Members Present: Larry Blair, Chairman Sylvia Smith Ruth Stamm Barbara Knowles Karl Stairs Others Present: Catherine Reischmann, Asst. City Attorney Dan M. Florian, Building Official Charles Rowe, Director of Community Development Russ Gibson, Land Development Coordinator Mary Muse, Secretary Chairman Larry Blair called the meeting to order at 11:30 A.M. The following case was tabled from the August 10, 2000 meeting. The following letter was submitted for consideration: Board of Adjustment City Hall Sanford, FL 32771 Gentlemen: I am submitting the following information for your consideration in requesting a variance in the Zoning Ordinance. Address: 2582 S. Sanford Avenue Legal Description: Lot 42, Frank L. Woodruffs Subd, as recorded in PB 3 PG 44, Public Records of the Seminole County, Florida Zoning Classification: MR -2 Variance Needed: Chain link fence in front yard The planned use of the property is to obtain approval to allow a chain link fence within the front yard area. Any consideration given this request will be appreciated. Signed: John T. Hagan & Michael A. Kramer, Esq. • Michael Kramer, representative for John Hagan was present. Mr. Kramer stated that his client, Mr. Hagan, is requesting a variance to allow a 4 -ft. chain link fence within the front yard area. • MINUTES — BOARD OF ADJUSTMENT — AUGUST 24, 2000 — 11:30 A.M. PAGE 2 Mr. Hagan would be allowed to have a 4 -ft. masonry, brick, or wood fence within the front yard area without a variance. There are special unique conditions. The pertinent special circumstance is the danger. When Mr. Hagan purchased the property, Sanford Avenue was a two -lane road. The area was mixed use — commercial and residential. Sanford Avenue has become a major four - lane road and the character of the area has changed. Due to the amount of traffic, it is difficult to pull or back out onto Sanford Avenue. If a masonry, brick or wood fence was installed, it could create a dangerous situation due to visibility problems. Mr. Kramer mentioned several other locations on Sanford Avenue, between W. 25`h St. & Wylly Avenue, which had chain link fences within the front yard area. Mr. Hagan is requesting the variance to allow visibility and security and states that it is not out of character for the area. Mr. Stairs stated that the fences in the area are old and the existing fences will be eliminated. Ms. Smith stated that the chain link fence has already been installed and was cited under Code Enforcement for not having a permit. Catherine Reischmann stated that it is not the concern of the Board that the fence was installed without a permit, or there are other chain link fences in the area, or kids are playing in the front • yard. The Board is required to look at the special needs of this property, not the owner or the area. Ms. Stamm made a motion to deny the request. Ms. Knowles seconded. Blair - aye Smith - nay Stamm - aye Knowles - aye Stairs - aye Motion carried. Under New Business, there was discussion regarding member attendance. The members agreed to call the secretary in advance if they would not be able to attend the scheduled meeting in order to receive an excused absence. After 3 unexcused absences, the Board can remove the member. There being no further business, the meeting was adjourned. L Blair, h C
