ORDINANCE NO. 3806
AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA,
AMENDING ORDINANCE 3747, TO AMEND THE HUMAN
RESOURCES MANUAL PERSONNEL RULES AND REGULATIONS,
CHAPTER II, SECTION 2.45, HEALTH INSURANCE PROVIDING
FOR SEVERABILITY, CONFLICTS, AND EFFECTIVE DATE.
WHEREAS, it is the desire of the City Commission of the City of Sanford, Florida, to amend
Human Resources Manual Personnel Rules and Regulations, Health Insurance, for the purpose of
Continuing the City's Health Care Cost Containment Initiatives.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD,
FLORIDA:
SECTION 1: The City Commission adopts statements above as if fully set forth herein.
SECTION: 2: That the Human Resources Manual Personnel Rules and Regulations, Health
Insurance, which is attached hereto as Exhibit "A" is incorporated herein by reference.
SECTION 3: SEVERABILITY:
If any section or portion of a section of this ordinance proved
to be invalid, unlawful, or unconstitutional, it shall not be held to impair the validity, inforce or effect
of any other section or part of this ordinance.
SECTION 4: CONFLICTS: That all ordinances or part of ordinances in conflict herewith be and
the same are hereby revoked.
SECTION 5: EFFECTIVE DATE: That this ordinance shall become effective October 1, 2003.

2.45 HEALTH INSURANCE
Exhibit "A"
(A) On the first day of the month after completing thirty (30) calendar days of service
with the City of Sanford, regular full-time and regular part-time employees are
provided with City paid health insurance benefit. The benefit is in the form of a
payment contribution. Once the employee's application for benefits is submitted
to Human Resources, the City pays the employee portion of health insurance as
determined by the City Commission.. during the course of its budgeting process;
of health insurance that is equal to the budgeted portion of the employee's
premium. of the least expensive plan option between the City's HMO Plan Option
and the POS Plan Option. The selection by the employee of a plan option
requiring a higher premium payment or a premium that is otherwise different from
the City's budaeted payment contribution portion shall be borne by the
employee.. Effective October 1, 2003. those retirees who move out of the health
insurance coverage area. will pay the difference between the budgeted portion
paid by the City and the out of area premium; provided. however. that prior
years' excess payments shall not be recouped from out-of-area retirees.
Employees desiring insurance coverage for their dependents, under the City's
plan, may obtain such dependent coverage at their own expense
(8) Each Fiscal Year the City Commission will determine the budaeted insurance
premium portion that the City will contribute towards health insurance coverage.
If the cost of employee coverage exceeds the amount determined by the City
Commission, then the difference shall be borne by the employee and/or retiree
receiving health care coverage
(C) An employee, if hired before October 1, 2002, will have met the criteria for
eligibility for continuation of City-Paid health insurance at the time of retirement
upon completion of twenty-five (25) years' service to the City. Any ~mployees
who retire! or who meet! the criteria for disability retirement after October 1.
2003. and receive! City-paid health insurance at the time of retirement in
accordance with foregoing paragraph hetshe must contribute theiF his or her
health insurance subsidy received from the State of Florida Retirement System
(F.R.S.) Pension Plan to the City to be credited toward the cost of the health
insurance premium. The retiree must not be disqualified for benefits under the
laws of the State or City Code. Employees hired after October 1, 2002 who retire
with twenty-five (25) years of service to the City shall not be eligible for any city
paid health insurance in accordance with the foregoing retirement eligibility
criteria in this paragraph.
(D) This policy will result in the entitlement of retiring employees to the same health
insurance coverage as is afforded regular employees and the total premium
charged to retiring employees will not exceed the total premium charged to the
active employee. The application of the said policy will also result in all
employees and retirees receivina health insurance benefits receivina the same
benefit reaardless of the health service area in which the employee or retiree
resides.
(E) Retirees receiving City health insurance coverage upon reaching age sixty-five
{65} will be required to enroll in Medicare Part B coverage.
(F) Employees retiring for disability reasons and who meet the criteria for disability
retirement as prescribed by the F.R.S. or who meet the criteria for disability
retirement as prescribed by the Police or Fire Pension Plan are eligible for
continued City-Paid health insurance. Effective October 1. 2003, with reaard to
all employees retiring as a result of full disability and meet the criteria for
disability retirement; City-Paid health insurance will begin upon retirement and
will continue until the disabled retiree receives Medicare benefits or until 24
months have elapsed from the date of retirement, whichever comes first. The
disabled retiree must not be disqualified for benefits under the laws of the State
or City Code.
The retiring employee approved for disability reasons will be entitled to the same
health insurance coverage as is afforded regular employees and the total
premium will not exceed the total premium charged to the active group.
Employees retiring for disability reasons shall have submitted to the City, proof of
application for disability retirement coincident with the employee's date of
termination.
(G) Upon attainment of age sixty-five (65) all entitlement to City-Paid health
insurance will cease,
Whenever a retiree becomes ineligible for continuation of City-Paid health
insurance due to attainment of age sixty-five (65), he/she or his/her eligible
dependents may elect to continue this coverage at his/her own expense under
the provisions of existing "COBRA" Law and Florida Statute Section 112.0801...
Florida Statutes.
(H) With respect to the foregoing paragraph this policy becomes effective
October 1, 1991 and would be applicable to all retirements occurring on or after
that date.,.
ill IntroductionlTimely Assertion of Claims: It is not the intent of this
provision to deny any City employee any vested riGht or entitlement. which
results from ooeration of law. Should any City employee or retiree desire to
assert a claim that the amendments to the subiect rule. as follows. denies
them any vested riGht. each such employee must file a claim statinG the
basis for such claim with the City's Human Resources Director within thirty
(30) days of the date on which the rule. as amended below. is adopted by
the City Commission of the City of Sanford. AnY such claim will be
determined by the City ManaGer or as otherwise may be set forth in the
Codes and Ordinances of the City of Sanford.
