The first item on the Agenda was to hold a Public Hearing to consider a request for a Conditional Use for O S P, Inc. to establish a single family residential dwelling for property located at 2523 Palmetto Avenue in a RC -1, Restricted Commercial Zoning District. Tax Parcel No: 01- 20 -30- 506 - 0000 -0130; owner: C S P, Inc. Representative: Alesandra Saunders. Alesandra Saunders -, 1102 Washington Ave . , Winter Park, was present for representation. She stated that this property sits on the border of minimal commercial and somewhat more residential. They will either market the property or rent it. The house is 24x32, 768 square feet. Mr. McClanahan moved to approve. seconded by Mr. Skat. All in favor. Motion carried. Next on the Agenda was to hold a Public Hearing to consider a request for a Conditional Use for property located at 1315 Pineway to establish an accessory residential structure (garage /guest apartment) in an AG, Agricultural Zoning District. Tax Parcel No: 18 -20 -31 -300- 014E -0000; Owner/representative: Ernest Fasciana. Ernest Fasicana, 1315 Pineway, Sanford, stated that the structure would be a guest apartment up above with an open garage below. It will be for guests only from June to December. He stated that he has 3.1 acres surrounded by woods and that there should not be any problems. Mr. McClanahan asked why Staff would recommend the limitation of structures when the codes clearly allows for 1 structure per acre. Mr. Marder stated that the site and environmental characteristics of the immediate area were considered. otherwise, it would open up the opportunity and precedent to start having two family, three family dwellings, etc. and changing the character over a period of time in that area. This particular dwelling unit that will be added is going to be an integral part of the principal residence. Mr. Stogner moved to approve and amended Item #4 of Staff's recommendations from 2 dwellings to 3. seconded by Mr. Dyal. Mr. McClanahan moved to amend the motion to approve the request as it stands without referring to the future number of dwelling units. Seconded by Mr. Dyal for discussion. Julie McAfee, 2120 County Road 427, that they would like to add an additional sign to the Aero Lane frontage. Mr. Stogner moved to approve with Staff's recommendations. Seconded by Mr. Hattaway. The next item was to hold a Public Hearing to consider a request for a Conditional Use for Alden Equipment Co. for the installation of a 1,000 gallon above ground fuel tank for property located at 500 Aero Lane in a RI -1, Restricted Industrial Zoning District. Tax Parcel No: 26- 19- 30 -5AE- 1400 -0000; owner: B C Family Partnership Ltd.; Representative: Crockett Bohannon, Alden Equipment Co., Inc. of Florida. Crockett Bohannon, 900 W. Chapman Road, Oviedo, stated that they are proposing to place a 1,000 gallon fuel tank to service their fleet vehicles as well as the equipment on -site. Mr. Robert moved for approval per Staff's recommendations. Seconded by Mr. Hattaway. All in favor. Motion carried. Next was to hold a Public Hearing to consider a request for a Dimensional Variance for Shell Oil Products, Inc. for a reduction in the front yard setback ( landscaping strip) requirements: 10' in width required, 5.25' proposed, a variance of 4.75 and a reduction in the accessory building setback requirements (canopy): 35' required, 25.85' proposed, a variance of 10.15 and an increase in sign (size) requirements: 50 square feet required, 75.62 square feet proposed, a variance of 25.62 square feet, for property located at 2500 Park Drive in a GC-2, General Commercial Zoning District. Tax Parcel No: 01- 20 -30- 501 - 0100 -0000 Owner: Shell oil Products, Inc.; Representative: Jeffrey Hodgkinson. Jeffrey.Hodgkinson, 865 N. Lake Fire circle, Oviedo, stated that there are three existing free standing signs on this site. They are proposing to take down the two price signs that are along the frontage of both Park Avenue and 46. Also , they would like to take down the old fashioned rotary sign and go with a fixed sign. The square footage is almost a swap right now. Mr. Hodgkinson stated that in light of the comments and talking with Mr. Gibson, he would be willing to reduce ghat is being proposed right now by 8.6 almost 9 square feet. Mr. Marder stated that there is only one free standing sign of 50 square feet permitted. The applicant could have two signs because of the two frontages but the signs would have to be a total of 50 square feet, 25 square feet each. Mr. Skat moved to approve the complete variance request per Staff's recommendations with the exception of the reduction. Seconded by Mr. Robert. Mr. Stogner stated that the applicant is willing to give up 10 square feet and feels that the Commission should cut back on the sign. Mr. Stogner opposed. All others in favor. Motion carried. MINUTES PLANNING AND ZONING COMMISSION MEETING OF JULY 17 1997 PAGE 3 The next item was the consideration of the Site Plan proposing a convenience store conversion to the Shell oil Station located at 2500 Park Drive in a GC -2, General Commercial Zoning District. Tax Parcel No: 01- 20 -30- 501 -0100 -0000; owner: Shell Oil Products, Inc.; Representative: Jeffrey Hodgkinson. Jeffrey Hodgkinson was also representing this request. He stated that he had received Staff's comments and recommendations and the only point he would like to comment on is the 15' exclusive easement along the front of SR 45. Also, Staff