An Ordinance of the City of Sanford, Florida providing for the
rezoning of real property totaling 9.8 acres in size (Tax Parcel
Identification Numbers 32-19-31-300-009A-0000 and 32- 19- 31 -300-
0090 -0000) within the City Limits (map of the property attached) from
Agriculture ("A-1") to Single Family Residential (11SRA"); providing
for the taking of implementing administrative actions; providing for
the adoption of a map by reference; repealing all conflicting
ordinances; providing for severability; providing for non-codification
and providing for an effective date.
Whereas, Goldchem, LLC, through Naushik (Nash) Hooda, whose address is
535 Julie Lane, Winter Springs, Florida 32708; and Victory Deliverance Center, Inc.,
through Charles Gramlin, whose address is 1925 Second Drive, Sanford, Florida
32771, are the owners of certain real property, which land totals approximately 9.8
acres in size, which real property is located at 2601 and 2387 Celery Avenue, and is
assigned Tax Parcel Identification Numbers 32-19-31-300-009A-0000 and 32- 19 -31-
300- 0090 -0000 by the Property Appraiser of Seminole County; and
Whereas, Alec String of Bryce Foster Corp., whose address is 215 Rollingwood
Trail, Altamonte Springs, Florida 32714, applied, on behalf of the owners, to the City of
Sanford, pursuant to the controlling provisions of State law and the Code of Ordinances
of the City of Sanford, to have the subject property rezoned to the Single Family
Residential ("SR-1"); zoning classification/district from the existing Agriculture ("A-1")
zoning classification/district; and
Whereas, the City's Planning and Development Services Department has
conducted a thorough review and analysis of the demands upon public facilities and
general planning and land development issues should the subject rezoning application
be approved and has otherwise reviewed and evaluated the application to determine

whether it comports with sound and generally accepted land use planning practices and
principles as well as whether the application is consistent with the goals, objectives and
policies set forth in the City's Comprehensive Plan; and
Whereas, the Citizen's Awareness Participation Plan (CAPP) requirements of
the City relative to the proposed rezoning have been met - by the applicant to the
satisfaction of the City and the CAPP procedures of the City have been adhered to and
honored with the applicant and owner; provided, however, that the CAPP report was
promulgated by Ms. Kim Hall Fischer, President, of Cycorp Engineering, Inc., whose
address is 1614 White Dove Drive, Winter Springs, Florida 32708, with regard to the
subject property; and
Whereas, on May 7, 2015 the Planning and Zoning Commission of the City of
Sanford recommended that the City Commission approve the subject rezoning as set
forth in this Ordinance; and
Whereas, professional City planning staff, the City's Planning and Zoning
Commission and the City Commission have determined that the proposed rezoning of
the subject property as set forth in this Ordinance is consistent with the Comprehensive
Plan of the City of Sanford, the Land Development Regulations of the City of Sanford,
and the controlling provisions of State law; and
Whereas, the City Commission of the City of Sanford, Florida has taken, as
implemented by City staff, all actions relating to the rezoning action set forth herein in
accordance with the requirements and procedures mandated by State law.
Now, therefore, be in enacted by the People of the City of Sanford, Florida:

Section 1. Legislative Findings and Intent.
(a). The City Commission of the City of Sanford hereby adopts and
incorporates into this Ordinance the City staff report and City Commission agenda
memorandum relating to the application relating to the proposed rezoning of the subject
property as well as the recitals (whereas clauses) to this Ordinance.
(b). The subject property, which is 9.8 acres in size, is located at 2601 and
2387 Celery Avenue, and is assigned Tax Parcel Identification Numbers 32-19-31-300-
009A-0000 and 32-19-31-300-0090-0000 by the Property Appraiser of Seminole
County.
(c). The property owner intends to develop the subject property for use as a
single family residential subdivision and has stated that it will adhere to all City land
development regulations.
(d). The City of Sanford has complied with all requirements and procedures of
Florida law in processing and advertising this Ordinance.
Section 2. Rezoning of Real Property/implementing Actions.
(a). Upon enactment of this Ordinance the following described property, as
depicted in the map attached to this Ordinance, and totaling 9.8 acres in size, shall be
rezoned from the Agriculture ("A-1") zoning classification/district to the Single Family
Residential ("SR-1") zoning classification/district:

