AGREEMENT
THIS AGREEMENT, made and entered into this ' day of
June, 1983, by and between CITY OF SANFORD, FLORIDA, a municipal
corporation, hereinafter called "City ", and THOMAS S. McDONALD
AS TRUSTEE, hereinafter called "Owner ",
W I T N E S S F. T H:
WHEREAS, Owner holds title to the following described property
in Seminole County, Florida, to -wit:
The South 1/2 of the Southeast 1/4 of Section 7,
Township 20 South, Range 31 East;
and
WHEREAS, City desires to locate an elevated water storage
tank upon property of Owner and described as follows, to -wit:
The Easterly 100 feet of the Westerly 1,320 feet
of the Northerly 100 feet of the Southwest 1/4 of
the Southeast 1/4 of Section 7, Township 20 South,
Range 31 East, Seminole County, Florida;
and
WHEREAS, Owner desires to have a minimum eight inch water
line and a minimum six inch sewer force main extended to Owner's
property so that the same can be serviced by City's municipal water
and sewer system and has requested City to enter into an appropriate
agreement to provide the same;
NOW, THEREFORE, in consideration of the premises, the
covenants and conditions hereinafter contained, the parties agree
as follows:
1. Owner herewith submits to City, and City accepts from
Owner, a deed to the above- described site for said elevated storage
tank.
2. As partial consideration for said deed, City covenants
to construct, at City's expense, an eight inch or larger water line
from the existing City line easterly to said elevated storage tank.
The cost of extending said line shall he borne by City. Initially
said line shall be extended so that it will service the following
described property, to -wit:
The West 871.2 feet of the North 625 feet of the
South 1/2 of the Southeast 1/4 of Section 7,
Township 20 South, Range 31 East.
Said line will be so located as to permit a tap for the purposes
of serving a sixty -four thousand square foot manufacturing plant
to be constructed by Invacare Corporation or its assigns. The
usual tap and connection fee will be paid by Invacare Corporation
and /or its assigns at the time of tap. Construction of said line
will commence as soon as appropriate permits are received and in
any event will be completed not more than one hundred twenty days
from June 17, 1983.
3. In addition to the aforesaid water line construction,
City covenants that it will extend a six inch sewer force main to
service the last above - described property for a cost of $ �� /4-
which will be paid by Owner and delivered to City immediately upon
title passing to Invacare Corporation and /or its assigns. City
represents that said line will be capable of servicing in excess
of two hundred fifty people and that construction will commence
upon receipt of appropriate permits and in any event will be
completed within one hundred twenty days from June 17, 1983.
City acknowledges that Owner has signed a contract for the
purchase of the last above - described property by Invacare Corpora-
tion and /or assigns and that this contract covering the above
described extensions of water and sewer lines is a condition
precedent to the closing of said purchase contract and that the
representation of the City is material to the acquisition of said
property by Invacare and the construction thereon of the above
described manufacturing plant.

hands and seals as of the day and year first above written.
