PRESENT: Jim Kidd, Nancy Roberts, Juanita Harold, Dean Ray, Dave Daly,
Brian Tooley - Police Chief, and Gracy Posley
Absent: Excused – Dave Hall, Kim Bridges, and Dr. Brenedette Hardy -Blake
Unexcused – Tom Carpenter and Oscar Redden
Called to Order by Chairperson Mr. Kidd. Mr. Kidd requested Minutes of April 10,
2002 be tabled due to their not being a quorum.
Police Chief Tooley introduced Susan Stacy of Stenstrom, McIntosh, Colbert, Whigham
& Simmons law firm.
Ms. Stacy introduced herself to members and gave an overview of the Florida Sunshine
Law which entails public meetings, public records, minutes, board ethics, etc. Public
boards have no privacy rights. Two board members or more constitutes a public
meeting. Two or more members of the same board discussing voting /decision matters
outside a public meeting; not noticed /advertised to the public, violates the Florida
Sunshine Law (F.S. 286.011). Any subject that might come before a board for decision
making must be done on public record. A board member can lobby a member of a
different board reference issues being recommended or being decided upon.
Sanctions for violation of the Florida Sunshine Law were discussed. Criminal violation
is a 2 degree misdemeanor; civil violation, non - criminal is a fine up to $500.00.
Regarding board ethic violations, there is an Advisory Ethic Committee, Tallahassee
that can provide opinions only; not a defense. One type of board ethic violation includes
receiving gifts to influence a vote /recommendation. A board ethical violation is civil with
a fine up to $10,000.00. Ethical complaints can be filed up to five years from the initial
incident.

— Police Chief Tooley advised members of the law enforcement officers appreciation
day being sponsored by Sanford Historic Trust at Centennial Park on May 11 at 11 am
for police department employees.

—Twenty-five new police take -home vehicles were rolled out to officers May 25 with
Mayor Lessard issuing the keys to each officer. These take -home vehicles are another
City benefit to attract and retain Sanford police officers.
—May 13 the City Commission approved, yet another police officers benefit. The
officers mortgage incentive program pays 20% of an officers mortgage ($200. min. -
$250. max.)
—May 21 -25 Sanford police will participate with other agencies within the county
reference a Zero Tolerance Operation (illegal alcohol use) regarding teenagers /high
school graduates.
—May 24 2 -5pm George Town residents will have a march regarding weeding out and
resolving community problems.
There being no further business, the meeting was adjourned at 7:40 pm.
