Ordinance No. 2009-4196
An Ordinance of the City of Sanford, Florida creating a special
assessment district for the purpose of providing the design,
permitting, right-of-way acquisition, construction and any and
all other related or necessary actions that pertain to the
improvement of Whippoorwill Court as a publicly dedicated
right-of-way located within the City Limits; providing for
legislative findings and intent; providing for attachment and
incorporation of exhibits; providing for the District to be
known as the "Whippoorwill Court Special Assessment
District"; providing for a short title; providing for legislative
findings and intent; providing for legal descriptions of the
properties located within the District; providing for the
governing of the District by the City Commission of the City of
Sanford; providing for a formula for special assessments
made within the District; providing for a list of assessments to
be made and collected based on application of the assessment
formula of a per lot basis pertaining to the ownership of
properties benefitted and fiscal procedures; providing for the
taking of implementing administrative actions; providing for
codification; providing for severability; providing for conflicts
and an effective date.
Whereas, the City Commission of the City of Sanford, Florida has the
power and authority to create and establish special assessment districts under
the controlling provisions of State law such as, by way of example only, the
provisions of Article VIII, Section 2 of the Constitution of the State of Florida and
the provisions of Chapter 166, Florida Statutes, and the controlling case law of
the Stat of Florida; and
Whereas, the City Commission of the City of Sanford, Florida, approved
numerous agreements with the owners of real property located within the plat of
the Whippoorwill Subdivision as recorded at Plat Book 40, Page 60 of the Public
Records of Seminole County, Florida; and

Whereas, the dedicated right-of-way is generally described as Tract "A" of
the Whippoorwill Subdivision and is known as Whippoorwill Court and generally
located and described and depicted in Exhibit "A" which Exhibit is attached
hereto and made a part hereof by this reference thereto as if fully set forth
verbatim within the text of this Ordinance; and
Whereas, the owners of Lots located within the Whippoorwill Subdivision
and the City of Sanford have agreed that certain improvements will be
implemented with regard to Whippoorwill Court which improvements will be
funded, in part, by means of special assessments being imposed upon the Lots
located within the Whippoorwill Subdivision.
Now, Therefore, be it Enacted By the People of the City Of Sanford,
Florida:
Section 1. Short Title.
This Ordinance shall be known and referred to as the Whippoorwill Court
Special Assessment District Ordinance.
Section 2. Legislative Findings and Intent.
(a). The City Commission of the City of Sanford hereby adopts and
incorporates into this Ordinance the recitals (whereas clauses) to this Ordinance,
the City staff report and City Commission agenda memorandum relating to the
application and the proposed vacation of the right-of-way as set forth herein.
(b). The City of Sanford has complied with all requirements and
procedures of Florida law in processing and advertising this Ordinance.

(c). This Ordinance is consistent with the goals, objectives and policies
of the Comprehensive Plan of the City of Sanford, the Land Development
Regulations of the City of Sanford, and other controlling law.
(d). The City Commission of the City of Sanford has determined that the
assessment of special assessments to fund the road improvements relating to
Whippoorwill Court are in accordance with the provisions of controlling Florida
law. See, for example, Atlantic Coast Line R. Co. v. City of Gainesville, 91 So.
118 (Fla. 1922), and Bodner v. County of Coral Gables, 245 So. 2d 250 (Fla.
1971 ).
Section 3. Creation of Special Assessment District; Legal
Description; Improvements.
There is hereby created within the City of Sanford, the Whippoorwill Court
Special Assessment District, henceforth referred to as "the District" which shall
constitute all lands located within the plat of the Whippoorwill Subdivision as
recorded at Plat Book 40, Page 60 of the Public Records of Seminole County,
Florida. The District is established for the purposes of providing road
improvements for Whippoorwill Court as depicted in the road improvement plans
set forth in Exhibit "B". The purposes and expenses of the District shall
encompass and include, but not be limited to, the following:
(1). The design, permitting and construction of the road improvements
relating to Whippoorwill Court; and
(2) Any and all related costs which may be incurred to administer and
implement the project.

Section 4. Powers and Duties of Governing Board.
(a). The Whippoorwill Court Special Assessment District shall be
governed by the City Commission of the City of Sanford, Florida, which the
Commission shall have, together with all other lawful appurtenant and necessary
powers and duties, the following powers and duties:
(1). To provide for the collection by the City of such funds to reimburse
the City for any and all expenditures relating to the design, permitting and
construction of the road improvements pertaining to Whippoorwill Court and any
and all related costs which may be incurred to administer and implement the road
improvements pertaining to Whippoorwill Court plus an administrative fee to fund
the necessary and associated administrative functions relative to the construction
of the road improvements relating to Whippoorwill Court within the District.
(2). To levy non-ad valorem assessments upon property located within
the District as set forth in this Ordinance and to provide for the collection of such
special assessments.
(b). The operations and actions of the District shall be as set forth and
required by the provisions of Florida law relating to public meetings, public
records and other requirements of law relating to municipalities.
Section 5. Administrative Costs.
All property owners within the District shall be charged a 3% (three
percent) administrative fee relating to the design, permitting and construction of
the road improvements relating to Whippoorwill Court, related costs, and any and

