MINUTES PLANNING AND ZONING COMMISSION MEETING OF JUNE 19, 1997 7:00 P.M. CITY COMMISSION CHAMBERS CITY HALL, SANFORD, FLORIDA MEMBERS PRESENT: Lynn Stogner Helen Stairs Mac McClanahan Otto Garrett Jiro Valerino Ross Robert Leon Brooks MF1WERS ABSENT Michael Skat - excused Ben Dural - excused OTHERS PRESENT: Russ Gibson, Land Development Coordinator Marion Anderson, Recording Secretary Mrs. Stairs called the meeting to order at 7:00 P.M. The first item considered on the Agenda was to hold a Public Hearing to consider a request for a Conditional Use for Greyhound Bus Lines for property located at 503 E. lst Street in a GC -2, General Commercial Zoning District to establish a public transportation terminal (bus station). Tax Parcel loo: 30- 19 -31 515 - 1400 -0020; Property Owner: Two- Noles, Inc. Representative: Donald Reed. Carlos Rogers, area manager with Greyhound, 555 N. John Young Parkway, Orlando, and Donald Reed, terminal manager, 503 E. 1st Street were present. Mr. Rogers stated that this is a great opportunity for Greyhound to be in Sanford. They are happy to comply with Staff's recommendations, except for Item B which states that the property owner shall be responsible within a 30 day period for damages. Mr. Rogers stated that Greyhound will be responsible for any damages and not the property owner. He provided a copy of Greyhound's liability insurance. Mr. McClanahan recommended that the Commission substitute Greyhound Bus Lines instead of the property owner regarding Item 5B in the staff's conditions. Mr. Gibson stated that this would be acceptable with Staff. Mr. Brooks asked if the service would be full function or just dropping passengers off. Mr. Rogers stated that it would be just drop off and pick up. It is a bus stop, basically, the buses would be there no longer than 2 or 3 minutes. Mr. Robert pointed out that the traffic flow on the diagram submitted indicates that the buses would be leaving going west. Mr. Rowe's letter indicates that he would like for the buses to go east. Mr. Rogers stated that Greyhound wants to do what is easiest and best for everybody. Mr. Robert stated that the best traffic plan would be Mr. Rage's plan. Mr. Rogers agreed. Mr. McClanahan moved on approval subject to the conditions as stated. Seconded by Mr. Stogner. All in favor. Motion carried. The next item considered was to hold a Public Hearing to consider a request for a Conditional Use for Strathmore Products, Inc. for property located at 130 Coastline Road in a RI -1, Restricted Industrial Zoning District for the purpose of a paint MINUTES PLANNING AND ZONING COMMISSION MEETING OF JUNE 19 1997 PAGE 2 manufacturing facility. Tax Parcel No: 28- 19- 30 -5JB -0000 -0440; Property owner: Earl M. Leiffer; Representative: Dick Holsombach. Dick Holsombach, 1218 E. Langley Ct., Lake Mary, stated that he had constructed a 20,000 square foot warehouse facility for Earl Leiffer which was built as an investment. They have been approached by Strathmore Paints to lease the building from Mr. Leiffer. Strathmore Paints is a company out of Syracuse, NY, which has been in business for 55 years. They are presently in the process of buying two similar companies in Florida, one in Oviedo and one in Miami, and they would life to consolidate all of their activities here at this Sanford location. It qualifies as a hazardous use because they manufacture certain types of paints that have certain types of solvents. An extensive study has been done in cooperation with the Fire Marshall and other members of the Staff and the necessary criteria has been reached to properly protect the building so that none of the surrounding buildings or people in this building would be in any danger. Mr. McClanahan questioned the west side of Northstar Road. It shows that the City of Sanford owns a 5' strip of land. This could, technically, block people from having access to their property. Mr. Holsombach stated that he doesn't know why this strip sits there either. It was done in conjunction with the original platting. Mr. Gibson stated that he was thinking it may have been a remedy for a deficiency in the right-of-way. Mr. Gibson will research and provide the Commission with the information. Mr. George Whipple representative of Strathmore Products, 231 Shuckman Road, Maitland, was also present for representation. Mr. Garrett questioned whether the equipment would be moved from the other two plants or if it would be new equipment. Mr. Whipple stated that they would utilize the existing equipment. Mr. Gibson informed the Commission that the Fire Marshall, Mike McGibeny was present. He also stated that Staff has recommended approval subject to the stipulations and approval of the Fire Marshall. Mr. Robert asked if the Standard Fire Protection Code would be applied to this