The Chairman called the meeting to order at 7:40 P.M.
Item I on the Agenda was to hold a Pub -lic Hearing to consider a
re est for a Planned Development Rezone for property located at
37� SR 4 6 from A-- Seminole County Zoning, to that of PD, Planned

VonHerbulis abstained due t professional assoc iation with this

witg the new guidelines of the. 46 corridor.
Mr.._ Garrett moved for approval based on Staff s recommendations .

The next item was to hold a Public Hearing to consider a request to
Re property located at 2 S. !4yrtle Avenue from RMOI,
Multiple Family Dwelling Residential -- office - Institutional, to that
of GC -2, General Commercial. Tax Parcel No: 36- 19-30- 539 -0000-
0470; Owner /Representative: William T. & Delores. S. Forbes.
Delores Forbes and J. Forbes, 244 - 0 S. Myrtle Avenue ■ were
present. Ms. Forbes stated that this is a quiet neighborhood and
that they have no -intent.ions of upsetting their neighbors. Mr.
Forbes stated that this property has been for:sale longer than
a �ragar and a half No one has even come to see it They would
like t0 have a little- extra - slack , in the zoning-. The are in
agreement with Staff' recommendations.

Mr. Van Oaale stated that the RC=-1 zoning is a less intense
commercial use. Mr. Gibson stated that business and
uses are allowed in the RMCI zoning. Retail sales and services
are permitted , in the RC -I up to 3500 square feet in floor area and
a restaurant is allowed - as a use b other co ercia uses are
permitted. A - dri ve -in restaurant is not permitted in RC - 1, which
is permitted in GC -2. Mr. Gibson ex aired that the
parking are based on the use and t - is specific - use requires
one parking space per 200 square feet of building floor area, and
this would require 8 parking spaces ' with the appropriate traffic
circulation.
Ira Rowell, 2436 S. Oak Avenue, stated that he was representing
approximately 13 pea le that -are in the audience that live in the
immediate vicinity tKat are against the rezoning. He stated that
specifically, the area - does not have adequate asking to meet the
requirements . The lot is entirely too small to- support this
change. They- are against "spot" rezon -ing in the area.
Raymond Heauschense, 2438 Myrtle Avenue, s poke in opposition. He
stated that he lives in the back of the Forbes, his land joins
their land. The commercial zone is ghat is worm ing him. The
neighbors do not want a commercial business to go . in ere. He does
not want a noisy business at the rear of-his property.
Catherine Givens r X435 Ir+IYrtle Avenue, spoke in opposition. She
stated that she is also in opposition to the RC -1 zoning. The

The next item on the Agenda was to hold a Public Hearing to
consider a request to Rezone property located at 1025 W. 25 Street
from PD, Planned Development, to that of RC -1, Restricted
Commercial. Tax Parcel N`o : 01- 20 -30- 504 - 1000 - - 0220; Owners Peggy
M'. William D. Johnson; Representative: Jim Weinberg.
Jinn. Weinberg,. 201 Orange Ridge. Circle, Longwood., representative for
Peclgy and David Johnson, was present. He stated that the Jvhnsons
have a buyer for this property. The buyer would like to use the
property as a commuter store. The primary reason will be for
service but there is a need for retail sale of titers from the
store Tate proximate size of the land is 15,Q square feet.
The current building, an existing houses has 1700 square feet of

City's LDR. There are S parking spaces currently on a paved
par ing area with a curb -cut to-46A.
Mr. VonHerbulis moved to approve p S'taff's reconmendations with
restrictions as spelled out in the recommendations. Seconded by
Mr. Robert. All in favor. Motion carried.
Next on the Ag -end.a was to Fold a Public Hearing to consider a
request for a Conditional Use for property located at 416 Say
Avenue for the purpose of expansion of a non - conforming structure.

to add a bedroom and loath on the rear of the home. The house was
built in 1972 he b9ught it in 1975.

favor. Motion carried.
The next_ item, was. to hold- a Publi -c. Rearing :to consider a request
for a Conditional Use for property located. at 2491 French Avenue

Edward O Neill, representative of Southern Express Lubes, 1113 N
Semoran Blvd., Orlando stated that they have purchased the
northeast corner of 25L Street and French Avenue. They are
E ropposing to tear down the old Texaco Gas Station and the adaacent
uilding, The Big Dip. This will be light automobile service oil.

repairs.. no trartsmission work or things like this.
Mr. O*Neill stated that the tanks were removed at the gas station
but that the soil is contaminated. They will have to do some
remedial work. Texaco has legal responsibility with the State to
clean it up but the State cl up funds are non-existent. A hedge
wi - 11 , surround the entire. parcel'. He stated that there are three or
four curb cuts between the gars - s and - Tire - Big- Dig . With this
pro' e the -re will be-only one. They are-anticipating a curb -cut
on 16.

The next item considered was the Site Plan for a proposed. Mobil
Lube and Tune -TTp Clinic located at 2493 French avenue (northeast

Ed O' Neill also represented this request. He stated that iven the
intersection, a lot of thought has gone into this site plan.

