HomeMy WebLinkAbout4181 FLUM Ordinance No. 4181 An Ordinance of the City of Sanford, Florida amending the City of Sanford Comprehensive Plan, as previously amended; amending the Future Land Use MaplFuture Land Use Element of Comprehensive Plan relating to an array of land use designation assignments currently assigned to 63.4+- acres located in and around the Georgetown Neighborhood and Sanford Avenue within the City Limits (maps of the properties are attached); assigning the following land use designations within the Georgetown Neighborhood: to LDR-SF, Low Density Residential Single Family Development: 310 parcels/52.397+- acres, to ROI, Residential/Office/Institutional: 5 parcels/6.224+- acres, and to NC, Neighborhood Commercial Development: 33 parcels/4.807+- acres; providing for legislative findings and intent; providing for amendments as described and depicted in the exhibits/maps to this Ordinance; providing for ratification of prior acts of the City Commission and others both specifically and generally; providing for conflicts; providing for the adoption of exhibits/maps by reference; providing for codification and directions to the Code codifier and providing for an effective date. Whereas, the Florida Legislature in enacting growth management laws expressed its intent and established State policy that local planning be a continuous and ongoing process; and Whereas, after extensive neighborhood meetings and research in 2006 and 2007, the Georgetown Neighborhood Plan was adopted by the City Commission of the City of Sanford on March 10, 2008 which Plan addressed the future vision for the Georgetown Neighborhood and provided for a framework for revitalization of the Neighborhood; and Whereas, the City Commission, by adopting the Plan, took action which was aimed at improving the quality of life for residents in and around the Georgetown Neighborhood and is based on the guidelines set forth by the Florida Department of Community Affairs' (FDCA) program for Holistic Neighborhood Revitalization; and Whereas, one goal of the Plan involves a comprehensive re-planning of the 1 an area of the City of Sanford that is generally known as the Georgetown Neighborhood in order to protect the single-family character of the community and the residents of the Neighborhood; and Whereas, in addressing the future of the Georgetown Neighborhood, the Plan recommended amending the Future Land Use Maps and the Official Zoning Maps to guide future development in a manner that is sensitive to the community's historic and cultural resources with the amendments being viewed in the context of the Plan instead of as individual unrelated ad hoc amendments with the coordinated amendments encouraging the rehabilitation of historic structures and the conversion of multi-unit dwellings to their original single-family residential uses, prohibiting the conversion of single-family residences into multi-unit dwellings, and providing commercial land use designations which will support areas of opportunity for commercial investment thus providing the Neighborhood with additional goods, services and employment opportunities; and Whereas, the planning actions taken in this Ordinance will serve to guide future development in a manner that is sensitive to the Neighborhood's historic and cultural resources and otherwise benefit the community; and Whereas, the planning actions taken in this Ordinance will encourage converting multi-unit dwellings back to single-family residential and encourage the rehabilitation and improvement of existing structures all of which will enhance the Neighborhood, specifically, and the City of Sanford, generally; and Whereas, the planning actions taken in this Ordinance will also restrict the conversion of existing single-family residences into multi-unit dwellings and thereby 2 benefit the Neighborhood; and Whereas, the City's Planning and Development Services Department held two public meetings (on September 10, 2008 and on April 29,2009) to advise property owners of the Neighborhood relative to the proposed planning actions as taken in this Ordinance and in order to provide information as to how the planning actions would affect the properties and the ownership rights and entitlements relative to the properties; and Whereas, the proposed future land use designation amendments (as reflected in the Future land Use Map) set forth in this Ordinance are one tool to implement the Plan's goal of preserving the positive character of the Neighborhood and to eliminate those land uses that are incompatible with that character; and Whereas, the City of Sanford Planning and Zoning Commission held a public hearing on June 18, 2009 to receive public input and comment on the proposed amendments to the City of Sanford Comprehensive Plan and to make recommendations to the City Commission and a copy of the materials considered and recommendations made by the Planning and Zoning Commission are on file in the office of the City Clerk for public review and consideration; and Whereas, the City Commission of the City of Sanford held public hearings on July 13, 2009 and October 12, 2009 to receive public input and comment on the proposed amendments to the City of Sanford Comprehensive Plan; and Whereas, the proposed changes to the City of Sanford Comprehensive Plan are vital to the future growth and development of the City of Sanford and further the City Commission's goal of providing a high quality of life to the citizens of the City; and 3 Whereas, pursuant to Part II, Chapter 163, Florida Statutes, the City Commission of the City of Sanford desires to favorably act upon the proposed amendments to the City of Sanford Comprehensive Plan and authorize their transmittal to the FDCA and other agencies as required by State law; and Whereas, the City Commission of the City of Sanford hereby adopts and incorporates into this Ordinance the City staff