all other costs associated with the project pertaining to Whippoorwill Court
regardless of whether provided by contract or in-house.
Section 6. Assessment Methodology.
Properties within the District shall be assessed based upon the number of
Lots located within the District and each Lot shall be equally assessed.
Section 7. List Of Assessments.
The affected Lots, legal description, tax identification numbers, and list of
initial assessments are contained in Exhibit "Cn of this Ordinance, which is
hereby incorporated herein by this reference thereto as if fully set forth herein
verbatim. These initial special assessments may be administratively adjusted to
account for any future change that may justify such adjustment in accordance
with the controlling provisions of State law. Additionally, the initial special
assessments are subject to adjustment and equalization at a public meeting of
the City Commission at which a final special assessment resolution shall be
adopted in accordance with the provisions of this Ordinance.
Section 8. Method Of Charging And Collection.
(a). Properties within the District shall be charged, as non-ad valorem
special assessments, the costs and fees resulting from the design, permitting
and construction of the road improvements relating to Whippoorwill Court and
related costs.
(b). Each Lot owner within the District shall be billed by the City which
shall be sent certified mail following the City's calculation of the costs of the road

improvements relating to Whippoorwill Court. Payment shall be due to the City at
the time the City sends the notice.
(c). The City Commission shall adopt a resolution setting forth the final
amount of special assessments with regard to those property owners who have
not paid the special assessment as a result of being billed as set forth in
Subsection 8(b). The resolution shall be recorded and constitute a lien upon the
properties within the District as set forth in the Resolution.
(d). The assessments imposed pursuant to this Ordinance will be
imposed by the City Commission, not the Seminole County Property Appraiser or
the Seminole County Tax Collector. Any activity of the Seminole County Property
Appraiser or the Seminole County Tax Collector under the provisions of this
Ordinance shall be construed solely as ministerial.
(e). If full payment is not made within thirty (30) days of the date that
the payment is due, interest shall be charged upon the unpaid balance in
accordance with the controlling codes and ordinances of the City as determined
by the City's Finance Director.
Section 9. Recordation; Implementing Administrative Actions.
(a). The City Manager, or designee, shall record in the Public Records
of Seminole County a certified copy of this Ordinance which shall constitute
notice to all property/Lot owners within the District and all others having current
or future interests in the properties/Lots that the properties/Lots shall be subject
to special assessment collection.
(b). The City Manager, or designee, shall take all necessary actions

relative to implementing the provisions of this Ordinance and with regard to the
collection of the special assessments imposed herein and in future adopted
resolutions in accordance with the uniform method for collection of non ad
valorem special assessments.
Section 10. Method Of Collection.
(a). The special assessments imposed by this Ordinance,
assessments shall be collected pursuant to the Uniform Assessment Collection
Act, and the City shall comply with all applicable provisions thereof including, but
not limited to:
(1). Entering into a written agreement with the Seminole County
Property Appraiser and the Seminole County Tax Collector for reimbursement of
necessary expenses to the extent required by law or deemed appropriate by the
assessment coordinator, and
(2). Adopting a resolution of intent which may be adopted either prior to
or following the initial assessment resolution; provided, however, that the
resolution of intent must be adopted prior to January 1 (or March 1 with consent
of the Seminole County Property Appraiser and the Seminole County Tax
Collector) of the year in which the assessments are first collected on the ad
valorem tax bill.
(b). Any hearing or notice required by this Ordinance may be combined
with any other hearing or notice required by the Uniform Assessment Collection
Act.
(c). Costs and expenses of collection of assessments may be included

annually as part of the assessments and be collected in the manner provided
herein. Amended resolutions may be adopted and recorded as necessary.
Section 11. Conflicts.
All ordinances or part of ordinances in conflict with this Ordinance are
hereby repealed.
Section 12 Severability.
If any section, sentence, phrase, word, or portion of this Ordinance is
determined to be invalid, unlawful or unconstitutional, said determination shall not
be held to invalidate or impair the validity, force or effect of any other section,
sentence, phrase, word, or portion of this Ordinance not otherwise determined to
be invalid, unlawful, or unconstitutional.
Section 13. Codification.
The provisions of this Ordinance shall become and be made a part of the
Code of Ordinances of the City of Sanford, Florida and the Sections of this
Ordinance may be renumbered or relettered to accomplish such intention and the
word "Ordinance", or similar words, may be changed to "Section," "Article", or
other appropriate word; provided, however, that Sections 11, 12, 13, and 14 shall
not be codified.
Section 14. Effective Date.
This Ordinance shall become effective immediately upon enactment.
