SANFORD POLICE OFFICERS' RETIREMENT SYSTEM
PENSION BOARD MEETING — DISABILITY HEARING
THURSDAY, MAY 15, 2008 — 1:00 P.M.
1. Call to Order and Roll Call
The meeting was called to order at 1:15 p.m. by the Chairman, Darrel Presley. The
following members were present: Bill Kirchhoff, Nigel Price, Michael Taylor, and Brian
Tooley. Also in attendance was Scott Christiansen, the Plan Attorney, the claimant, Mr.
John DiFatta, his wife, and his attorney, Mr. Herbert Hill.
2. Review Medical Information and Disability Aoplication
Scott Christiansen began by reviewing the disability processes and procedures with
everyone. He went on to review the disability criteria detailed in the Pension Plan
Ordinance explaining that the Trustees were also going to have to determine whether
or not the disability occurred in the line of duty.
Mr. Herbert Hill discussed his client's case and stated that Mr. DiFatta's is in excellent
health, as reported by the Dr. Rojas during his independent medical examination, and
his intent is to return to work as a Police Officer with the City of Sanford.
The medical records that were collected were reviewed and discussed and Mr. DiFatta
was asked specific questions regarding the disability application and his ability to
perform the duties of a certified Police Officer.
The Trustees could not find any indication that Mr. DiFatta has a disability that would
prevent him from returning to duty. Therefore, a motion was made by Mike Taylor
NOT to grant the disability to Mr. John DiFatta. Seconded by Nigel Price, the motion
carried unanimously.
3. Adjournment
The meeting ended at 1:45 p.m.