report and City Commission agenda memorandum relating to the proposed amendments to the City of Sanford Comprehensive Plan as well as the Data, Inventory and Analysis used to support such amendments; and Whereas, this Ordinance is internally consistent with the goals, objectives and policies of the City of Sanford Comprehensive Plan; and Whereas, the City of Sanford has complied with all requirements and procedures of Florida law in processing this amendment to the City of Sanford Comprehensive Plan including, but not limited to, those prescribed in Section 163.3184, Florida Statutes. Now, therefore, be it enacted by the People of the City of Sanford, Florida: Section 1. Legislative findings and intent. (a).The City Commission of the City of Sanford hereby adopts and incorporates into this Ordinance, as legislative findings and intent, the City staff report and City Commission agenda memorandum relating to the proposed amendments to the City of Sanford Comprehensive Plan. (b). The Exhibits (maps) to this Ordinance are incorporated herein as if fully set forth herein verbatim. The Exhibits/maps consist of the following: 4 (1). Proposed Future Land Use Map. (2).Proposed Individual site maps. (A composite exhibit). (c). The City Commission of the City of Sanford hereby adopts as legislative findings and intent the recitals (whereas clauses) to this Ordinance. Section 2. Amendment to City of Sanford Comprehensive Plan. (a). The amendments to the City of Sanford Comprehensive Plan are reflected in the attached maps and provide for changes as follows: (1). To LDR-SF, Low Density Residential Single Family Development: 310 parcels, 52.397+- acres. (2). To ROI, Residential/Office/Institutional: 5 parcels, 6.224+- acres. (3). To NC, Neighborhood Commercial Development: 33 parcels, 4.807+- acres. (b). The prior actions of the City Commission of the City of Sanford and its boards, commissions, officers, officials and employees relative to the subject land areas and the actions relating thereto pertaining to the adoption and implementation of the City of Sanford Comprehensive Plan are hereby ratified and affirmed Section 3. Implementing Administrative Actions. The City Manager, or designee, is hereby authorized and directed to implement the provisions of this Ordinance and to take any and all necessary administrative actions necessary to process the provisions of this Ordinance. Section 4. Severability. If any section, sentence, phrase, word, or portion of this Ordinance is determined to be invalid, unlawful or unconstitutional, said determination shall not be held to 5 invalidate or impair the validity, force or effect of any other section, sentence, phrase, word, or portion of this Ordinance not otherwise determined to be invalid, unlawful, or unconstitutional. Section 5. ConflictslRatification of Prior Actions. All ordinances or parts of ordinances in conflict herewith are hereby repealed. The prior actions of the City Commission and its agencies in enacting and amending the City of Sanford Comprehensive Plan are hereby ratified and affirmed. Section 6. Codificationllnstructions to Code Codifier. It is the intention of the City Commission of the City of Sanford, Florida, and it is hereby ordained, that the provisions of this Ordinance shall become and be made a part of the codified version of the City of Sanford Comprehensive Plan and/or the Code of Ordinances of the City of Sanford, Florida and that the City of Sanford Comprehensive Plan shall be codified and made available to the public and broadly made available to the public as is the overall provisions of the Code of Ordinances of the City of Sanford, Florida. The actual text of the Sections to this Ordinance need not be codified. The Code codifier of the City is given broad and liberal authority to appropriately codify the provisions of the City of Sanford Comprehensive Plan in a format that can be readily published and distributed in a useable and manageable format. The City Manager, in conjunction with the City Clerk and the City Attorney, are hereby granted the authority to take any and all necessary and appropriate actions to accomplish the provisions of this Section. Section 7. Effective Date. The effective date of this Ordinance and City of Sanford Comprehensive Plan 6 amendments set forth in this Ordinance shall be the date a Final Order is issued by the Florida Department of Community Affairs finding the amendment to be in compliance, in accordance with the provisions of Section 163.3184, Florida Statutes, or the date a Final Order is issued by the Administration Commission (the Governor and Cabinet) finding the amendment to be in compliance, in accordance with Section 163.3184, Florida Statutes. FISCAL/STAFFING STATEMENT: None BACKGROUND: On July 13, 2009 the City Commission unanimously approved the first reading of Ordinance 4181 to amend the future land use map of the Comprehensive Plan for parcels of land in the vicinity of Sanford A venue and the Georgetown neighborhood and directed staff to transmit the amendments to the Department of Community Affairs. The DCA reviewed the amendments and has no objection to their adoption. The proposed future land use amendments are one tool in the implementation of the Georgetown Neighborhood Plan, adopted by the City Commission on March 10,2008. The Georgetown Plan recommended amending the future land use map and the zoning map to guide future development in a manner that is sensitive to the community's historic and cultural resources. LEGAL REVIEW: The ordinance was prepared by the City Attorney's office. RECOMMENDATION: On June 18, 2009, the Planning and Zoning Commission unanimously recommended that the City Commission approve Ordinance No. 4181 to amend the future land use map of the Comprehensive Plan. lof2 SUGGESTED MOTION: "I move to adopt Ordinance No. 4181 to amend the future land use map of the Comprehensive Plan.
