DEED OF EASEMENT
March 17 , 1987
THIS DEED, made this March 17 , 1987 by HILLERBRAND & SON,
INC., an Iowa corporation in gooa standing and authorized to do
business in Florida, with offices at 1250 So. U. S. Hwy. 17-92,
Suite 220, Longwood, Florida 32758, ("Grantor") to the CITY OF
SANFOED, Florida, with offices at City Hall, 380 North Park
Avenue, Sanford, Florida ("Grantee");
WITNESSETH: That Grantor, for consideration which includes
issuance of final site approval and final city occupancy permits
(with respect to property described in EXHIBIT A hereto), all
issued by the City of Sanford, and to which issuance this Deed is
subject, hereby grants, bargains and sells to Grantee and its
heirs and assigns forever, the following described land:
The east thirty feet of the property owned.by Grantor along
U. S. Highway 17-92 (Seminole Boulevard) adjacent to Lake
Monroe, which is described in the attached Legal
Description, EXHIBIT A hereto. The parcel conveyed is
believed to have been known as Terwilliger Lane and shown
as such on recorded surveys.
ALSO SUBJECT TO a reservation in Grantor (and its heirs and
assigns) of a nonexclusive easement on said conveyed parcel
running up to the corner of U. S. Highway 17-92 (Seminole
Boulevard) and the conveyed parcel (Terwilliger Lane) for
retention and detention ponds and drainage, and any future public
or private utilities useage consistent with same. Grantee may
cover or enclose by piping or similar means, the pond area, so
long as no significant impediment is imposed upon the foreseeable
flow of water between the north and south ends of the easement~
at such time, or upon the overall foreseeable water quality and~
dissipation rates at such time. As fee Owner of the parcel, _.~
Grantee hereby assumes full responsibility for all maintenance,~
repairs, improvements, assessments, taxes or any Other ~
liabilities or obligations associated therewith, other than ~
liabilities or obligations directly resulting from Grantor's ~
actual use of the reserved easement. ~
THE GRANTOR does hereby fully warrant the title to said
land, and will defend same against the lawful claims of all
persons whomsoever.
IN WITNESS WHEREOF, the Grantor has signed and sealed
