Risner Kermit Wallstedt The meeting was called to order by the Chairman and minutes of the last meeting were waived to avoid delay in the meeting. A letter of request of variance was submitted to the Board by Mrs. Joseph W. Stuart as follows: • Board of Adjustment City Hall Sanford, Florida Gentlemen: I am submitting the following information for your consideration in requesting variance in the Zoning Ordinance as it pertains to a 13' variance in the rear yard and a 2' variance in the side yard setback requirements in R -5, one and two family dwelling zoned distruct. Legal description being Lot 6, less the east 57' Block 7, Tier C, E. R. Traffords Map of Sanford. Property located at 503 Pine Ave. The planned use of the property is for a single family dwelling. Any consideration given this request will be appreciated. Mr. Joseph W. Stuart Pr Board of Adjustment S October 30, 1969 Page 2 A general discussion was held regarding the size of the lot which was 50' x 67'. It was the general concensus of the Board that a lot of this size was too small to build on. Mr. Risner reminded the members that you could build on any lot that was platted as a lot of record and the setback requirements could be met as required by the Zoning Ordinance. After a lengthy discussion it was determined by the Board that this was a hardship case and that the owner of the property was trying to improve his living conditions by building a new residence in the place of one that had reached the point of having to be torn down. The cost of the repair of the old dwelling would have been so great it would not be feasible for Mr. Stewart to repair it. Since the demolition,he has been renting a house until something had been decided as to erecting a new dwelling. 411 After taking all this into consideration the Board granted variances so as to allow the erection of a new dwelling. Mr. Karns moved that a 5' variance in the front yard; an 8' variance in the rear yard and a 2' variance in the side yard be granted. Mr. Karns explained that instead of the variance requests that was previously requested that these be granted to prohibit the placing of the proposed dwelling too close to the exising house on the next lot and from placing the house too close to the street thus causing traffic hazards.
