THIS UTILITY EASEMENT is made this day of June, 2015, by and
between Christopher Browne and Michelle L. Browne, whose address is 2311
Grandview Avenue, Sanford, Florida 32771, (hereinafter referred to as the
"GRANTORS"), to the CITY OF SANFORD, FLORIDA, a Florida municipality,
whose mailing address is 300 North Park Avenue, Sanford, Florida 32774'
(hereinafter referred to as the "City" or the "GRANTEE").
WITNESSETH:
FOR AND IN CONSIDERATION of the sum of TEN DOLLARS ($10.00),
together with other good and valuable consideration, in hand paid to the
GRANTORS by the GRANTEE, the receipt and sufficiency whereof is hereby
acknowledged, the GRANTOR does hereby give, grant, bargain, and sell unto
the GRANTEE, its successors and assigns, a Utility Easement to continue the
use of or to construct, install and maintain utility facilities, of every type and
nature, and all rights appurtenant thereto, to include, but not be limited to, the
perpetual right to enter upon said Easement Parcel at any time that it may seem
fit, to construct, lay, reconstruct, operate, maintain, modify, and repair utility lines
and facilities of every type and nature, as well as appurtenances thereto, for the
purpose of operating and supplying utility services over, through and under that
certain parcel or tract of real estate situated in the County of Seminole, State of
Florida, more particularly described as follows:

(Together consisting of the "Easement Parcel")
THE GRANTEE and its assigns shall have the right to excavate, patrol,
alter, improve, permit, repair, construct, maintain, or remove utility lines,
structures and facilities including, without limitation, the rights and privileges
reasonably necessary or convenient for the purpose of providing utility services;
and the further right to trim, cut, remove trees, bushes, undergrowth, pavement,
curbs, and other obstructions interfering with the location, construction and
maintenance of utility lines and facilities located within the aforedescribed
Easement Parcel. The GRANTORS agree not to build, construct, or create or
permit others to build, construct, or create any buildings or other structures in
said Easement Parcel or any pond or similar structure or facility, of whatsoever
type or nature, that may interfere, in any way, with the location, excavation,
operation, or maintenance of the utility system installed thereon or therein; and
THE GRANTORS do hereby covenant with the GRANTEE that they are
lawfully seized and possessed of the real estate herein described, that they have
good and lawful right to convey the said Easement Parcel; and that it is free of all
encumbrances,
