CITY COMMISSION CHAMBERS CITY HALL, SANFORD, FLORIDA MEMBERS PRESENT: Ross Robert, Chairman Andy Kutz, Vice Chairman Brian Volk Mike Skat Richard Huber Rani Yosefian Carol Dennison Eddie Green MEMBERS ABSENT Otto Garrett, excused Bobby VonHerbulis, excused OTHERS PRESENT: Russ Gibson, Director of Planning and Development Services Larry Robertson, Development Services Manager Jared Munster, Planning Intern Mr. Robert called the meeting to order at 7:00 P.M. MINTTTF ,q_ Mr. Skat moved to approve the Minutes of the May 19, 2005 Regular Meeting. Mr. Huber seconded. All in favor. Motion carried. PROOF OF PUBLICATION Ms. Dennison moved to accept the proof of publication for the Public Hearing being considered. Mr. Yosefian seconded. All in favor. Mr. Yoseflan moved to approve the Final Plat for Regency Oaks per staff's recommendation. Mr. Huber seconded. All in favor. Motion carried. DEVELOPMENT PLANS. Consider the Site Plan for Pollo Tropical at 1001 WP Ball Boulevard; NAP Seminole Marketplace LLC, owner, Jill Minton, PE — CPH Engineers, representative. Mr. Kutz moved to approve the Site Plan per staff's recommendation. Mr. Yosefian seconded. All in favor. Motion carried. Consider the Site Plan for Diversified Specialties at 1741 W. l Street; Renal Properties — Sanford, LLC, owner; Richard R. Morris, PE — MDM Services, Inc., representative. Based on discussion regarding the type of construction, Mr. Kutz requested an elevation or architectural rendering be brought to the Planning and Zoning Commission for courtesy review. Applicant agreed. Mr. Kutz moved to approve the Site Plan per staff's recommendation. Mr. Yosefian seconded. All in favor. Motion carried. Motion carried. Consider the Site Plan for S G & K Automotive at 1122 Celery Avenue. S G & K Auto Repair Center, Inc., owner; Sherri M. Mahoney -S G & K Auto Repair, representative. Mr. Skat moved to approve the Site Plan per staff s recommendation, with the removal of conditions A and B. Mr. Huber seconded. All in favor. Motion carried. SUNSET REVIEW. Consider the One Year Sunset Provision as stipulated by the Planning and Zoning Commission on March 18, 2004 for the Conditional Use to allow outdoor Commercial Amusements for The Barn located at 1200 French Avenue; Thomas W etherald, owner; John Masterson, representative. Mr. Green moved to deny the outdoor commercial amusements for The Barn. Mr. Kutz seconded. Mr. Yosefian against, all others in favor. Motion to deny carried. PUB LIC HEARING-. Re- consider a Conditional Use request for Outdoor Automobile Storage for Lanza Auto Storage at 201 Persimmon Avenue. This item was tabled at the May 19, 2005 meeting. Mr. Skat moved to remove the item from the table Mr. Kutz seconded. All in favor, Motion carried. Following discussion Mr, Yosefian moved to deny, Mr. Skat seconded. Mr. Robert against, all others in favor. Motion to deny carried. STAFF REPORTS. The definition of the word "family" was discussed in reference to the use of the term when designating a property as a "single - family" home, etc. COMMISSIONERS REPORTS. Commissioner Williams was present at the meeting and wished to thank the Commission for taking into consideration the citizens who live near both of the sites and for doing what is best for the City in denying the requests of The Barn and Lanza Auto Storage. Both facilities are in her district. Staff was asked to look into the property at 3550 W, 1st Street. First to determine if it is in the City or in the County, and secondly if it is found to be in the City to please take action on the cars parked along the fence line. Staff was asked to look into the fence behind the convenience store on Upsala Road. The fence is falling down, and may have to be replaced. Also, look into whether or not the convenience store was required to build that fence to establish who the responsibility of maintenance falls to. CITIZEN PARTICIPATION. None. ADJOURNMENT.
