THIS INDENTURE, made this 12th day of October ,
A.D. 1970, by and between CITY OF SANFORD, FLORIDA, a municipal
corporation, party of the first part, hereinafter called Grantor, and
FLORIDA PUBLIC UTILITIES COMPANY, a corporation, party of the
second part, hereinafter called Grantee,
WlTNESSETH:
For and in consideration of the sum of Ten Dollars and other
good and valuable consideration, Grantor by these presents grants,
bargains, sells and conveys unto Grantee the following described per-
sonal property lying and being in Seminole County, Florida, to-wit:
The 4" steel pipe starting at a point 940 feet West
of the center line of Park Avenue at its intersection
with Seminole Boulevard, and located on the North
side of Seminole Boulevard, running Easterly a dis-
tance of 5,363 feet to the East side of Mellonville
Avenue, thence on the East side of Mellonville
Avenue running Southerly a distance of 10, 021 feet to
a point 400 feet South of the South right of way line
of East 25th Street at the property line of the Sanford
Airport. The total length of pipe being 15,384 feet.
TO HAVE AND TO HOLD in fee simple. Grantor warrants that
it has full right and lawful authority to convey the above described personal
property.
In addition to the foregoing conveyance of personal property,
Grantor by these presents does give and grant unto Grantee a non-
exclusive easement along the above referenced street rights of way where
the above described pipe is located for the purposes of locating and main-
taining said pipe thereon, said easement being upon the following conditions:
1. Grantee will at all times maintain said pipe line in a safe
condition precluding injury, damage or annoyance to adjacent property
owners and/or the public.
2. In the event excavations are required in order to maintain

said pipe, such excavation will be promptly and expeditiously completed
with the surface areas repaired and replaced in as good condition as the
same is on the date of this grant.
3. In the event it is necessary for Grantor or other govern-
mental entity to enter upon such street rights of way for the purposes of
repair, renewal, replacement, reconstruction, or widening of such
streets, Grantee agrees at its expense to locate and/or relocate such
pipe line in such manner and fashion that any such maintenance, repair,
construction, reconstruction, or widening will not be interfered with
or delayed.
IN WITNESS WHEREOF this ins trument has been executed in
the name of the Grantor herein by its Mayor and attested by its Clerk
as a result of proper authorization of the governing authority of the City
of Sanford, the day and year first above written.

I, an officer authorized to take acknowledgments according to the
laws of the State of Florida, duly qualified and acting, HEREBY CERTIFY
that LEE P. MOORE and H. N. TAMN, respectively as Mayor and Clerk
of the City of Sanford, Florida, a municipal corporation, to me personally
known, this day acknowledged before me that they executed the foregoing
Bill of. Sale and Easement as such officers of said corporation; and I
FURTHER CERTIFY that I know the said persons making said acknow-
ledgments to be the individuals described in and who executed the said
ins trument.
