HomeMy WebLinkAbout4175 Repealing PERC PUBLIC EMPLOYEES RELATIONS COMMISSION ORDINANCE NO. 2009-4175 An ordinance of the City of Sanford, Florida relating the City's Public Employees Relations Commission; providing for the repeal of City ordinance numbers 1338, 1343, 1412, 1417, 1429, 1492, 1535, 1548, 2025 and 3287; providing for legislative findings and intent; providing for implementing administrative actions; providing for conflicts; providing for a savings provision; providing for non- codification; providing for severability and providing for an effective date. Be it enacted by the People of the City of Sanford, Florida: Section 1. Legislative findings and intent. The City Commission hereby determines that the provisions of Part II of Chapter 447, Florida Statutes, and other controlling law, adequately provide for and implement the public policy of the State of Florida as stated in Section 6, Article I of the Constitution of the State of Florida such as with respect to public employees and the promotion harmonious and cooperative relationships between governments and their employees, both collectively and individually. The prior institution of a local Public Employees Relations Commission and associated processes and procedures are not necessary for the City and, indeed, may cause confusion and a waste of resources. The City may reasonably rely upon the processes and procedures set forth in controlling State law and the exercise of appropriate jurisdiction by the Florida Public Employees Relations Commission. Section 2. Conflicts/Repealer. (a). All ordinances or part of ordinances in conflict with this Ordinance are hereby repealed. (b). City ordinance numbers 1338,1343,1412,1417,1429,1492,1535,1548, 2025 and 3287 are hereby repealed. Section 3. Implementing Administrative Actions. The City Manager, or designee, is hereby authorized and directed to implement the provisions of this Ordinance and to take any and all necessary administrative actions. Section 4. Savings. The prior actions of the City of Sanford relative to the labor management activities of the City are hereby ratified and affirmed. 1 Section 5. Severability. If any section, sentence, phrase, word, or portion of this Ordinance is determined to be invalid, unlawful or unconstitutional, said determination shall not be held to invalidate or impair the validity, force or effect of any other section, sentence, phrase, word, or portion of this Ordinance not otherwise determined to be invalid, unlawful, or unconstitutional. Section 6. Codification. This Ordinance shall not be codified in the City Code of the City of Sanford. Section 7. Effective Date. This Ordinance shall take effect immediately upon passage and adoption. Passed and adopted this 8th day of June, 2009.