wanted two corner clips, one to the west of the site at oak where it intersects with SR 46, and one at Park and 46. Staff wants 20' corner clips at each of these locations and wants them to become dedicated. In talking with Shell, Mr. Hodgkinson stated that some compensation would be required for those dedications and he has conveyed this to Mr. Crumpton of the Utilities Department. The dedication was agreed upon this afternoon by Shell and Staff. The two corner clips and the 15' easement will be converted into an exclusive easement to the City of Sanford for future use for reclaimed water. It would be exclusive to the City.and no dedication would occur. Mr. Skat moved for approval. Seconded by Mr. Hattaway. All in favor. Motion carried. The next item was to hold a Public Hearing to consider a request for a Dimensional Variance for Lot 4, ACI Income Fund PD, for a reduction in the side yard setback requirements: 79' required, 75' proposed, a variance of 4 and a reduction in the rear yard setback requirements: 20' required, 12.7' proposed, a variance of 7.3' for property located at 110 Towne Center Blvd. in a PD, Planned Development Zoning District.Tax Parcel No: 29-19-30 -504 -- 0000 -0040; owner: ACI Income Fund, Ltd.; Representative: Todd Hudson, Tipton Associates, Inc. Todd Hudson, 764 Maguire Blvd., Orlando, and Frank Scripture, 600 E. Colonial Drive, Orlando, were present. Mr. Scripture stated that the building is designed for retail. They are building it for lease and he did not know what tenant would be going in as of yet. He stated that an eye glass shop has shown some interest. Mr. Stogner moved for approval based on Staff's recommendations. Seconded by Mr. Garrett. All in favor. Motion carried. Next was the consideration of the Site Plan for a proposed 7,000 sq. ft retail building for Lot 4, ACI Income Fund PD located at 110 Towne Center Boulevard in a PD, Planned Development Zoning District. Tax Parcel No: 29 -19 -30 -504 -0000 -0040; owner: ACI Income Fund, Ltd.; Representative: Todd Hudson, Tipton Associates, Inc. Todd Hudson was also representing this request. Mr. Robert moved for approval per Staff's recommendations. Seconded by Mr. Skat. All in favor. Motion carried. Next was to hold a Public Hearing to consider a request for a Dimensional Variance for Lot 3, Keyes Seminole Industrial Park located at 34 Keyes court for a reduction in the side yard setback requirements: 15' required, 10' proposed, a variance of 5' for property located in a RI -1, Restricted Industrial Zoning District. Tax Parcel No: 12 -20 -30 -510- 0000 -0030; owner: J. Munf ield; Representative: Harry Reynolds, Engineering Design. Harry Reynolds, P O Box 520695, Longwood, was present. He stated that the request is to allow the building to be moored 5' to accommodate maintenance of a sewer line on the north side of the building. Mr. Skat requested that 618 Mellonville and at the corners of 7th and San Marcos and 7th and Willow be passed along to Code Enforcement. Mr. McClanahan asked that 2100 Mellonville be checked also. Mr. Skat also stated that the lot on Palmetto, where the house was taken dawn, north of 619, has not been mowed. Mr. Skat stated that at 406 oak a new structure has been added without any permits or C of A. Mr. Valerino stated that he did call in and that he had an excused absence for the last meeting. Mr. Dyal stated that he was present at the last meeting. Mr. Stogner stated that it is important and requested that the Commission receive completed Staff recommendations before the meetings. He pointed out that the Police Department normally does not fill out their part of the recommendations. Mr. Dyal asked if Staff had checked on the status of the BP Station. Mr. Gibson stated "no ", but that he would add It to the list. Mr. Skat stated that he had asked Mr. Gibson what happened in the Minutes regarding the discussion of the zoning and uses in the downtown district that was brought about because of the labor pool. I From the Director of Planning and Development JuIV 10, 1997 /, TO: City of Sanford Planning and Zoning Commission SUBJECT: Recommendations for Meeting of July 17, 1997 SAUNDERSIOSP, INC. - Request conditional use permit to establish a single family dwelling on property Zoned RC -1, Restricted Commercial located at 2523 South Palmetto Avenue. Site is Zoned RC -1, Restricted Commercial and is vacant at the present time. 2. Uses adjacent to the site include single family dwellings, a hardware store and miscellaneous businesses. 3. Recommend approval of the request to establish a single family dwelling in an RC -1 Zone based on the existing character of the immediate area at the present time. FASCIANA - Request conditional use permit to establish an accessory residential structure in an AG, Agricultural Zone located at 1315 Pine Way. 1. Site is Zoned AG, Agricultural and appears to include one single family dwelling upon approximately 3 acres. A portion of the property appears to be wetlands. 2. Adjacent uses include a single family dwelling Zoned AG and vacant land Zoned RI -1 and AG. 3. At the present time the site and immediate area are considered to be of a rura character with various large tract homesites. 