SUBJECT: Special Meeting - October 23, 1985 - 4:00 P.M.
Dear Member:
A meeting has been scheduled for October 23, 1985 at 4:00 P.M. in the Conference
Room at City Hall.
The meeting is being called to consider a request from Central Constructors, Inc.
for Lakeview Village Apartments located at 401 W. Seminole Blvd. They are request-
ing a variance in section 1113.3 "treads and risers" of the Standard Building Code
to allow them to vary up to one inch from the code. Please see attached letter.
Please let me know by Monday, August 21, 1985 if you are unable to attend.

Dear Mr. Winn:
Request is made for approval of existing variations in
the first and last stair risers on apartment stairs as
indicated on the attached report dated October 12, 1985, •
pages one (1) through nine (9) of nine.
In section 1113.3 treads and risers of the standard
building code , it requires that the sum total of 2 risers
and 1 tread exclusive of the nosing is not less than 24"
and not more than 25 ".
Height of risers shall not exceed 7 3/4" and treads
exclusive of nosing shall not be less than 9" wide. The
average of our top and bottom riser is 23.93" and there-
fore we are requesting a variance to allow us to vary
up to one (1) inch from the code.
Approval is requested of the existing conditions at the
first and last risers only for all ten (10) buildings.
Due to the Owner's urgency in obtaining final building
Certificate of Occupancy and occupancy at the earliest
possible date ( on or about November 1, 1985 ) we would
be most appreciative of your favorable response to this
request at the earliest possible moment.

Dear Mr. Winn:
This will confirm our telephone conversation today wherein I
confirmed that the Board of Adjustment and Appeals has the
inherent authority to grant a variance from the literal
enforcement of the Codes. The act is a discretionary one and is
therefore one that does not subject the City or the Board to
liability unless the decision was arbitrary, capricious or beyond
the realm of reason.
I believe a variance of approximately one inch on the stair
raisers at the Lakefront project is a decision in the sound
discretion of the Board.