The next item on the. Agenda was to hold- a Public Hearing to

that the Historic ,Preservation Board has given its approval. The
garage will' be shifted 5 "' to the west. Mr., VonHerbulis asked if
any consideration had' been given. to moving.the.structure to the
rrorthr to acoodate the v- ehiales riot - being .. in pavement of the
road before the doorway is cleared. Mr. Gibson stated that Staff
had reviewed this and fe-els, . - that. the only adjustment that was
needed . -was the setback- f zo m - - th.e - alley to. a=ommcdat a vehicular
traffic through the a.11e This is a low intense use on a
secondary str eet, -3t was felt that it would be acceptable to have
the building remain in its current location along 14rn Street.
Toby Troutman, 900 S. Palmetto, wasn't sure if she - was in favor of
or against the request. she was worried about someone renting the
in�law apartment. She asked''if there were any stipulations that it
has to be lived in by a member of' family and not be rented out.

dwelling gill look like the main house. Mr Van -Gaale stated that
the applicants have reconfi ed the L original design to tie into
the main house with the wood siding, Windows and a ta..n. roof . Ms.
Wells stated - that this dwelling does not aspen up onto the sidewalk,
but rather from the other end. She asked if this could be done
because.. children do'. us.e - the.. sidewalk.. It is . &.'safety issue being
so close to the sidewalk. Mr. Gibson stated that the building

setback for this property s 15' -from 10 Street. They will be
required to pursue a dimensional variance from the Board of
Ad ustm - ent - in order to establish the structure on - the property line
if less than 15
Howard' Thomas, 91& S. - Magnolia Avenue, state that he needs more
information because-he-didn't know what the change is about. He
requested dimensions. Mr. Van Gaale stated that , the dimensions are
roughly 30x 3G . Mr Uhran stated that the outside dimensions are
26. 3 and - 3/4xZ6' and - 3/4 " -. Thee overall dimensions of the original
structure- is-- a . litt-le over 2arx24 . He rioted that the owners are
very hist<o.r al_ and 'tha-t -the struc.tur-e...will :be torn down and the
material salvaged and reused for the new structure. It is very
imp ortant to the owners to place it where it sho be on the
property.
Lynn Stevens, 918 Magnolia Avenue, . spoke in opposition. She stated
that there are a couple of rental properties close to her and that
they have been subjected to people fixing . old care in the alley
until late at night. Residents that take their dogs out and let
them ran all over her property. People . drive and - park.. right in the
all She stated- that sire is hasic conc erred. of the p otential
mis -us-e .cif this- apartment in- the future -. She stated, that they have
enough p rob Zems. in- the- area. and that - their- do not need any more
r,ental properties.

He stated that he does not want to see another rental unit.

The g entleman at 331 Magnolia Avenue stated that he has been
patrolling the neighborhood-watch for the last few Y ears.

recommendations. All signage will be attached to the building.
Mm VonHerbulis asked what landscaping will have to be provided
across the front of the property so that -it will block the view of
the building. Mr. Gibson stated that the -City is requiring the
applicant to meet the newly adopted gateway corridor standards
which include larger plantin s with regard to tree-s. and shrubs.

Next was the consideration of the Final Plat for Monterey oaks,
Phase r, a proposed 55 lot single family residential subdivision
located at 4 Upsala Road. Tax Parcel - Number. 3
0450; Property Owner: Upsala Oaks-of Sanford, Inc.; Representative:
Gary R. Roche -- Lochrane Engineering.
Tom Yokal, Zochrane Lngineering, was present - . This is phase one.
Mr. Gibson stated that Staff was concerned with the alignment - of a
future driveway to go right into Dogwood Avenue. This has been
addressed on the construction plans. A physical barrier will be
ere across this area. It will - be either a masonry wall or a
fence-of some mature. There is no- intention for to be a road
connection.
Mr. VonHerbulis stated that he would like to sere the cul -de -sac
pushed back and make Lots 88 and Tract H lift station to take up
the end of the cul -de -sac.
Ms. Ue=ison que stioned the 10" Environmental Control Easement.
From note three on the surveyor "s notes, it was determined that it
is a swale maintained by the property owner.
Mr. VonHerbulis moved to approve - the Final Plat for Monterey Oaks
with the addition that a 5 wall easement, dedicated to the
homeowner# s association along the entire eastern boundary line of
the subdivision, including the stormwater retention areas and lift
station areas, and construct a wall that is matching the
subdivision to the north, and that there be recorded with this
final lot that no right -of' -wag o:r - ingress /egress easement at the
end of S anis - h . Bay Drive to the east through to Upsala Road.

Next was the consideration of the Yinal Plat fir Placid Woods,
Phase III, a 40 lot single family residential subdivision

Mr. Gibson stated that the one distinction for Phase III vs. Phases
I.. and II is. that it. i s.. a s ec c s ti - at_ion. on the plat that no
additional impervious area be allowed and the building d. The i
retention designed for this phase can y only handle the drains e
runoff fr the building pads, driveways. Specific coverage is
maxe�d out totally to the primary building and. its related
appurtenances.

The next item was the consideration of the Site Plan for the
Sanfor d/gemimal-pa..County ,Pool -complex. to- be located at 2701
Ridgewood Avenue. Representative: Karl Pecht, Pecht Evans
Engineering, Inc.
Carl - Pecht, 5 Cr1 9_ Jackson Street. Orlando, was present. This is
a point - effort with the City, County and the School Board. The
property was -deeded to the Cit -by the School Board. He stated
that the diving area will be 1 deep, it has water polo, and a
minimum depth 5 11 .

Staff regarding its recommendations.
