HomeMy WebLinkAbout4087 ORDINANCE NO. 4087 AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, AMENDING SECTION 102-271(15)(a), GENERAL DISCHARGE PROHIBITION OF THE CODE OF ORDINANCES OF THE CITY OF SANFORD; PROVIDING FOR LEGISLATIVE FINDINGS; PROVIDING FOR CONFLICTS; PROVIDING FOR SEVERABILITY; PROVIDING FOR CODIFICATION; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Commission of the City of Sanford, Florida, finds it necessary and immediately legislatively desirable to amend the language and legislative intent for a portion of Division 2. Regulations, Section 102-271 of the Code of Ordinances of the City of Sanford; and WHEREAS, The Florida Department of Environmental Protection has reviewed the existing content of the aforementioned section and has suggested that the section be amended to eliminate potential conflicts with other sections of the Code; and WHEREAS, the City Commission intends for this Ordinance to eliminate conflicting interpretations within the Code of Ordinances of the City of Sanford and advance the health, safety, and welfare of the general public and not to protect particular individuals, organizations of a particular group of persons affected by the terms of this amendment; and WHEREAS, the City Commission does not intend this Ordinance to conflict with any State Law, Regulation or Administrative Code germane to the regulation of the limits for oil/grease in the City's system. NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF SANFORD, FLORIDA: SECTION 1. LEGISLATIVE FINDINGS. The statements contained in the above Whereas clauses are adopted and ratified as the legislative findings and intent of the City Commission as if fully set forth herein as the legislative intent and findings of the City Commission. SECTION 2. Section 102-271(15) of the Code of Ordinances of the City of Sanford, Florida entitled "Regulations, General Discharge Prohibitions" is hereby vacated and subsection (a) thereof is specifically deleted and the new Section 102- 271 (15) shall read as follows: I. DIVISION 2. REGULATIONS Sec. 102-271. General discharge prohibitions. (15) Detergents, surface-active agents, or other substances which may cause excessive foaming in the VVWF. SECTION 3. CONFLICTS. All ordinances or part of ordinances in conflict with this Ordinance are hereby repealed. SECTION 4. SEVERABILITY. Should any section, paragraph, sentence, clause, phrase, or other part of this Ordinance be declared by a court of competent jurisdiction to be invalid, such decision shall not affect the validity of this Ordinance as a whole or any portion thereof, other than the part so declared to be invalid. SECTION 5. CODIFICATION. Only Section 2 of this Ordinance shall be codified and become a legislative declaration of the City Commission of the City of Sanford, Florida and become a part of the Code of Ordinances of the City of Sanford, Florida. SECTION 7. EFFECTIVE DATE. The provisions of this Ordinance shall take effect immediately upon enactment. Ordinance No, 4087 Page 2 of 3 PASSED AND ADOPTED this 14th day of January, 2008.
