The first item on the Agenda was to hold a Public Hearing to consider a request for a Conditional Use with an associated Dimensional Variance for SprintCom for the construction of a 130' communications tower located at 4175 Orlando Drive (Aristocrat Volkswagen) for the property Zoned GC -2, General Commercial, AG, Agricultural, and SR -1A, Single Family Residential. Tax Parcel No: 14- 20 -30- 300 -0000; Property Owner: Larry Bishop - Aristocrat Volkswagen; Representative: Matthew Danielson - SprintCom. Jay Harker, 997 W. Kennedy Blvd., Orlando, stated that he was representing SprintCom. He concurs with the facts and recommendations contained in Staff's reports. SprintCom is latest of PCS carriers to get involved in this market. Therefore, SprintCom has designed its system around the newer telecommunication ordinances. The need for tower in this exact location is the direct result of SprintCom successfully securing colocations on all neighboring sites, approximately 10. SprintCom has complied with the code of encouraging colocation. SprintCom anticipates that this will be the only request that it will require in building a tower within the City. SprintCom has obtained 10 to 12 sites on other towers. Seminole County is not ready to offer colocation on its site across the street. Mr. Barker stated that the trees are a natural vegetative buffer at the rear of the Volkswagen property that would justify the variance. This is wetland property so the trees will never go. Mr. Barker stated that this tower will provide for one colocation. Mr. Stegner stated that he is concerned with setting a precedent of allowing this type of use next to residential zoning. Mr. Robert moved on approval per Staff's recommendations and based on existing site characteristics. Seconded by Mr. Shat. Mr. Stegner opposed. All others in favor. Motion carried. Next on the Agenda was to hold a Public Hearing to consider a request for a Dimensional variance of the rear yard setback from 20' required to 10' proposed for a variance of 10' for the construction of a building on Lot 28 in Sanford Central Park for property Zoned RI -1. Restricted Industrial. Tax Parcel No: 35- MINUTES MEETING OF JANUARY B , 1998 PAGE 2 19- 30- 524 - 0000 -0280. Property Owner: Lamphier Painting services; applicant /representative: Aagaard- Harbin Construction. Allan Penney, 2619 S S. French Ave., stated that they need the variance due to constraints of size of property and traffic. Mr. Skat moved on approval per Staff's recommendations. Seconded by Mr. Stogner. All in favor. Motion carried. Next on the Agenda was the consideration of a site plan for Hudson Furniture, property located at 3290 W. 1't Street in a GC- 2, General Commercial Zoning District. Owner: Fred Hudson; Representative: Mitch Collins - Harb Design Group. Mitch Collins, 3704 34th St., Orlando, stated that the site plan includes present and proposed future expansions. He stated that the future expansion is for information only. To show what is planned for the future. Mr. Stogner moved on approval with Staff's recommendations. Seconded by Mr. McClanahan. All in favor. Motion carried. Next was the consideration of the Site Plan for Florida Solar, property located at 100 Coastline Road in a RI -1 Restricted Industrial Zoning District. Property Owner /representative: H.D. Holsombach. Dick Holsombach, 511 Central Park Drive, stated that he had worked with Staff and has answered all questions. Mr. McClanahan moved on approval. Seconded by Mr. Stogner. All in favor. Motion carried. Mr. Skat asked Staff to check the fence around the retention pond at McDonald' s . He also asked Staff to check the curb in back of Chinese restaurant in 17 -92. Mr. McClanahan moved to approve the Minutes of the previous meeting. Seconded. by Mr. Skat. All in favor. Motion carried. There being no further business, the meeting adjourned at 8:00 P.M. , ",-, 4it f "Valler 4 i.no, Vice Chairman From the Director of Planning and Development /` December 31, 1997 TO: City of Sanford Planning and Zoning Commission SUBJECT: Recommendations for Meeting of December 18, 1997 SPRINTCOM - Request conditional use permit to establish a communication tower with support equipment located on a site with GC -2, General Commercial, AG, Agriculture and SR -1 A, Single Family Zoning and to allow a dimensional variance of separation distance from residential zoning at 4175 South Orlando Drive. Site is zoned GC -2, General Commercial, AG, Agriculture and SR -1 A, Single Family and includes an automobile dealership with associated buildings and automobile storage and display areas. The site fronts U.S. Highway 17 & 92. 2. The applicant proposes to construct a 130 foot tall communication tower on the eastern portion of the property. The proposed tower must be located a minimum distance from single family residential uses of 200 feet or 300 percent of the height of the tower, whichever is greater. Therefore the tower must be separated 390 feet from adjacent residential uses. The applicant requests a dimensional variance of 171 feet to allow the tower to be located 219 feet from an SR -1 A Zone. 3. Adjacent uses include automobile sales and service and governmental offices. Site is also adjacent to a heavily vegetated wetlands area that includes a portion of the site. The forested wetlands area separates the site from existing single family development located east of site. 4. Three communication towers are located west of the site at the Seminole County Five Points complex. 5. Recommend approval of the conditional use permit to establish a communication tower and allow a dimensional variance from residential zoning based on existing towers already established in the immediate area, existing site characteristics and existing natural vegetation separating tower from existing residential development. Planning Recommendations - Page 1 AAGAAR©- HARBIN CONSTRUCTION - Request dimensional variance of side yard setbacks for property Zoned RI -1, Restricted Industrial, located at 131 Commerce Way. 1. Site is Zoned RI -1, Restricted Industrial and is a vacant lot in an industrial park. 2. Applicant requests a dimensional variance of ten feet from the required twenty foot rear yard building setback along the easterly property line. This request was suggested to the applicant by the City's Plans Review Committee in order to provide improved on -site traffic circulation on this relatively small site. 3. An asphalt paving company with equipment storage is located adjacent to the site's easterly property line. Other adjacent uses include miscellaneous industrial services with equipment storage and other light industrial storage and wholesale activities. 4. Recommend approval of the requested dimensional variance based on plans provided by applicant dated October 21, 1997 and general characteristics of immediate area adjacent to site.
