Mr. Skat called the Worksession to order at 6 :00 P.M.
Presentation by H. W. `Bill" Suber, CFA, ASA, Seminole County Property Appraiser on the effects
of land use actions on property values.
Mr. Suber was present and introduced Terry Manfre, Alice Feinberg, and David Johnson o f the
Seminole County Property Appraiser's Office.
Mr. Suber spoke on annexations. Annexations are bind of like zonings to the Appraiser's office.
The annexation, in and of itself, only w ill affect the tax base, not the value itself', Dace a property i
annexed into the City, the Appraiser's office applies a Sanford niffigerather than a fire or road tax
along with the County and the School.
The on g is kind of like the annexation, it of itself won't necess affect the value. If it affects
anything initially, it would only be because the market reacted to it imm ediately.
Permits, in and of themselves, don't necessary affect the value. The product or the iunpro ement
that is being p ut on the property will affect the value, but the permit itself won't necessarily.
The annexation, the zoning, and the permit for any fee appraisal, are market driven. Amendment
1 , or Save O ur H orne, is the value limitation constitutional amendment that passed in 1992,

implemented in 1994, which says that as long as a person homesteads a property, the value from
one year to the next can only increase by a maximum of the lesser of % or CPI. Those people
living in homesteaded property, if the market indicates that their market value has gone up a
thousand times, the value will be changed to coincide with what the market says, but the assessed
value or the part that is limited by the constitutional amendment will only rise by the CPI or %.
Mr. Gibson stated that City Staff would continue to coordinate with the Property Appraiser's
Office to provide some historical assessments of some select areas that were noted. Staff will also
try to do proactive measures with regard to land use changes that the community or neighboring
properties might suggest that their property values may impact.

Bill Kercher of GI tting Jackson I ercher Anglin Lope2 Lope and Rinehart was present to make an
announcement on the Riverwalk. He stated that they are heading up the team that is working on the
Riverwalk. The sons and survey work are nearing completion. They will begin the Downtown Urban
Design Plan the week of August 2 h . They will move their design studio into the old Library. He
invited the Commissioners to come visit sometime during the days of the 21", 22 d , or the 23" The
Band -out includes a survey form to solicit information. They are trying to gather as many ideas,
different thoughts, as many alternative prospects as they can. Once the Urban Design Flan is done,
they will start the engineering design of the bulkhead and the seawall, as well as the promenade of the
Riverwalk itself. Phase 1 is from llellonville Avenue to French Avenue and Phase 2 will he from
French Avenue to I -4.
The first item on the Agenda was to hold a Public Hearing to consider a request to Rezone a portion
of the CSR Rinker property located at 2210 W. 2 1h Street from I -1, Ret.cted Industrial, to III -2,
Medium Industrial.

Don Beers, Engineering Manager for Rinker Materials, 1501 Belvedere Road, Test Palm Beach, was
Present.
Mr. Gibson stand that this tract of land was an out parcel that may have been separately acquired by
CSR. They are trying to get the zoning consistent with the remainder of the CSR property that is
currently being used for their facility. They anticipate some expansion of their activities with regard
to similar activities that they are doing on the existing property.

Mr. Beers stated that the intended use of the property is for a storage area which is not allowed mn the
current zoning. They are going through some environmental improvements and a portion of the area
of the request will be used for water retention.
Mr. Yo se moved to approve per Staff s recommendations. Seconded by Mr. Lowell All in fagot.
Motion carried.
Next on the Agenda was the consideration of the changes to San ford's Land Development Regulations.
Ms. Gerli stated that she wanted to get the Con mssion's input and answer any questions that it may
have. She stated that she would like to withdraw Article 5 because the engineers have some other ideas
they would life to add to this section to rnake it better.
Regarding architec review, Mr. Lowell requested that in the agenda packet, architectural elevations,
the location of wall signs, and an artist rendering, be included in Section 4.3. Ms. Gerh stated that
conceptual elevations would be o.k to include the architectural style, the height and the height in
relationship to some landscaping. Mr. Gibson stated that Staff can and does require the architectural
elevations. The problem is that if someone makes a proposal and the Commission proposes to deny
the project /site plan based on the fact that their facade doesn't loop good or feels it isn't compatible,
the City sloes not have those standard in place.
Mr. Lowell also requested that the Conindssion seriously look at Section 5.8 as to homer daces are
addressed, not only from a safety, fire, or rescue standpoint, but for the elderly also. Mr. Gibson stated
that currently it is in the wilding Codes.
Mr. VonHerbulis stated that be is definitely against barb wire, concertina, razor wire, etc. from being
visible from any residential area or zone being prohibited. Typically a residence isn't going to add barb
wire around its property. Commercial and industrial will put a fence up for security. He is favor of
the concertina and razor wire being prohibited but the barb wire provides protection. Mr. Gibson
stated that in Schedule J it states that the restriction would apply to residential areas, Zoning Distficts
SR -1, MRs, PDs, and RIII.
Mr. Kutz suggested that the Yielding and Provost Guidelines be attached to the new Downtown
Waterfront District because the land use and the zoning have been changed. He also suggested that
the definition of hardships on page 111-5 needs to be utilized in different sections of the code, i.e. page
III -1 2 III- 1, III -1 , excluding involving loss of profit.
Mr. Robert suggested that in the case of non - conforming single family residence structure or use, page

Mr. Skat stated that he would like to see something in the Code regarding a recommendation from
Historic preservation Board when there are projects that have to come before the Pknning and Zoning

Co mmission. He would also l� e to see language in the Code under Remedies and Penalties that saps
the Administrative Official s hould be able to pull a C.O. o shut someone down with their business
license if they are not in cmpiance instead of being authorized to disconnect utilities serving the
remm i.s in violation.
Mr. Skat stated that o 111-10 where it talks about determinations in the cases o f single family dwelling
by the B oar d of Adjustment, he wo uld like to see residential districts stated in that. He thinks Planning
and Zoning should continue to determine cases o single family d in commercial districts. On
Page 111-12, public facilities and services, he would like to see schools included.
Mr. Ross moved to table the changes to the Land Development Regulations until a re -write of the
changes are done. Seconded by Mr. Lowell. All in favor. Motion carried.
Mr. Skat stated that the pa rking at the jyard o Vt Street, o the street. Mr. Gibson stand that it
has been noted and Staff will be coordinating with the Police Department and DOT to insure that
Maple and 4 is clear.
