Special Meeting

The meeting was called to order by the Chairman.
The following letter was submitted by Mr. R. D. Grieme for con-
sideration by the board.

Gentlemen:
I am submitting the following information for your consideration
in requesting variance in the Zoning Ordinance as it pertains to
side and rear yard setback requirements in RC -1 Zoned District.
Legal description being Lot 1 (less the West 44.75 ft. thereof),
Block 15, Tier 4, E. R. Trafford's Map of Sanford. Property location
is 1300 Park Avenue.
The planned use of the property is a metal building to be used
for recreation and storage.
Any consideration given this request will be appreciated.

• Mr. Grieme explained that the Central Baptist Church is requesting
a variance of 10' in the side yard setback on the corner at 13th
Street and 2.75' in the rear yard setback in order to construct
a single story metal building to be used for recreation and storage.
The reason they propose a metal building is that, if the need arises
for more parking space for the church, a metal building could be
moved to another location. Mr. Grieme felt that a metal building
would be an improvement over what is there now. He had checked
with the two abutting property owners and found that they had no
objection to the proposed building.
After consideration, Mr. Karns moved to grant a variance of 10' in
the side yard setback requirements for corner lots in RC -1 District
and a variance of 2.75' in the rear yard setback requirements at
the location of 1300 Park Avenue.
The motion was seconded by Mr. Philips and was carried by a unanimous
vote of the board members.
The following letter was next presented by Mr. Norman H. Schiff,
for consideration.

Gentlemen:
I am submitting the following information for your consideration
in requesting variance in the Zoning Ordinance as it pertains to
density controls in MR -2 Zoned District. MR -2 Paragraph 6- D- (2) -f -bb,
one bedroom apartment - from minimum living area 700 sq.ft. to
approximately 648 sq.ft.
Legal description being the North 200 feet of the SW4 of SE4
East of U.S. Highway No. 17 -92 of Section 11, Township 20 South,
Range 30 East, and the N2 of SE4 of SE4 of Section 11, Township 20
South, Range 30 East.
The planned use of the property is multi - family rental garden
apartments.
Any consideration given this request will be appreciated.

111 Mr. Schiff explained that Royal Line Builders, Inc. propose to
construct a complex of multi - family rental garden apartments at
the location on the east side of Highway 17 -92 using the same
construction plans they had used in two other parts of the state.
He explained that they plan about 50 of the units will be one - bedroom
units with a living area of approximately 648 sq. ft.; and he was
requesting a variance in the requirement for a minimum of 700 sq. ft.
of living area density for these 50 units.
It is noted that there was no one present to object to the granting
of the variance.
There was a general discussion among the board members with the
conclusion that they were not sure the Board of Adjustment had the
authority to grant such a variance; if they should grant a variance
on the approximately 50 units, might it not be a defacto amendment
to the Zoning Ordinance. The consensus was that an opinion from
the City Attorney was needed and also a recommendation from the
Planning and Zoning Commission.
On the motion of Mr. Julian, seconded by Mr. Karns and carried by
a unanimous vote, the hearing was continued to a meeting at the
call of the Chairman, to await the opinion of the City Attorney
• as to whether granting of this variance is within the scope of
the Board of Adjustment, or with the Planning and Zoning Commission
and the City Commission; and to get some feedback from the Planning
and Zoning Commission on the subject.
Mr. Grieme was asked to submit a request to the Planning and Zoning
Commission, asking them to review this request for the reduction
in living area density in MR -2 District.
There being no further business, the meeting was adjourned.
