Joe Davis, Jr. Attorney Mr. Carl Gutmann, Designer Mr. Michael Porter Chairman Perkins called the meeting to order and reading of the minutes of the last meeting were waived to avoid delay in the meeting. . g 411 Mr. S. Joe Davis, Jr., Attorney, and Mr. Carl Gutmann, Designer, appeared in behalf of Mr. Michael Porter owner of Michael's Restaurant located at 2508 South French Avenue. The following letter was submitted to the Board by Mr. Porter: Board of Adjustment February 3, 1971 City Hall Sanford, Florida Gentlemen: I am submitting the following information for you consider- ation in requesting variance in the Zoning Ordinance as it pertains to Article XI, Section 4 and Article XV (b) (3) yard setback requirements in C -1 Zoned District. Legal Description being Lots 1, 2, and 21 through 244, Block 14, Dreamwold according to the plat thereof, as recorded in Plat Book 3, Page 30 of the public records of Seminole County, Florida. Property being located at the corner of Osceola Avenue and Highway 17 -92. 411 The planned use of the property is for restaurant facilities. Any consideration given this request will be appreciated. Signed: Michael Porter Owner AA Pr— .194 Board of Adjustment 411 February 16, 1971 Page 2 Mr. Porter has requested a twenty (20) foot variance in the front yard and a 13.4 foot variance in the rear yard for the purpose of erecting additional restaurant facilities. Mr. Risner was called on to read from the Zoning Ordinance Article XI, Section 4, C -1 Commercial Zone, stating there should be a front yard of not less that twenty (20) feet and a rear yard of not less than twenty (20) feet. Mr. Risner stated that because of the shape of the lot there would be two front yard variances due to the lot also facing Osceola Drive, meaning a front yard variance on Osceola Drive of twenty (20) feet and a front yard variance on French Avenue of eighteen (18) feet. Mr. Davis stated this would be an addition of 5,000 square feet seating approximately two hundred people. Mr. Gutmann stated this addition would not effect the off - street parking requirements. Mr. Gutmann explained that the request for a front yard variance on French Avenue would be for the purpose of providing a covered entrance for the patrons. Their plans call for a new driveway off French Avenue through an open canopy, therefore, providing attendent parking. Mr. Porter has a letter from the City granting him the use of City owned property abutting on the North side of his property for beautification purposes. Therefore the variance would not effect the abutting property owner. After considerable discussion it was moved by Mr. Philips that a twenty (20) front yard variance and a thirteen feet four inches (13.4) rear yard variance be granted, seconded by Mr. Karns and carried with a unanimous vote. A second motion was made by Mr. Julian that the eighteen (18) foot front yard variance on French Avenue be granted, with the condition that the canopy always remain open, III seconded by Mr. Philips and duly carried. Board of Adjustment , 411 February 16, 1971 Page 3 A motion was made by Mr. Julian that Mr. Gordon Sweeney's name be submitted to the City Commission to fill the vacancy left on the Board by the resignation of Mr. M. R. Strickland and that the meeting date be changed to Monday at 3 :30 P. M. Seconded by Mr. Philips and duly carried.
