HomeMy WebLinkAbout4158 CE INTEREST RATES FOR OBLIGATIONS TO CITY ORDINANCE NO. 2009-4158 An ordinance of the City of Sanford, Florida amending the City Code of the City of Sanford pertaining to interest rates applicable to sums due to the City; providing for liens for charges, judgments, fines, penalties and other financial obligations due to the City; providing for conflicts; providing a savings provision; providing for severability; providing for codification and providing for an effective date. Be it enacted by the People of the City of Sanford, Florida: Section 1. Interest rate on obligations to City. A new section of the City Code of the City of Sanford is created to read as follows: The interest rate due to the City and which shall be collected by the City with regard to any sum due to the City under this Code shall be one percent (1 %) per month or the maximum interest rate authorized by law, whichever is less. A lien against the user's property may be filed and the lien may be pursued, in accordance with the provisions of controlling law, to reimburse the City for any and all charges, judgments, fines, penalties, sums due from orders entered in the code enforcement processes of the City (to include, but not be limited to, the charges incurred by special magistrates and attorneys fees of the City). and other financial obligations due to the City; provided, however, that this provision shall not apply to contracts in which the City is a party and other matters over which controlling State or Federal law takes precedence. Section 2. Conflicts. All ordinances or part of ordinances in conflict with this Ordinance are hereby repealed. Section 3. Savings. The prior actions of the City of Sanford in terms of the assessment of penalties to include, but not be limited to, matters relating to code enforcement activities of the City are hereby ratified and affirmed. Section 4. Severability. If any section, sentence, phrase, word, or portion of this Ordinance is determined to be invalid, unlawful or unconstitutional, said determination shall not be held to invalidate or impair the validity, force or effect of any other section, sentence, phrase, 1 word, or portion of this Ordinance not otherwise determined to be invalid, unlawful, or unconstitutional. Section 5. Codification. This Ordinance shall be codified in the City Code of the City of Sanford; provided, however, that Sections 2, 3, 4, 5 and 6 shall not be codified. The Code Codifier is granted broad and liberal authority to change section numbers in the current City Code and other appropriate actions as set forth in Section 1-10 of the City Code. Section 6. Effective Date. This Ordinance shall take effect immediately upon passage and adoption. Passed and adopted this 23rd day of March, 2009.
