Perkins, Chairman Others Present: Bill Braceland, Building Official The meeting was called to order by Mr. Philips in the absence of the Chairman, B. L. Perkins. The first item for consideration was the following : Board of Adjustment ity Hall Sanford, FL 32771 Gentlemen: I am submitting the following information for your consideration in requesting variance in the Zoning Ordinance as it pertains to side yard setback require- 4110 ments in GC- 2'Zoned District. Legal description Lots 6 & 7, Block 16, Chapman & Tucker's Addition. Property location 207 Cypress Ave. The planned use of the property is carport addition to commercial building. Any consideration given this request will be appreciated. Signed: Charles E. Meeks, Owner Mr. Meeks was present to represent the request. and said he needed to erect a cover over his parking area and the addition will bring the building in line. A variance of 6' 9" was needed. After discussion, Mr. White moved to grant the variance. Mr. Karns seconded. Motion carried. The next item for consideration was the following: Board of Adjustment City Hall Sanford, FL Gentlemen: I am submitting the following information for your consideration in requesting variance in the Zoning Ordinance as it pertains to living area requirements in MR -1 Zoned District. • Legal description all of Ridgewood Estates, Plat Book 20, Page 95. Property location Immediately north of Seminole High School, Georgia Ave. on the east, Ridgewood Ave. on the west, Geneva Terrace Replat on the north. The planned use of the property is Multi- family residential units. Any consideration given this request will be appreciated. Signed: W. 0. Page 2 Mr. Hutchison was present to represent the request and the requested variance was for 26 one - bedroom units, of 647 sq. ft.; 40 one - bedroom units of 659 sq. ft. and 24 two - bedroom units of 789 sq. ft. The requested variances for 26 one - bedroom units was for 53 sq. ft., 40 one - bedroom units 41 sq. ft. and 24 two - bedroom units for 11 sq. ft. The 90 units will have a density of 11.8 per acre and the requirement is 12 per acre. After discussion Mr. Karns moved to grant the variance subject to something in writing supporting the legality of a decision of this kind for the Board of Adjustment. Mr. Blair seconded. Motion carried. Attached letter from the City Attorney supporting the Board of Adjustment decision. There being no further business, the meeting was adjourned. If B. L. Perkins, Chai an W. M. Perkins, Jr. Chairman - Board of Adjustment City of Sanford, Florida Re: Density Provisions - Square Footage Variance Dear Mr. Perkins: I have been requested, as attorney for the City of Sanford, to give an opinion relative to the density provisions of the zoning ordinance relative to the question of variance as to the square footage of dwelling units. Section 6 of Article X of the zoning ordinance pro- vides that variance may be granted on density control requirements only. The question as arisen as to whether or not the matter of square footage is con - • templated by the density control requirements. After considering the definition of "variance" as set forth in Section 65 of Article II, Section 6 of Article X, and the general provisions and intent of the question as to variance in general, I am of the opinion that the Board of Adjustment has the discretion to grant a variance as to square footage of a dwelling unit.
