The Board of Adjustment met in special session at the City Hall at
11:30 A. M. on May 31, 1974.

The meeting was called to order by the Chairman.
The following letter was submitted to the Board for consideration:

Gentlemen:
I am submitting the following information for your consideration
in requesting variance in the Zoning Ordinance as it pertains to front,
rear and side yard setback requirements in MR -1, Multiple - Family
Residential Dwelling Zoned District. Property being described as
"The Oaks ", located at West 25th Street, east of Upsala Road.
The planned use of the property is single - family condominium.
Any consideration given this request will be appreciated.

Mr. McKee explained to the Board that what they had come up with
originally was a plat for The Oaks which exists as part of the
• condominium document. The parcel is zoned MR -1 with a 5 -unit per
acre density. Up to this point there is no condominium ordinance

that suits this sort of development. Rather than a condominium
stacked up where block units are sold, we are selling a unit on a
piece of property. In order to have a means of selling the property
we divided it similar to a plat, but it does not meet the typical
plat law. On the advice of the City Attorney we have platted the
whole five acres as a single lot, which meets the plat law, and the
subdivision of the property is an exhibit to that plat and also the
condominium document. These will be 22 single - family units and each
person owning one of these units will own 1/22 interest of the tennis
court, swimming pool and common area. That is the reason it has to
be done on a condominium basis. Since these units are separated,
they give the advantage of a single - family unit, but the setbacks
do not meet the requirements. Mr. McKee said he was requesting con-
sideration for a waiver of the setback requirements.
Mr. White said he felt the single units separated were preferable
to having common walls, but he was concerned about the small distance
between units in reference to fire fighting. Mr. McKee said that
there were no units that would not have 7 or 8 feet between, and there
is a gap of 20 feet between each three units to meet the fire code,
the walls have a one -hour fire rating, and there will be two fire
hydrants in the area.
• In discussion it was determined that no rear yard would be less
than the required 20 feet, and therefore a waiver of the rear yard
setback would not be necessary.
After consideration, a motion was made by Mr. Philips to waive
the setback requirements for side yard and front yard, as shown on
the plat of "The Oaks ", dated May 29, 1974. The motion was seconded
by Mr. White and was carried by a unanimous vote.
There being no further business, the meeting was adjourned.
