White Cedar Road. Tax Parcel Number: 26-19-30-5AE-030C-0000 Property Owner: Meena G. Chaudhari Trustee FBO Representative: Jason G. Toll PH-3 Hold a Public Hearing to consider a Conditional Use to establish a House of Worship at 1916 W. 13th Street for World of Faith and Deliverance. MINUTES Mr. Kutz moved to approve the Minutes of the September 6, 2007 Regular Meeting. Mr. Yolk seconded. All in favor. Motion carried 5-0 (Ms. Dennison not present at this time). PUBLIC HEARINGS Remove from the table and hold a public hearing to consider a conditional use to establish vehicular sales and storage at 410 W. 13th Street for the adjacent business, Auto Care Clinic. Food With Care, Inc., property owner; Toby Wells, Darren Jones and Rose Jones, representatives. Anthony Miller was present to speak in favor. Dirk Miller, adjacent property owner, was present to inform the commission he was not opposed to the request, but wanted to ensure there would not be a parking problem if there was a change of oVlllership on the property. Mr. Yolk moved to remove from table. Mr. Kutz seconded. All in favor. Motion carried 5..0 (Ms. Dennison not present at thi s time). Prior to a motion being made, the applicant withdrew their request. Mr. Kutz moved to accept the request to withdraw. Mr. Yolk seconded. All in favor~ Motion carried 6-0. Hold a public hearing to consider a request to rezone 2.39 acres from AG, Agriculture to PD, Planned Development for a proposed warehouse/office development located at 251 S. White Cedar Road. Meena G. Chaudhari Trustee FBO, property owner; Jason Toll and Casidys Suvongse, representatives. Mr. V onHerbulis moved to approve the conditional use per staffs recommendation with the following addition to Item 3: improvements to S. White Cedar Road to the southerly property line will be required and said improvements must meet Seminole County's standards. Ms. Dennison seconded~ After further discussion, Mr. V onHerbulis amended the motion to change Item 5 to allow a seven foot opaque or masonry wall. Ms. Dennison seconded. All in favor. Amended motion carried 6-0. MINUTES - SEPTEMBER 20, 2007 PLANNING AND ZONING COMMISSION PAGE 2 Hold a public hearing to consider a conditional use to establish a house of worship at 1916 W. 13th Street for World of Faith and Deliverance. Harlan and Carolyn Walker, property owners; Harlan Walker, representative. The following were opposed to the request: Olive Johnson, Kenneth Bentley, Gail Choice, Ronald Merthie, Willie Hooks, and Rosa Jenkins. They were concerned about the traffic and noise a church would create and would like the property to remain residential. They also would like to see retail and restaurant uses along 13th Street, not another church or a community resource facility. Commissioner Williams came forward to clarify the area the residents would like to keep as residential on W. 13th Street, which is the area between Southwest Road and Crooms Academy. Mr. Green moved to deny the conditional use due to the request not meeting the following standards: Item D - The design of the proposed development must minimize adverse effects, including, but not limited to, visual, noise and traffic impacts of the proposed use on the surrounding properties, Item E - The conditional use must be compatible with the nature and intensity of the development surrounding the premise and with the community character of the immediate vicinity of the parcel proposed for development and Item F - The location and topography of the premises proposed for development must make the use an appropriate use which will not adversely affect the public interest Mr. Yolk seconded. All in favor~ Motion carried 6-0. STAFF REPORTS A staff report was distributed for the board's review. The commission requested a copy of the approved building color standards. Mr. VonHerbulis requested a copy of the 133 N. White Cedar request CITIZEN PARTICIPATION None.
