ORDINANCE NO. 1439
AN EMERGENCY ORDIN&~CE OF THE CITY OF
SANFORD, FLORIDA, PURSUANT TO THE PROVISIONS
OF SECTION l66.04l,(3)(b), FLORIDA STATUTES,
(1977); SAID ORDINM~CE AUTHORIZING THE CON-
TINUED DEVELOPMENT OF PLATTED PROPERTY IN
THE PRESENTLY EXISTING AREAS WHICH ARE ZONED
PUD (PLANNED UNIT DEVELOPMENT), SAID ORDINANCE
REQUIRING THAT APPLICANTS FOR BUILDING PEID1ITS
SIGN DOCUMENTS AGREEING TO COl~LY WITH EITHER
THE PRESENT DEVLOPMENT PLAN IN SUCH DISTRICTS
OR SUBMIT NEW DEVELOPMENT PLANS FOR CONSIDER-
ATION BY THE PLANNING AND ZONING CO}ft1ISSION
AND APPROVAL BY THE CITY CO~1ISSION, PROVIDING
AND EFFECTIVE DATE.
WHEREAS, it has been brought to the attention of the
City Commission that the Development Plans in the three areas
within the City which are zoned PUD (Planned Unit Development)
have expired due to no construction and failure to maintain
approved Development Plan Schedule within the two year period as
provided for in Subparagraph 8 of Article 8 entitled Supplementary
Regulations of the Zoning Ordinances, and
WHEREAS, said ordinance further provides that in the
event the Development Plan lapses, the City Commission shall take
the necessary rezoning action to remove the Planned Unit Develop-
ment from the official zoning map, file a notice of revocation with
the recorded Development Plans and reinstate the zoning district and
regulations which were in effect prior to the approval of the
Development Plan, and
WHEREAS, the strict enforcement of the present ordinance
would cause undue hardship and would further prevent the immediate
development in the three Planned Unit Development areas, and
WHEREAS, it is the desire of the City Commission to
allow continued development in the areas specified herein until such
time as an appropriate amendment can be enacted to the present
ordinance, the City Commission being of the opinion that the situation
constitutes an emergency and that an emergency ordinance should be
adopted.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD,
FLORIDA:
SECTION 1: That the continued development of platted
property in the presently existing areas within the City of Sanford,
which are zoned PUD (Planned Unit Development) shall be allowed to
continue until this ordinance expires or until such time as the
presently existing ordinance relative to the development in PUD
(Planned Unit Development) is amended.
SECTION 2: That in order to obtain a building permit
for future development in the presently existing PUD (Planned Unit
Development) areas, the applicant for a building permit must sign
a document approved in form by the Building Official of the City
of Sanford, Florida, agreeing to comply with either the presently
existing Development Plan in such district or in the alternative,
submit a new development plan for consideration by the Planning
and Zoning Commission and approval by the City Commission.
SECTION 3: This ordinance shall become effective
immediately upon its passage and adoption and shall remain in
effect until August 22, 1978 or an earlier date in the event the
presently existing PUD (Planned Unit Development) ordinance is
amended.