(b). The City Manager, or designee, is hereby authorized to execute any and
all documents necessary to formalize approval of the rezoning action taken herein and
to revise and amend the Official Zoning Map or Maps of the City of Sanford as may be
appropriate to accomplish the action taken in this Ordinance.
(c). Conditions of development relating to the subject property may be
incorporated into the subsequent pertinent development orders and development
permits and such development orders and development permits may be subject to
public hearing requirements in accordance with the provisions of controlling law.
Section 3. Incorporation of Map. The map attached to this Ordinance is
hereby ratified and affirmed and incorporated into this Ordinance as a substantive part
of this Ordinance.
Section 4. Conflicts. All ordinances or part of ordinances in conflict with this
Ordinance are hereby repealed
Section 5. Severability. If any section, sentence, phrase, word, or portion of
this Ordinance is determined to be invalid, unlawful or unconstitutional, said
determination shall not be held to invalidate or impair the validity, force or effect of any
other section, sentence, phrase, word, or portion of this Ordinance not otherwise

determined to be invalid, unlawful, or unconstitutional.
Section 6. Non- codification. This Ordinance shall be not be codified in the
City Code of the City of Sanford or the Land Development Code of the City of Sanford,
provided, however, that the actions taken herein shall be depicted on the zoning maps
of the City of Sanford by the City Manager, or designee.
Section 7. Effective Date This Ordinance shall take effect immediately upon
enactment.

SYNOPSIS:
Ordinance No. 4343, to rezone 9.8 acres located at 2601 Celery Avenue from A -1, Agriculture to
SR -1, Single Family Residential is being submitted for second reading and adoption.
The property owners are Goldchem, LLC and Victory Deliverance Center, Inc. The applicant is
Alec String of the Bryce Foster Corp. Cycorp Engineering, Inc. accomplished the Citizens
Awareness Participation Plan meeting.
The Affidavits of Ownership and Designation of Agent forms are attached and other information
is available in order to ensure that all potential conflicts of interests are capable of being
discerned.
FISCALISTAFFFING STATEMENT:
Based on the 2014 property tax roll of Seminole County, the vacant property located at 2601
Celery Avenue has an assessed value of $106,040. The total tax bill for the parcel in 2014 was
$14.32. The vacant property located at 2387 Celery Avenue has an assessed value of $109,780.
The total tax bill for the property in 2014 was $0 as it currently carries a Church/Religious
institution exemption.
If the site is rezoned and subsequently developed, the property would be assessed the City's
millage rate for the new use and generate additional ad valorem and utility revenues for the City.
BACKGROUND:
The 9.8 acre site is located on the south side of Celery Avenue, east of Brisson Avenue adjacent
to the Tusca Place North subdivision. The City Commission adopted Ordinance No. 4322
annexing 4.82 acres at 2601 Celery Avenue on August 25, 2014. On January 12, 2015 the City
Commission adopted Ordinance No. 4328 annexing an additional 4.99 acres at 2387 Celery
Avenue. The two parcels are now being submitted together for rezone and have been assigned a
project address of 2601 Celery Avenue.
The property owners have submitted a request to rezone the property from A -1, Agriculture to
SR -1, Single Family Residential for the purpose of developing a residential subdivision proposed
to be known as Celery Cove. In conjunction with the rezone, a request to amend the future land
use map designation from SE, Suburban Estates to LDR -SF, Low Density Residential - Single
Family has also been submitted for consistency with the Comprehensive Plan.
Based on the City's Joint Planning Agreement with Seminole County the proposed density for
the residential development cannot exceed four units per acre. The minimum building setbacks
and design standards shall be consistent with the requirements of the SR -1 zoning district as

