ORDINANCE NO. 2008-4120
AN ORDINANCE OF THE CITY OF SANFORD, FLORIDA, EXTENDING
THE IMPOSITION OF AMNESTY PROVISIONS ON NOISE
REQUIREMENTS, REGULATIONS, AND PROVISIONS WITHIN THE
CITY BY NINETY (90) DAYS UNTIL SEPTEMBER 24, 2008;
PROVIDING FOR FINDINGS AND LEGISLATIVE INTENT;
REENACTING THE LEGISLATIVE MANDATES OF ORDINANCE NO.
2008-4097; PROVIDING FOR INCORPORATION BY REFERENCE;
PROVIDING FOR SEVERABILITY; PROVIDING FOR CONFLICTS AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Ordinance No. 2008-4097 was enacted by the City of Sanford on
March 24, 2008; and
WHEREAS, Ordinance No. 2008-4097 is known as "The Temporary Noise
Prohibition Amnesty Ordinance of the City of Sanford"; and
WHEREAS, staff has created the Noise Ordinance Task Force (hereinafter the
"Task Force") including interested citizens of the City and who have dedicated many
hours of time toward the accomplishment of the legislative objectives of Ordinance No.
2008-4097; and
WHEREAS, the Task Force has considered similar legislation from areas
throughout the United States; and
WHEREAS, the Task Force has completed its task and has provided its written
recommendations to staff for preparation of new noise control and noise pollution
legislation; and
WHEREAS, staff has begun the laborious task of implementing the needs of the
City with updated noise control and noise pollution legislation to advance the best
interests of the citizens of the City of Sanford.
NOW, THEREFORE, BE IT ENACTED BY THE PEOPLE OF THE CITY OF
SANFORD, FLORIDA:
SECTION 1: FINDINGS AND LEGISLATIVE INTENT. The whereas clauses
herein declare the findings and legislative intent of the City of Sanford on the effective
date of this Ordinance.
SECTION 2. REENACTMENT OF ORDINANCE NO. 2008-4097. The legal
pronouncements and mandates of Ordinance No. 2008-4097 enacted by the City of
Sanford on March 24, 2008 are hereby reenacted without limitation and all persons
affected thereby shall take notice and be governed accordingly..
SECTION 3. INCORPORATION OF ORDINANCE NO. 2008-4097 BY
REFERENCE. Ordinance No, 2008-4097 enacted March 24, 2008 is incorporated
herein by this reference as if fully set forth herein verbatim so that all citizens shall be
informed as to their responsibilities to the City and function accordingly without
question.
SECTION 4. EXTENSION OF AMNESTY. The temporary amnesty period set
forth in Ordinance No. 2008-4097 which terminates on June 25, 2008, be and the same,
is extended to September 24, 2008 upon the adoption of this Ordinance; that all
provisions of Ordinance No. 2008-4097 are reenacted during the extension period in
accordance with the legislative mandates of Section 2 and Section 3 of this Ordinance.
SECTION 5. SEVERABILITY. If any section or portion of a section of this
Ordinance proves to be invalid, unlawful or unconstitutional, it shall not be held to impair
the validity, force or effect or any other section or part of this Ordinance.
SECTION 6. CONFLICTS. That all ordinances or parts of ordinances in
conflict herewith be and the same are hereby revoked.

SECTION 7. EFFECTIVE DATE. Except as otherwise provided herein, this
Ordinance shall become effective immediately upon its passage and adoption.
