SANFORD POLICE OFFICERS' RETIREMENT SYSTEM PENSION BOARD DISABILITY HEARING - WILT THURSDAY, AUGUST 12, 2010 — 1:30 P.M. 1. Call to Order and Roll Call The meeting was called to order at 1:15 p.m. by the Chairman, Michael Taylor. The following members were present: Bill Kirchhoff and Greg Smith. Nigel Price was excused. Also in attendance was Scott Christiansen, the Plan Attorney, the claimant, Mr. John Wilt and his attorney, Mr. Paul White- Davis. 2. Review Medical Information and Disability Application Scott Christiansen began by reviewing the disability processes and procedures with everyone. He went on to review the disability criteria detailed in the Pension Plan Ordinance explaining that the Trustees were also going to have to determine whether or not the disability occurred in the line of duty. The medical records that were collected were reviewed and discussed and Mr. Wilt was asked specific questions regarding the disability claim. Both he and his attorney provided commentary regarding the arrest made on September 16, 2009 that resulted in his injuries, and thereby, his inability to perform as a Police Officer. The Trustees all agreed that his injuries occurred in the line of duty. A lengthy discussion then ensued regarding the "intent" clause in the disability procedures. A motion was then made by Greg Smith to approve of an in- line -of -duty disability with total and permanent injuries specifying the injuries were not the result of an intentional act of violence or permanent disfigurement against the officer. The motion was seconded by Michael Taylor for discussion. The discussion continued regarding the determination and definition of intentional bodily harm or permanent disfigurement. The following vote was then recorded: Bill Kirchhoff No Greg Smith Yes Chairman Taylor Yes The motion was not passed due to the fact that there had to be a unanimous decision. Scott informed Mr. Wilt and his attorney that another hearing date will be scheduled and they will be notified as soon it has been established. 3. Adjournment The meeting ended at 2:50 p.m. ,homr,