The applicant held a Citizens Awareness Participation Plan (CAPP) meeting on July 30, 2014,
for the north parcel. On October 6, 2014, a letter was sent notifying additional property owners
within 500 feet of the south parcel. The applicant has provided a CAPP summary.
This project, if approved, would facilitate diverse housing options which is an initiative
associated with the strategic priority listed as "Update Regulatory Framework" in the Imagine
Sanford strategic plan adopted by the City Commission.
On May 7, 2015, the Planning and Zoning Commission (P &ZC) conducted a public hearing and
unanimously recommended that the City Commission approve the request to rezone 9.8 acres at
2601 and 2387 Celery Avenue from A -1, Agriculture to SR -1, Single Family Residential.
On June 8, 2015, the City Commission continued the first reading of Ordinance No. 4343 to the
meeting of June 22, 2015.
On June 22, 2015, Ordinance No. 4343 was passed on first reading by the City Commission.
The City Clerk published notice of the public hearing in the Sanford Herald on June 7, 2015.
LEGAL REVIEW:
The Assistant City Attorney reviewed this item and assisted in drafting the proposed ordinance.
RECOMMENDATION:
It is Staff's recommendation that the City Commission adopt Ordinance No. 4343, to rezone 9.8
acres with a project address of 2601 Celery Avenue from A -1, Agriculture to SR -1, Single
Family Residential, subject to the adoption of the Comprehensive Plan Future Land Use Map
amendment from SE, Suburban Estates to LDR -SF, Low Density Residential - Single Family.
SUGGESTED MOTION:
"I move to adopt Ordinance No. 4343, to rezone 9.8 acres with a project address of 2601 Celery
Avenue from A -1, Agriculture to SR -1, Single Family Residential, subject to the adoption of the

CONCURRENCY
Concurrency is a finding that public facilities and services necessary to support a proposed development are
available, or will be made available, concurrent with the impacts of the development. The concurrency facilities
evaluated by the City of Sanford include the following:

Drainage: The project shall comply to and be engineered to the adopted 25 Year, 24 Hour LOS /Storm
Event. Note, the Land Development Regulations allows the Administrative Official to increase
the design frequency standard if deemed necessary.
Roadways: The traffic capacity demands for this project are estimated at 390 average daily trips with 40 trips
during the PM peak. This project does not require a traffic study.
Water: Water services will be provided by the City of Sanford.
Sewer: Sewer services will be provided by the City of Sanford.
School: A School Impact Analysis (SIA) letter was issued on February 26, 2015 by Seminole County
Public Schools. A copy of the findings by SCPS is attached to this report which has the potential

property owners within a 500 feet radius of the proposed Celery Cove Subdivision. The
meeting was scheduled for July 30th at 5:30 pm at St. James House of Prayer located at 2775
Celery Avenue.
Prior to the meeting I have received no phone calls or concerns regarding the proposed
development.
During the meeting on Wednesday, July 30, 2014 we had one couple in attendance:

The Rodda's property is along the eastern portion of Tusca Place. The Rodda's didn't have a
concern regarding the annexation and subsequent development but were merely inquiring as

Bryce Foster Corporation would like to inform you of a proposed rezoning of approximately 5
acres of land known as Celery Cove (rear 5 acres). Bryce Foster will be submitting
application to the City of Sanford to rezone the 5 acre-property from Agricultural land (A-1) to
Single Family Residential (SR-1). The parcel is currently vacant and the proposed
development would contain about 15 single family homesites.
A few months ago, Celery Cove submitted application for the annexation of the front 5 acres
and held a public meeting for the same front 5 acres for the rezone which included about 20
single family homesites. The plan submitted in the letter includes both the front 5 acres and
the rear 5 acres of Celery Cove.
Bryce Foster would like to address any comments and concerns you may have regarding this
proposal. I have included the proposed site plan in conjunction with the front 5 acres. Please

if approved, the new FULM designation and /or zoning will have the effect of increasing
residential density, and as a result generate additional school age children.

Sanford. The applicant is requesting a change to the Future Land Use Map and zoning
designation to allow a maximum of 39 single - family attached dwelling units to be developed
within the requested zoning and future land use designation.

