Ms. Dennison moved to approve the Minutes of the February 7, 2008 Regular Meeting. Mr. Robert seconded. All in
favor~ Motion carried 7-0.

Mr. Yolk moved to accept the proof of publications. Mr. Huber seconded. All in favor. Motion carried 7-0.
PUBLIC HEARINGS
Hold a Public Hearing to consider a conditional use request to allow outdoor seating within the required front setback
for Skibo's Restaurant at 2435 French Avenue. John Sobik, Jr., property owner; Oennis J. Sobik, representative.
During discussion regarding the ground sign compliance, Commissioner Randy Jones came fOf'\Vard to advise the
Planning and Zoning Commission members the City Commission will be considering an I8-month temporary sign
amnesty ordinance at their meeting on Monday, February 25th. .
Mr~ Robert moved to approve the conditional use per staffs recommendation, with the deletion of item #3 - The
existing pole sign must be removed and signage brought into compliance with Schedule K, Sign Ordinance. Mr. Yolk
seconded. All in favor. Motion carried 7..0~

Present to speak in opposition were Robert Huey-20 1 W 19th Street, Bernie and Marie Hilgenberg-207 W 20th Street,
Mark Hoen-316 W 20th Street and Randy Jones-120 W 20th Street. The concerns were: they want to preserve their
neighborhood as residential and concerned if this type of business were allowed to operate it would set a precedent and
allow other type of commercial uses; they were concerned about the safety of the elderly if they were to wander
outside because of the heavy traffic along 20th Street as well as in the alleyway; they were concerned about property
values and property taxes; and concerned to hear they were currently using the house to hold meetings with proposed
clients.
Mr~ Robert moved to deny the conditional use due to the use being too intense for the area as well as the proposed site
does not meet every criterion listed in Schedule E, section 7.0-D-2. Mr. Kutz seconded. All in favor~ Motion carried
7-0.
Hold a Public Hearing to re-consider the conditional use request to allow outdoor manufacturing at 1150 Albright
Road. Treadmasters, Inc., property owner; Sid Vihlen, Jr. and Roy Fluharty - Nelson LLC, representatives.
Per the applicant's request, Mr. Robert moved to continue the conditional use until the March 20th meeting. Ms.
Dennison seconded. All in favor. Motion carried 7-0.
Hold a Public Hearing to rezone 0.18 acre from SR-I, Single-Family Residential, to RC-I, Restricted Commercial, at
2612 Hiawatha Avenue. Felipe K. DeRivero, property owner/representative~ Mr. Garrett read a letter from Gloria Stair,
property owner next door. She was concerned the increased traffic may impose an unsafe environment, as well as
affecting her property value.
Mr. Huber moved to recommend approval to the City Commission per staff's recommendation. Mr. Yolk seconded.
All in favor. Motion carried 7-0.

Mr. Robert moved to approve the Comprehensive Sign Plan per staffs recommendation. Ms. Dennison seconded. Mr.
Kutz against, all others in favor. Motion carried 6-1.
