HomeMy WebLinkAbout02241995 min • MINUTES The Board of Adjustment of the City of Sanford, Florida, met in Regular Session in the City Commission Chambers of the City Hall at 11:30 A.M. on February 24, 1995 Members Present: Larry Blair, Chairman Karl Stairs Carol Dennison Sylvia Smith Henry Sweet Others Present: Bill Reischmann, City Attorney Gary Winn, Building Official Arlene Rumbley, Secretary Mary Muse, Secretary The following letter was submitted for consideration: Board of Adjustment City Hall Sanford, FL 32771 Gentlemen: I am submitting the following information for your consideration in requesting a variance in the Zoning Ordinance. • Address: 113 1/2 W. 19th Street Legal Description: The South 54 ft of Lot 126" Sanford Heights Addn to Sanford asrecorded in the Public Records of Seminole County, Florida. Zoning Classification: SR -1A Side Yard Setback - 10' Present Setback: 2.5' Variance Needed: 7.5' East Side of House Side Yard Setback - 10' Variance Needed: 7.5' West Side of House Rear Yard Setback Requirement: 20 feet Present Setback: 4.5 feet Variance Needed: 15.5' Parcel Width: 70' Present: 50' Variance Needed: 20' Maximum Bldg Area: 35% Present: 36.4% Variance Needed: 1.4% Minimum Living Area: 700 sq' Present: 517 sq' Variance Needed: 183 sq' Accessory Bldg Setback - Has an accessory bldg in front yard (Must Be removed) Minimum parcel area: 7,500 sq' Present: 2700 sq' • Variance Needed: 4,800 sq' MINUTES - BOARD OF ADJUSTMENT - FEBRUARY 24, 1995 - 11:30 A.M. • PAGE 2 The planned use of the property is to erect a single family residence. Any consideration given this request will be appreciated. Signed: Robert A. Tango Mr. John Baldwin the attorney for Mr. Tango was present to represent the request. Mr. Baldwin advised the board that Mr. Tango did not create this problem, it was a non - conforming lot when sold to him in 1980. Mr. Baldwin submitted a copy of the survey into evidence. Present to speak in opposition was Lauren Swaggerty. Her property is located at 113 W. 19th Street. She advised the board that Mr. Tango was using the property in a SR -1A zone as a MR -2 zone. She stated that in 1986 there was remodeling done to the downstairs and she discovered there was no permits or inspections made. She stated that she spoke with Mr. Joe Jarrell, the contractor who built the garage. He informed her that there was one door and a dirt floor. Mrs. Swaggerty submitted pictures, 2 letters and signed petition into evidence. Also to speak in opposition was Jerry Ramson who lives at 116 W. 19th Street. The only thing he had to add was that the structure is • a public safety hazard and it causes low property value assessments in the neighborhood. By a show of hands in the audience, the following were in opposition: H.B.Owens, Mrs. Brooks, Mrs. Desmet, Mr. Douglas, and Mr. McLaulin. Mr. Blair read the section from the Land Development Regulations Standards for consideration for dimensional variances. He advised the board to review all 6 items prior to making a motion. Mr. Sweet made a motion to deny the request because of the conditions and circumstances did not result from the action of negligence of the applicant. Lack of seconded. Ms. Smith made a motion to approve the variance because that the grant of the variance will be harmony with the general intent and purpose of the ordinance and that such variance will not be injurious to the area involved or otherwise detrimental to the public interest or welfare. Mr. Sweet made a motion to deny the request because of the conditions and circumstances did not result from the action of negligence of the applicant. Mrs. Dennison seconded. Blair - aye Dennison - aye Smith - nay Stairs - nay Sweet - aye Motion carried. There being no further business, the meeting was adjourned. • Larry Blair, Chairman 111