Comments:
The students generated at the three CSA levels would at this point be able to be
accommodated without exceeding the adopted levels of service (LOS) for each CSA by school
type, or there is adjacent capacity to meet LOS as allowed by interlocal agreement. Any
planned expansions /additions in the current five -year capital plan would provide additional
student capacity to relieve the affected schools.
Review and evaluations performed on proposed future land use changes and rezones,
unplatted parcels, or projects that have not recived final approval do not guarantee that the
developments subject to this declaration are exempt from, or determined to meet the school
concurrency requirement, which is effective as of January 1, 2008. Changes in enrollment,
any newly platted developments, and any subsequent final development approvals may affect
the provision of concurrent school facilities at the point of final subdivision approval, including
the potential of not meeting statutory concurrency requirements based on future conditions.

Terms and Definitions:
Capacity: The amount of satisfactory permanent student stations as calculated on the date of
the second DOE count in October of the current school year. The number of students that can
be satisfactorily accommodated in a room at any given time and which, is typically a lesser
percentage of the total number of student stations. NOTE: Capacity is ONLY a measure of
space, not of enrollment.
Concurrency Service Area (CSA): A geographic unit promulgated by the School Board and
adopted by local governments within which the level of service is measured when an
application for residential development is reviewed for school concurrency purposes.
Enrollment: For the purposes of concurrency review, the enrollment level is established each
year as per Public School Interlocal Agreement Section 12.4 A, which sets the level on the
date of the second FTE survey for DOE, generally taken the in mid - October.
Programmed 3 Year Additions: New permanent school capacity within the CSA, which will
be in place or under actual construction within the first three years of the current SCPS Capital
Improvement Plan.
Remaining Capacity: The capacity available for future development after the addition of any
programmed capacity and less the reserved capacity.
Reserved Capacity: The total number of student stations reserved in the respective CSA's
that are assigned to projects via a SCALD certificate.
School Size: For planning purposes, each public school district must determine the maximum
size of future elementary, middle and high schools. Existing school size is determined solely
through FISH data. Seminole County Public Schools has established the sizes of future
schools (with the exception of special centers and magnet schools) as follows:
i) Elementary: 780 student stations
ii) Middle: 1500 student stations
iii) High: 2,800 student stations
Students Generated by Project: is determined by applying the current SCPS student
generation rate (calculated by using US Census data analysis) to the number and type of units
proposed. The number of units is determined using information provided by the County and /or
from the applicant's request. If no actual unit count is provided the unit count is then estimated
based on the maximum allowable density under the existing /proposed future land use
designation. Student assignment may not be to the school in closest proximity to the proposed
residential development.
Utilization: A State Board Rule prescribed percentage of student stations that a room (and
proportionately, a school and school district) can satisfactorily accommodate at any given time.

An Ordinance of the City of Sanford, Florida providing for the
rezoning of real property totaling 9.8 acres in size (Tax Parcel
Identification Numbers 32-19-31-300-009A-0000 and 32- 19- 31 -300-
0090 -0000) within the City Limits (map of the property attached) from
Agriculture ("A-1") to Single Family Residential ("SR-1"); providing
for the taking of implementing administrative actions; providing for
the adoption of a map by reference; repealing all conflicting
ordinances; providing for severability; providing for non-codification
and providing for an effective date.
Whereas, Goldchem, LLC, through Naushik (Nash) Hooda, whose address is
535 Julie Lane, Winter Springs, Florida 32708; and Victory Deliverance Center, Inc.,
through Charles Gramlin, whose address is 1925 Second Drive, Sanford, Florida
32771, are the owners of certain real property, which land totals approximately 9.8
acres in size, which real property is located at 2601 and 2387 Celery Avenue, and is
assigned Tax Parcel Identification Numbers 32-19-31-300-009A-0000 and 32- 19 -31-
300- 0090 -0000 by the Property Appraiser of Seminole County; and
Whereas, Alec String of Bryce Foster Corp., whose address is 215 Rollingwood
Trail, Altamonte Springs, Florida 32714, applied, on behalf of the owners, to the City of
Sanford, pursuant to the controlling provisions of State law and the Code of Ordinances
of the City of Sanford, to have the subject property rezoned to the Single Family
Residential ("SR-1"); zoning classification/district from the existing Agriculture ("A-V)
zoning classification/district; and
Whereas, the City's Planning and Development Services Department has
conducted a thorough review and analysis of the demands upon public facilities and
general planning and land development issues should the subject rezoning application
be approved and has otherwise reviewed and evaluated the application to determine

