MINUTES Mr. Huber moved to approve the Minutes of the October 19, 2006 Regular Meeting. Mr. Volk seconded. Mr. Kutz not present at this time, all others in favor. Motion carried 5 -0. PROOF OF PUBLICATION Mr. Garrett moved to accept the proof of publications for the Public Hearings being considered. Mr. Huber seconded. Mr. Kutz not present at this time, all others in favor. Motion carried 5 -0. CONSENT AGENDA Approve the Final Plat for Amberlee Townhomes at 1301 E. Airport Boulevard. Mr. Green moved to approve the Final Plat per staff's recommendation. Mr. Volk seconded. Mr. Kutz not present at this time, all others in favor. Motion carried 5 -0. PUBLIC HEARINGS Hold a Public Hearing to consider a request to Rezone 4.53 acres at 361 S. White Cedar Road from AG, Agricultural to PD, Planned Development for a proposed light industrial office development; Mary McKeever, Kevin Colton, Lygia Colton, et al, property owners; Mary McKeever, representative. Additional staff recommendations stated by Mr. Gibson were: 1) the parking spaces shall comply with LDR requirements; and 2) the landscaping buffer shall be a minimum of 15 feet wide. Mr. Green moved to approve the Rezone per staff's amended recommendation. Mr. Volk seconded. Mr. Kutz not present at this time, all others in favor. Motion carried 5 -0. MINUTES — NOVEMBER 2, 2006 PLANNING AND ZONING COMMISSION PAGE 2 Hold a Public Hearing to consider a Conditional Use request for an Urban InfiIl project to vary the townhome requirements for a 4 -unit multi - family townhouse at 110 W. 24th Street; Leo C, Nelson, Jr., owner and representative. Additional staff recommendations stated by Mr, Gibson were: 1.) the garages are to remain for vehicular use, not storage and 2) in lieu of a 4 foot wall, enhanced landscaping shall be installed. Present to speak in opposition were: Linda Miller of 2404 oak Avenue (renters do not have an investment in the neighborhood), Sharon Swalina of 2316 Park Avenue (concerned about the lot size, opposed to any two -story structure because it would block the sunlight from her property and it would interfere with her property rights), Ruthe Depe of 2314 Park Avenue (opposed to rental units and it would take away the privacy for the Park Ave Villas), William Clayton of 2305 oak Avenue (submitted a petition signed by 30 neighbors, the project does not meet the townhome standards and there are existing drainage problems in the area), and Henry Sweet of 2300 Oak Avenue (verification on why townhome standards have to be met when apartments are allowed in the RMOI zoning district, opposed to apartments and this project would disrupt their quality of life). Mr. Kutz moved to deny the request to vary the townhome standards for a 4 -unit multi -- family townhouse based on the request not meeting the following Standards for Conditional Use: 1) the design of the proposed development must minimize adverse effects, including, but not limited to, visual, noise and traffic impacts of the proposed use on the surrounding properties; 2) the conditional use must be compatible with the nature and intensity of the development surrounding the premises and with the community character of the immediate vicinity of the parcel proposed for development; and 3) the location and topography of the premises proposed for development must make the use an appropriate use which will not adversely affect the public interest. Mr. Huber seconded. Motion to deny carried 5 to 1, with Mr. Green in opposition to the motion. STAFF REPORTS A staff report was included in the agenda packet for the board's review, COMMISSIONERS REPORTS None. CITIZEN PARTICIPATION None.
