Seminole Blvd. Building Permit # 20575 Dear Mr. Winn: Request is made for approval of existing variations in the first and last stair risers on apartment stairs as indicated on the attached report dated October 12, 1985, • pages one (1) through nine (9) of nine. In section 1113.3 treads and risers of the standard building code , it requires that the sum total of 2 risers and 1 tread exclusive of the nosing is not less than 24" and not more than 25 ". Height of risers shall not exceed 7 3/4" and treads exclusive of nosing shall not be less than 9" wide. The act is a discretionary one and is therefore one that does not subject the City or the Board to liability unless the decision was arbitrary, capricious or beyond the realm of reason. I believe a variance of approximately one inch on the stair raisers at the Lakefront project is a decision in the sound discretion of the Board.
