CITY COMMISSION CHAMBERS CITY HALL, SANFORD, FLORIDA MEMBERS PRESENT: Ross Robert, Chairman Brian Volk Richard Huber Rami Yosefian Bobby VonHerbulis Carol Dennison Otto Garrett MEMBERS ABSENT Andy Kutz, Vice Chairman Mike Skat, excused OTHERS PRESENT: Larry Robertson, Development Services Manager Mary Muse, Secretary Mr. Robert called the meeting to order at 7:05 P.M. MINUTES Mr. Huber moved to approve the Minutes of the August 18, 2005 Worksession and Regular Meeting. Mr. Garrett seconded. Mr. Vo nHerbulis Was not present at this time, all others in favor , Motion carried. PROOF OF PUBLICATION Ms. Dennison moved to accept the proof of publication for the Public Hearing being considered. Mr_ Yosefian seconded. Mr. VonHerbulis was not present at this time, all others in favor. Motion carried. PUBLIC HEARINGS. McIntosh Associates, Inc. and Tina Demostene -Pulte Homes, representatives. Mr. Yosefxan moved to approve the Rezone per staff s recommendation. Mr_ Volk seconded. All in favor= Motion carried. DEVELOPMENT PLANS. Consider the Preliminary Subdivision Plan for Regency oaks, Phases 2 and 3 at 1000 Upsala Road; John Townsend, P.E. - Donald W, McIntosh Associates, Inc. and Tina Demostene-Pulte Homes, representatives. Mr . VonHerbulis moved to approve the Preliminary Subdivision Plan per staff s recommendation with the addition that staff and the applicant work together to provide, if possible, an emergency access at the northwest corner of the project and have staff check to see if it is possible to vacate Upsala Road from the curve going east to Central Park Drive. Mr. Volk seconded. All in favor., Motion carried. MINUTES — SEPTEMBER 1, 2005 PLANNING AND ZONING COMMISSION PAGE 2 Consider the Preliminary Subdivision Plan for Lake Mary Complex at 1160 W. Lake Mary Boulevard; Lake Mary Development Partners, LLC, owner; Shane Murray -Lake Mary Development Partners, LLC and David Nelson — PEC Engineering, representatives. Mr Yosefian moved to approve the Preliminary Subdivision Plan per staff s recommendation. Mr. Huber seconded. All in favor. Motion carried. SUNSET REVIEW. Consider the one -Year Sunset Provision as stipulated by the Planning and Zoning Commission on April 1, 2004 for the Conditional Use approval for an Urban Infill Redevelopment of the Szabo House at 2405 !12 Palmetto Avenue; Estate of Esther M. Szabo per rep Darlene S. Szabo; owner, Darlene S. Szabo, representative. Present to speak were David Higginbotham and Grace Pittman. They were concerned about the traffic /access from the alley and the lack of maintenance to the property. Mr. VonHerbulis moved to approve the one -year sunset provision per staff s recommendation. Mr. Garrett seconded. Motion carried with a vote 4 to 3. Those in favor were VonHerbulis, Garrett, Yosefian, and Dennison. Those against were Robert, Huber and Volk. STAFF REPORTS An Informational Memo was distributed to each board member, which gave an update on some past items /issues. Ms. Dennison thanked staff for resolving the fence issue at Nate's Store on Upsala Road. COMMISSIONERS REPORTS, Mr. Robert read a letter of resignation from Michael Skat. Ms. Dennison informed staff that Crown Colony's fence along Dogwood Drive has fallen down. CITIZEN PARTICIPATION. John Leroy informed the board that the Seminole County School Board is working with the developers of the Regency Oaks and Lake Mary Development projects in regards to the school impact issues. He also informed the board that he will be in attendance at the Planning and zoning Commission meetings when there are large residential projects on the agenda. Virginia Huber stated that she attended the Historic Trust meeting and there was a brief discussion about apartments being constructed at 3rd Street and Sanford Avenue and asked if anyone was aware of this p ro'a ect. Mr. Robertson informed her that he had a brief conversation with the property owner and his plans were to convert the building into 3 office units. ADJOURNMENT.
