McAlexander Due to the absenle of Chairman Perkins, Secretary Wally Philips called the meeting to order and reading of the minutes of the last meeting were waived to avoid delay in the meeting. The following letter was submitted by Mr. E. H. McAlexander for consideration by the Board: Board of Adjustment April 12, 1971 J P • City Hall Sanford, Florida Gentlemen: I am submitting the following information for your con- sideration in requesting variance in the Zoning Ordinance as it pertains to Article XI, Section 4, rear yard set- back requirements in a C -1, Neighborhood Commercial Zoned District. Legal description being Lots 17 -18, Block 3, Florida Sub- division, Sanford, Florida. Property located at Mac's Oil Company (Phillips 66 Service Station) 1122 Celery Avenue. The planned use of the property is addition of two Bay Carwash in rear yard of gasoline service station. Any consideration given this request will be appreciated. Signed: E. H. McAlexander, has requested a ten (10) foot variance in the rear yard for the purpose of erecting a 38' x 22' covered metal building for use as a car wash. Mr. Risner was called upon to explain the set back re- quirements in the rear yard for a C -1 Neighborhood Commer- cial Zone and the variance requested. He stated there is a set back requirement of twenty (20) feet in the rear yard and that Mr. McAlexander's property at the rear, facing North, includes a seven (7) foot utility easement with the School Board owning that property on the North side and West side including a seven (7) foot utility easement and is fenced in. Mr. Risner also pointed out that Mr. McAlexanded had agreed to connecting to the I storm sewer on Mellonville Avenue to take care of waste water from the car wash. Mr. Sweeney called upon Mr. McAlexander to explain why this addition could not be on the West side of the build- ing and also if the addition would require walls. Mr. McAlexander explained there were existing pump islands on the West side and they would have to be removed to allow for the addition and that the building would re- main open; that it would only involve a cement floor with a metal roof. Mr. Karns pointed out that this addition might cut off the refuse truck from picking up refuse in the back of the building. If this happens Mr. McAlexander should be required to relocate his cans for pickup. After discussion it was moved by Mr. Julian that a ten (10) foot rear yard variance be granted, with the condi- tions that the metal building always remain open and if the variance interferred with refuse pickup Mr. McAlexander would have to relocate his cans.
