"), and CITY OF SANFORD, FLORIDA, a municipal corporation,
situated in Seminole County, Florida, whose address is 300 North Park
Avenue, Sanford, Florida 32771 ("Grantee");
WI TNE S SETH:
THAT Grantor, for and in consideration of the sum of Ten Dollars
($10.00) and other valuable consideration in hand paid by Grantee, receipt
whereof is hereby acknowledged, has granted and conveyed, and by these
presents does grant and convey to Grantee, its successors, assigns and
licensees, a non-exclusive utility easement under, upon and across the
property situated in Seminole County, Florida ("Easement Area"), more
particularly described as follows:
The South 10.00 feet of the Northwest 1/4 of the Southeast
1/4 of Section 3, Township 20 South, Range 30 East, Seminole
County, Florida, lying west of Old Lake Mary Road (50 foot
right-of-way), LESS AND EXCEPT the West 142.00 feet thereof;
FOR the purposes of installing, maintaining, inspecting, servicing,
repairing and replacing an underground pipe line for the transmission of
reclaimed water, including the right of free ingress and egress over and
across the Easement Area for any of the purposes aforesaid;
PROVIDED, HOWEVER, that Grantor reserves the right to dedicate all or
any part of the Easement Area as a public utility easement or public right-
of-way in connection with one or more future plats of the Grantor's real
property of which the Easement Area forms a part, in which event this
easement shall automatically cease, terminate, become null and void, and be
of no further effect upon the recording of any such plat among the Public
Records of Seminole County, Florida, as to any portion of the Easement Area
with respect to which such a dedication is made.
IN WITNESS WHEREOF, Grantor has caused these presents to be executed
as of the day and year first above written.
