PH- I Hold a Public Hearing to consider proposed amendments to the City of Sanford Land Development Regulations, Schedule N, Subdivision Requirements. Representative: Antonia Gerli, Principal Planner -City of Sanford PH -2 Hold a Public Hearing to consider a Conditional Use for an Urban Infill Redevelopment for the Little School Academy, a Pre -K educational facility proposed at 805 Cypress Avenue. Tax Parcel Numbers: 25- 19- 30- 5AG -10oB -0050, 25- 19- 30- 5AG -10oB -0060, 25- 19- 30- 5AG --10OB --0070 Property Owners: Hortense G. Evans and Lowman J. Oliver, Sr. Representative: Dr. Preston Adams PH -3 Hold a Public Hearing to consider a Conditional Use for an Urban Infill Redevelopment of an existing non- conforming property at 2484 Sanford Avenue to allow a retail Bait Shop. Tax Parcel Numbers: 36-19-30-542-0000-0200 Property Owners: Mahendra and Mina Vyas Representative: Richard Powell Staff Reports Citizen Participation Commissioners Reports Adjournment ADVICE TO THE PUBLIC. MINUTES Mr. Kutz moved to approve the Minutes of the July 6, 2006 Regular Meeting. Mr. Volk seconded. Mr. Huber not present at this time, all others in favor. Motion carried 6-0. PROOF OF PUBLICATION Mr. VonHerbulis moved to accept the proof of publication for the Public Hearings being considered. Ms. Dennison seconded. Mr. Huber not present at this time, all others in favor. Motion carried 6 -0. PUBLIC HEARINGS With the consensus of the Board, items PH -2 and PH -3 were considered before item PH -1. Hold a Public Hearing to consider a Conditional Use for an Urban Infill Redevelopment for the Little School Academy, a Pre -K. educational facility proposed at 805 Cypress Avenue; Hortense G. Evans and Lowman J. Oliver, Sr., property owners, Dr. Preston Adams and Chris Andexler, representatives. Present to speak in opposition was 011ie Williams and Juanita Papino. Their concerns were traffic, noise, current sewage problems and deliveries to the facility.. Mr. VonHerbulis moved to deny the Conditional Use based on the request not meeting the Standards for Conditional Use including specifically the following requirements: the design of the proposed development must minimize adverse effects, including, but not limited to, visual, noise and traffic impacts of the proposed use on the surrounding properties and the proposed use must be compatible with the nature and intensity of the development surrounding the premises and with the community character of the immediate vicinity of the parcel proposed for development. Mr. Lutz seconded. All in favor. Motion carried 7 -0. MINUTES - JULY 2 0, 2006 PLANNING AND ZONING COMMISSION PAGE 2 Hold a Public Hearing to consider a Conditional Use for an Urban Infill Redevelopment of an existing non- conforming property at 2484 Sanford Avenue to allow a retail Bait Shop; Mahendra and Mina Vyas, property owners. A letter from the owner was received requesting the public hearing to be continued. Per the owner's request, Mr, Garrett moved to continue the Conditional Use for 30 days. Mr. Huber seconded. All in favor. Motion carried 7 -0. Hold a Public Hearing to consider proposed amendments to the City of Sanford Land Development Regulations, Schedule N, Subdivision Requirements; Antonia Gerli, Principal Planner -City of Sanford, representative. Mr, Huber moved to approve the proposed amendments to Schedule N per staff s recommendation. Mr, Volk seconded. All in favor. Motion carried 7 -0. CITIZEN PARTICIPATION None. STAFF REPORTS A staff report was included in the agenda packet for the board's review. COMMISSIONERS REPORTS None. ADJOURNMENT There being no further business, the meeting adjourned at I I ° 17 AM.
