Special Meeting
January 25, 1973

The Board of Adjustment met in special session at the City Hall
at 3:30 P. M. on January 25, 1973.

Chairman Perkins called the meeting to order.
• The Chairman announced that the Board had convened in order to
consider a request for a variance in the Zoning Ordinance as it
pertains to Off Street Parking requirements in SC -3 Special
Commercial Zoned District in Lots 9 and 10, Block 5, Tier 2,
E. R. Trafford's Map of Sanford, Seminole County, Florida, being
more generally described as located at the southeast corner of
Magnolia Avenue and Third Street.
The letter of request submitted is as follows:

Gentlemen:
Attached please find the application and the application fee
necessary to request permission to appear before you.
The purpose of this request is to seek a parking variance in the
existing ordinance as it pertains to property described in the
attached application.
• In contracting to buy the property in question from Mr. Frederick
H. Williams, it was our intention to construct a 5,000 square foot

office building with twenty -six parking spaces. At the time the
contract was presented to Mr. Williams, the existing zoning called
for five parking spaces per 1,000 square feet of rentable office
space and thus we were within the prescribed limits.
Under the new parking requirements, seven spaces per one thousand
square feet of rentable office space, the largest building now
permissable is 3,600 square feet, which is not economically feasible.
It is our contention that the value of the property in question has
been substantially reduced because of the new requirements and that
these requirements have created a significant hardship for the seller
inasmuch as he can no longer sell the property as planned.
Since there is significant on- street parking in addition to the
twenty -six existing parking places and the site in question is not
the central downtown area, we would like to request permission to
go ahead with our original plans to construct a five thousand square
foot building. There is presently a need for the type of small
office building we propose to build and therefore our request if
• granted will prove mutually beneficial for the City of Sanford, in
the form of increased taxes, as well as the general business com-
munity.

At the Chairman's request, Mr. Risner read from the Zoning Ordinance
which was adopted by the City of Sanford on December 11, 1972, the
off - street parking requirements as applicable in SC -3 Zones,
as follows:

OFF- STREET PARKING & LOADING REGULATIONS
Paragraph (13)
Office and public buildings: Seven spaces for each 1,000
square feet of floor area used for office purposes.
Mr. David Johnston, urban planner, representing the applicants
presented a list of comparable parking requirements for general
office buildings in other Florida cities showing other cities
range from one parking space for each 200 feet to 400 feet.
• Mr. Dalsemer stated that the proposed construction would not only
benefit him as an investor; but, it would also benefit the City

of Sanford by filling a need for this type of small office building,
as well as provide increased tax revenue.
A general discussion by the members of the Board followed, with the
conclusion that the variance should be granted.
On the motion of Mr. White, seconded by Mr. Philips and carried
unanimously, a variance in the Zoning Ordinance off five (5) off -
street parking spaces was granted.
There being no further business, the meeting was adjourned.