4. Recommend approval of the request to establish an accessory residential structure based on the ability to construct one dwelling unit per acre in the AG, Agricultural Zoning District and provided that the site shall be limited to two dwelling units based on site characteristics and rural character of the immediate area at the present time. Planning Recommendations - Page 1 INVACARE - Request a conditional use permit to establish a second sign for property Zoned RI -1, Restricted Industrial located at 699 Aero Lane. 1. Site is Zoned RI -1, Restricted Industrial and includes 9.5 acres with an approximately 100,000 square foot manufacturing facility under construction at the time of survey. 2. Adjacent uses include a truck driver training facility, equipment rental, manufacturing and vacant land. 3. A shopping center of similar size would be permitted to have one detached sign of up to 200 square feet. 3. Recommend approval of the request for a second sign based on double frontage as well as the size of the building in relationship to proposed detached signage which would total less than 100 square feet. ALDEN EQUIPMENT - Request a conditional use permit to establish an above - ground fuel storage tank in an RI -1, Restricted Industrial Zone located at 500 Aero Lane. 1. Site is Zoned RI -1, Restricted Industrial and includes a recently completed equipment rental establishment with associated buildings and parking areas. 2. Site is adjacent to a school and a truck driver training facility as well as vacant land Zoned RI -1. 3. Recommend that request to establish above - ground fuel storage tanks be approved based on truck and vehicular- related uses already established in the immediate area. HODGKINSON - SHELL OIL - Request dimensional variances for property Zoned GC- 2, General Commercial located at the southwest corner of 25th Street and Park Drive. 1. Site is Zoned GC -2, General Commercial and includes an existing gasoline service station. Site fronts State Road 46 East/25th Street and Park Drive. 2. Applicant requests dimensional variances as follows: a. Landscape strip, 10 feet wide required, 5.25 feet proposed. b. Canopy, 35 feet from property line required, 25.85 feet proposed. c. Sign, 50 square feet allowed, 75.62 square feet proposed. 3a. Regarding landscape, the applicant essentially requests to leave a portion of existing landscape strip adjacent to 25th Street "as is." The Planning and Zoning Commission has permitted five foot landscape strips instead of the required 10 foot strip in places where the site is essentially developed and is part of a renovation. Recommend approval of the requested variance for landscape based on existing development and improvements already in place. Planning Recommendations - Page 2 3b. Regarding the setback for the canopy, the site is essentially developed at the present time and compliance would appear to create a hardship to the applicant. Recommend approval of the requested variance of the setback from property line for the canopy based on existing improvement. 3c. Regarding signage, the site included four detached signs as well as one snipe sign at the time of inspection. The Planning and Zoning Commission granted a sign dimensional variance for the nearby credit union that permitted an existing sign face that was slightly larger than the 50 foot maximum permitted by the LDR to be reoriented. Recommend that the request for a variance to permit a larger sign be denied because there does not appear to be any special condition or circumstance related to the parcel nor would such conformance create a hardship upon the applicant. In fact, the proposed location of the sign at the signalized intersection of SR 46 and Park Drive provides excellent visibility and identification of the business. HUDSON /ACI INCOME FUND. LTD. - Request dimensional variances for property Zoned PD, Planned Development located at 110 Towne Center Boulevard. 1. Site is Zoned PD, Planned Development and includes existing at -grade infrastructure per the original plan. 2. Adjacent uses include a restaurant, gasoline service station, vacant and a shopping center. 3. Setbacks were established as part of the PD, Planned Development Master Plan approval process. Applicant requests to vary side yard setback from Towne Center Boulevard from 79 feet to 75 feet. Applicant also requests to vary setback from North Entrance Road from 20 feet to 12.7 feet. 4. Several dimensional requirements were varied for the ACI project including setbacks from Towne Center Boulevard and parking space size. 5. Recommend approval of the requested dimensional variances based on the unique nature of PD Zoning and similarity with variances already granted for the project. ENGINEERING DESIGN/MUNFIELD - Request dimensional variances for property Zoned RI -1, Restricted Industrial located at 34 Keyes Court. Site is Zoned RI -1, Restricted Industrial and is vacant. 2. Uses adjacent to site include a convenience store Zoned GC -2, General Commercial, a multiple family residential building Zoned RMOI, Multiple Family Residential Office and Institutional and an industrial building Zoned RI -1, Restricted Industrial. Planning Recommendations - Page 3 3. The applicant proposes to vary the side yard setback located on the south side of the site in order to locate the building further away from a City sewer line and related easement. The use immediately adjacent to the request is a parking lot associated with an industrial use. 4. Recommend approval of the requested dimensional variance based on the unique circumstance of the sewer line and easement upon the property and the need to place the building as far away from said line and easement as possible.
