Special Meeting ' March 28, 1968 J ~ t The Board of Adjustment met in a reconvened session of the adjourned meeting of March 14, 1968. The meeting had been adjourned due to lack of a quorum. . Members Present: 'IL B. L. Perkins Robert Karns Jerry Senkarik Wally Philips M. R. Strickland Others Present: Mr. L. J. Risner, Building Official, Mr. Kermit Wallstedt, Building Inspector Mr. G. A. Speer and the Manager of McCrory & McClelland Store 1 110 Due to lack of a quorum at the last called meeting it was necessary to take up the request of variance on two different locations. Reading of the minutes were waived due to lack of time. � The meeting was called to order and Chairman Perkins presented the first item on the agenda. A request for Mr. Geo A. Speer, Jr. for a variance in the side and rear yards at 700 Park Ave. letter read as follows: Board of Adjustment City Hall Sanford, Florida Gentlemen: I am submitting the following information for your ..'" consideration in requesting variance in the Zoning Ordinance as it pertains to side and rear yard setback requirements in R -3 Multiple Family Dwelling zoned district. Legal description Lots 1 and 2, Block 9, Tier 4, E. R. Traffords Map of Sanford. Property location 700 Park Ave., Sanford, Florida. ' • The Planned use of the property is a residential carporte., Any consideration given this request will be appreciated. George A. Speer, Jr. Owner BOARD OF ADJUSTMENT ! 4110 Special Meeting March 28, 1968 Page 2 Mr. Speer asked the Board to consider his request for an 18' side yard variance and a 6" rear yard variance as the present location of the existing carporte proved a hardship to himself and his wife in trying to park their cars. It was now necessary for him to leave one out in the weather as they did not have room under the carporte. There followed a general discussion as to the feasibility of the request after which Mr. Karns made a motion that the two variances be granted,Mr. Senkarik seconded the motion. Voting was as follows: Karns Aye Senkarik Aye Philips Aye Strickland Aye Motion carried, variance granted. 110 Chairman Perkins next presented to the Board a letter from George A. Speer, Jr, Daisy Speer and G. Andrew Speer re- questing a 19.6' rear yard variance in a C -2 General Com- mercial Zoned District. Legal description being Lot 2 (less begin NE corner, run W 2.97', S 117', E 2.65', N 117') & E of Lot 3, Blk 3, Tier 3, E. R. Traffords Map of Sanford located at 111 East First Street. The planned use of the property is for retail sales (McCroy's Stores) Mr. Speer was called upon to present to the Board the proposed extension and why it was needed. He proceeded to explain that due to the sale of part of the existing store to the Sanford Atlantic Bank that more space for the $.05 and $.10 Store was needed and this propesed location was the only feasible place for it. It was pointed out to the Board by Mr. Risner, the Building Official, that by placing this extension so close to the alley that trucks would have to load and unload in the alley and that according to the zoning ordinance a 20' rear yard was necessary in this zone. It was also pointed out that a trash bin would be needed and that even more room would be taken away from the loading zone. Further discussion followed and Mr. Philips made a motion that the 19.6' variance in the rear yard be granted. Mr. Karns BOARD OF ADJUSTMENT Special Meeting March 28, 1968 Page 3 seconded the motion. Mr. Senkarik declined to vote- stating that since he was involved in the extension that he felt it unfair to vote. Voting was as follows: Perkins Aye Karns Aye Philips Aye Strickland Aye Motion carried, variance granted. There being no further business the meeting was adjourned. JO B. L.