whether it comports with sound and generally accepted land use planning practices and
principles as well as whether the application is consistent with the goals, objectives and
policies set forth in the City's Comprehensive Plan; and
Whereas, the Citizen's Awareness Participation Plan (CAPP) requirements of
the City relative to the proposed rezoning have been met - by the applicant to the
satisfaction of the City and the CAPP procedures of the City have been adhered to and
honored with the applicant and owner; provided, however, that the CAPP report was
promulgated by Ms. Kim Hall Fischer, President, of Cycorp Engineering, Inc., whose
address is 1614 White Dove Drive, Winter Springs, Florida 32708, with regard to the
subject property; and
Whereas, on May 7, 2015 the Planning and Zoning Commission of the City of
Sanford recommended that the City Commission approve the subject rezoning as set
forth in this Ordinance; and
Whereas, professional City planning staff, the City's Planning and Zoning
Commission and the City Commission have determined that the proposed rezoning of
the subject property as set forth in this Ordinance is consistent with the Comprehensive
Plan of the City of Sanford, the Land Development Regulations of the City of Sanford,
and the controlling provisions of State law; and
Whereas, the City Commission of the City of Sanford, Florida has taken, as
implemented by City staff, all actions relating to the rezoning action set forth herein in
accordance with the requirements and procedures mandated by State law.
Now, therefore, be in enacted by the People of the City of Sanford, Florida:

Section 1. Legislative Findings and Intent.
(a). The City Commission of the City of Sanford hereby adopts and
incorporates into this Ordinance the City staff report and City Commission agenda
memorandum relating to the application relating to the proposed rezoning of the subject
property as well as the recitals (whereas clauses) to this Ordinance.
(b). The subject property, which is 9.8 acres in size, is located at 2601 and
2387 Celery Avenue, and is assigned Tax Parcel Identification Numbers 32-19-31-300-
009A-0000 and 32-19-31-300-0090-0000 by the Property Appraiser of Seminole
County.
(c). The property owner intends to develop the subject property for use as a
single family residential subdivision and has stated that it will adhere to all City land
development regulations.
(d). The City of Sanford has complied with all requirements and procedures of
Florida law in processing and advertising this Ordinance.
Section 2. Rezoning of Real Property/Implementing Actions.
(a). Upon enactment of this Ordinance the following described property, as
depicted in the map attached to this Ordinance, and totaling 9.8 acres in size, shall be
rezoned from the Agriculture ("A-1") zoning classification /district to the Single Family
Residential ("SR-1") zoning classification /district:

NAMELY: THE NORTH 725.11 FEET OF THE EAST % OF THE
NORTHWEST % OF THE NORTHEAST % (LESS THE NORTH 25 FEET
AND THE WEST 30 FEET),

(b). The City Manager, or designee, is hereby authorized to execute any and
all documents necessary to formalize approval of the rezoning action taken herein and
to revise and amend the Official Zoning Map or Maps of the City of Sanford as may be
appropriate to accomplish the action taken in this Ordinance.
(c). Conditions of development relating to the subject property may be
incorporated into the subsequent pertinent development orders and development
permits and such development orders and development permits may be subject to
public hearing requirements in accordance with the provisions of controlling law.
Section 3. Incorporation of Map. The map attached to this Ordinance is
hereby ratified and affirmed and incorporated into this Ordinance as a substantive part
of this Ordinance.
Section 4. Conflicts. All ordinances or part of ordinances in conflict with this
Ordinance are hereby repealed
Section 5. Severability. If any section, sentence, phrase, word, or portion of
this Ordinance is determined to be invalid, unlawful or unconstitutional, said
determination shall not be held to invalidate or impair the validity, force or effect of any
other section, sentence, phrase, word, or portion of this Ordinance not otherwise

determined to be invalid, unlawful, or unconstitutional.
Section 6. Non - codification. This Ordinance shall be not be codified in the
City Code of the City of Sanford or the Land Development Code of the City of Sanford;
provided, however, that the actions taken herein shall be depicted on the zoning maps
of the City of Sanford by the City Manager, or designee.
Section 7. Effective Date This Ordinance shall take effect immediately upon
enactment.
