HomeMy WebLinkAbout121310 dis hr min Wilt SANFORD POLICE OFFICERS' RETIREMENT SYSTEM PENSION BOARD DISABILITY HEARING - WILT MONDAY, DECEMBER 13, 2010 — 1:00 P.M. 1. CaII to Order and Roll Call The meeting was called to order at 1:05 p.m. by the Chairman, John Metsopoulos. The following members were present: Chris Collison, Darrel Presley, and Greg Smith. Also in attendance was Scott Christiansen, the Plan Attorney, the claimant, Mr. John Wilt and his attorney, Mr. Paul White- Davis. 2. Review Medical Information and Disability Application Today's meeting was a continuation of the Initial Hearing that was held on August 12, 2010. Due to the fact that Greg Smith was the only returning Trustee that participated in the first part of the disability hearing, Scott Christiansen began by reviewing the actions that were taken as a result of that meeting. He then reviewed the disability processes and procedures with everyone. Mr. Wilt described the incidents of the arrest that took place and his personal injuries as a result of that arrest. His attorney passed around pictures of the crime scene and a lengthy discussion ensued. A motion was then made by Greg Smith to approve of a total and permanent in- line -of -duty disability. Seconded by Chris Collison, the motion carried unanimously. The discussion continued regarding the criminal intent and the determination and definition of intentional bodily harm or permanent disfigurement. A motion was then made by Greg Smith that, though the injuries did result from the perpetration of an intentional act of violence, the evidence was not sufficient enough to find that the perpetrator intended to cause great bodily harm or permanent disfigurement. The motion was seconded by Darrel Presley and the following vote was recorded: Chris Collison No Darrel Presley Yes Greg Smith Yes Chairman Metsopoulos Yes Mr. Wilt and his attorney were advised that the final Order would be signed and sent to them as quickly as possible and they will have 90 days in which to file an appeal (if they so desire.) 3. Adjournment The meeting ended at 2:25 p.m. (for ge Board of Trustees)
