MINUTES
The Board of Adjustment of the City of Sanford, Florida, met in Regular Session in the City
Commission Chambers of the City Hall at 11:45 A.M. on August 10, 2000.
Members Present: Larry Blair, Chairman

Chairman Larry Blair called the meeting to order at 11:45 A.M.
The following letter was submitted for consideration:

Gentlemen:
I am submitting the following information for your consideration in requesting a variance in the
Zoning Ordinance.
Address: 2582 S. Sanford Avenue
Legal Description: Lot 42, Frank L. Woodruffs Subd, as recorded in PB 3 PG 44, Public Records of
the Seminole County, Florida
Zoning Classification: MR -2
Variance Needed: Chain link fence in front yard
The planned use of the property is to obtain approval to allow a chain link fence within the front yard
area.
Any consideration given this request will be appreciated.

Michael Kramer, representative for John Hagan was present. Mr. Kramer stated that Mr. Hagan
is requesting a variance to allow a chain link fence within the front yard area. To keep in harmony
with the neighborhood, the fence would only be 4 ft. in height. There are several other places
along Sanford Avenue, which have chain link fences in the front yard. Mr. Kramer submitted

pictures to the board. Further south of this property, there is an 8 ft. chain link fence with barbed
wire on top. It is not a typical residential neighborhood since there are businesses along this area.
Mr. Hagan is requesting the fence for the safety of his children.
Sylvia Smith stated that the fence was installed without a permit and the code prohibits chain link
fences, but not wood fences in the front yard. If a wood fence was installed, it could obstruct the
visibility when backing or pulling onto Sanford Avenue. With the chain link fence you would be
able to see through it.
Catherine Reischmann stated that the Board could waive if criteria are met. The board needs to
look at the neighborhood as a whole and look at the land not the owner. Staff states they do not
meet the criteria and when the board makes their decision, they need to state such items. Mrs.
Reischmann questioned the definition of "decorative" fencing. She stated that if a permit was
obtained prior to installation, the item regarding decorative could have been worked through.
Sylvia Smith made a motion to approve the request due to it being peculiar to the area. Motion
died due to a lack of a second.
Ruth Stamm made a motion to table until Mr. Hagan can find out what else is available. Larry
• Blair seconded for discussion. After some discussion the second and motion was withdrawn.

Sylvia Smith made a motion to table the hearing until the August 24, 2000 meeting. Ruth Stamm
seconded.

Legal Description: Lot 17, Orange Park, as recorded in PB 3, PG 42, Public Records of Seminole
County, Florida.
Zoning Classification: SR-IA
Rear Yard Setback Requirement: 4 ft
Present Setback: 16 in.
Variance Needed: 32 in.
The planned use of the property is to construct a shed at the rear of the property.
Any consideration given this request will be appreciated.

Mr. Allen Johnson was present to represent the request. Mr. Johnson stated that the rear yard is
very small and if he were to place the shed at a different location, it would case the removal of a
large oak tree. The oak tree grows at an angle, which takes up most of the backyard. There is an
existing block wall at the alley, which the shed would be attached to.
Sylvia Smith questioned the impact on the oak tree when the footers are dug. Ruth Stamm asked
• how high the shed would be.
Allen Johnson stated that he has an engineer that is designing the footer in a way that would not
harm the roots. The peak of the shed would not be more than 10 ft. tall.
Sylvia Smith made a motion to approve the request. Ruth Stamm seconded.
