WX PLANNING AND ZONING COMMISSION MEETING OF MARCH 19, 1998 7:00 P.M. CITY COMMISSION CHAMBERS CITY HALL, SANFORD, FLORIDA MEMBERS PRESENT: James Valerino Ross Robert Lynn Stogner Otto Garrett Mike Skat Ben Dyal MEMBERS ABSENT: Helen Stairs - excused Mac McClanahan James Hattaway- excused OTHERS PRESENT: Russ Gibson, Land Development Coordinator Jay Marder, Director of Planning and Development The first item on the Agenda was to hold a Public Hearing to consider a request for a Dimensional Variance for property located at 185 E. Airport Boulevard in a GC -2, General Commercial Zoning District. TaxParcelNo: 01 -20 -30 -512- 0000 -038A. Owner Ato Z International, Inc., representative: Nema K Mousa. John McDonal 185 E. d, Airport Blvd., Sanford, stated that Mr. Mousa was in Miami and that he would be representing this request. He stated that cars and large trucks turn onto this property to turn around and knock the fence down. This is an import/export and auto repair business and they need to have the lot secured. Their primary business is buying cars at auction, refurbishing them, and doing vinyl tops. Ifthe fence was put back 25', trucks would not be able pull in. The reason for the lot line request is as much for traffic control than it is for security. Mr. McDonald stated that he had not read Staffs recommendations. It would be acceptable to have the type of gate, fence gate, to keep cars out. when the property was purchased, there was a roll gate on the side of the building, but this is something that they would need to talk over. By putting some type of gate across the entryway that could be opened and closed, it would solve the in and out problem but not the security problems. Allie Owen, 185 E. Airport Blvd., stated that the damaged cars will be kept in the back section. They ship the cars, the way they are, overseas for parts. The nicer cars will be out front. He is afraid that the cars out front will be damaged by people turning around in there. He stated that he would like to have some type of 2' vegetation over a 5' fence so that it would look good. There was no one else present to speak in favor of or in opposition to the request. Mr. Stogner moved to deny the request based on Staff s recommendations. Seconded by Mr. Garrett. Mr. Stogner requested that Staff offer the applicant something available to meet his needs, other than the chain link fence. All in favor. Motion carried. The next item on the Agenda was to consider a request for Site Plan approval for Lot 28, Sanford Central Park, located at 131 Commerce Way in an R1-1, Restricted Industrial Zoning District. Tax Parcel No: 35 -19 -30 -524- 0000 -0250. Owner: Lamphier Painting Services; representative: Dennis Aagaard. ES PLANNING AND ZONING COMMISSION MEETING OF MARCH 19, 1998 PAGE 2 Dennis Aagaard, 2+619B S. French Ave., Sanford, was present. The site will be an office/warehouse for Lamphier Painting Services. Mr. Dyal moved to approve per StafF s recommendations. Mr. Robert seconded. Mr. Dyal stated that the curb concerns him. All in favor. Motion carried. Mr. Stogner noted concern regarding the hugh holes along the seawall. Mr. Marder stated that the City is looking into the problem. He stated that this would be a very expensive undertaking. The City has advertised for request for proposals for an engineering study to determine the alternative means that we can look at to fix the seawall. Mr. Dyal reported a number of cars on Laurel, behind walgreens and the Rib Ranch, that look like they haven't moved in years. Mr. Dyal noted that the City tends to barge into things, with the citizens being all hot on the development of Ft. Mellon Park,, and that we need to make sure that we have the best people on the project. Mr. Skat requested Staffto drive up Magnolia from 9' to 13' Streets and look at all the cars and Rvs in people's yards. Mr. Robert moved for approval of the Minutes as circulated. Seconded by Mr. Stogner. All in favor. Motion carried. There being no further business, the meeding adjourned at 7:55 P.M Q&U-47 r Ja s Valerino, Vice Chairman From the Director of Planning and Development March 13, 1998 TO: City of Sanford Planning and Zoning Commission SUBJECT: Recommendations for Meeting of April 19, 1998 NEMA K. MOUSA - Request a dimensional variance to permit chain link fencing within the required 25 foot setback line for property Zoned GC -2, General Commercial located at 185 East Airport Boulevard. Site is Zoned GC -2, General Commercial and includes automobile repair and body work uses. Site fronts Airport Boulevard. 2. Site is adjacent to a shopping center and a gasoline service station. 3. The applicant requests a dimensional variance to place a chain link fence on the front property line. Chain link fences are prohibited within the required front yard building setback." (Schedule J, Landscape, Buffer and Tree Requirements, City of Sanford Land Development Regulations 4. The Planning and Zoning Commission has granted dimensional variances for chain link fences in industrial parks such as North Star. The Planning and Zoning Commission has not granted variances to chain link fence requirements for commercial development along major highways. Figures 1 through 5 depict the site and existing chain link fence in the nearby area. 6. Criteria for a dimensional variance requires that the applicant show how a literal interpretation of the provisions of the Ordinance would deprive the applicant of rights commonly enjoyed by other properties in this same Zoning District. Figures 6 through 8 depict automobile sales lots that utilize materials other than chain link fence to secure automobile sales and on site vehicular circulation areas (turn - around as noted by applicant's letter). Therefore, the applicant would not be deprived of rights commonly enjoyed by other car lots in the same zoning district. 7. Recommend denial of the request to place chain link fence in the front yard setback because alternative means to secure the property are available to the applicant and because the applicant has not met required criteria for a dimensional variance including but not limited to being deprived of rights enjoyed by other similar uses in the same zoning district.