operation and questioned storage. Mr. Whipple stated 'eyes ". He does not envision underground tanks at this facility because there is no place to put them. Growth will detail outside storage tanks. Storage would mostly be in steel 5 gallon buckets and 55 gallon drums. Mr. Whipple stated that there would be 10 to 12,000 gallons of paint stored over a 47 day period. The budding has ceiling vents, and ventilation fans will be at ground level. Dave Brewer, 3149 Ossie Point, Longwood, stated that he owns the buildings at 125 Coastline, 120 Coastline and 230 Coastline Road. He is concerned with the future environmental impact and with odors. He stated that he is concerned with the possibility of fire and what recourse would they have after approval, if there is an odor or some other type problem. Mr. Brewer stated that he is concerned with the changing use. Mr. Whipple stated that there would be some smells inside the building, and with 4 locations, there has never been a complaint on odors. Exhaust fans are filtered and they take all particles away. Dissipation is i immediate. There are no floor drains in the building and no way to contaminate the ground. Mr. McClanahan stated that he has had pretty close dealings with Coronado Paint company on the East Coast and Color Wheel in Fairvilla and that he has never known of any complaint environmental or otherwise. Conrad Palombo, ownner of 122 Coastline Road, home address 1778 Alaqua Drive, Longwood, stated that one attraction for them for this Park was that it is a Restricted Industrial area. Now it is trying to change into a heavy industrial area. He stated that from going from,a light industrial to a heavy industrial area, their investments would not be protected. There area a lot of small business in this Park and they have a right to protect their business values. He is concerned with the number of trucks coming in and out, and whether or not there would be a future date of underground or outdoor storage. The area does not lend itself to underground storage. Some type of outdoor storage would have to be put in. He asked where would the paint be stored. He is concerned also with the appearance of the area. Mr. Whipple stated that the building has four overhead doors for moving items in and out and that there would be 10 to 12 trucks a day, including UPS. All paints will be stored inside. Mike McGibeny, Fire Marshall for Sanford, 933 Village Dr., Ormond Beach, stated what has been done is that he and one of his inspectors went out to the present facility to basically familiarize themselves with what Strathmore Products does and to gain some MSDS material data sheets to find out what the materials are. Mr. McGibeny stated that they also contacted the sprinkler contractor and had them do an analysis of given the stuff that is put in the building and how to deal with it and what level of upgrade would be needed for the fire sprinkler system. He also talked with the Building Official and the Land Development Coordinator. Mr. Stogner asked what type of contained storage would be on site. Mr. McGibeny stated that the proposed design would be about 2000 square feet in front for the office, roughly 1300 square feet in the middle of the plant would be for storage, and about 5000 square feet in the back for the production area. He would be looking for a lip that would contain any spillage possibly between the office area and the warehouse and then the warehouse and the production area. In essence, there would be a large storage area. g g The paint company would have to go to high density, including foam, because of the type of material, and because of the flammability and combustibility of some of the materials that are in the plant. The upgrade is significant, it will require a 500 gallon interior storage unit for the 3% in the foam water sprinkler system. Mr. Gibson noted that a manufacturing use is a permitted use in the Restricted Industrial Zoning District. The issue before the Commission is the fact that it contains hazardous materials. The applicants have worked with Staff addressing any of the concerns that Staff has had at the development level as well as a working relationship with the Fire Department. With regards to any outdoor storage, this request is purely for indoor use only and even outdoor storage tanks would require a Conditional use. Mr. Palombo stated that after this is approved, then they come back and ask to do outside storage. The concern is what is the recourse after approval. If they could give assurance that no MINUTES PLANNING AND ZONING COMMISSION MEETING OF JUNE 19, 1997 PAGE 4 outside storage would ever be approved, then they wouldn't have the objection that is being voiced. Mr. Brewer asked what is the Fire Marshall's opinion on the odor. Mr. McGibeny stated that at the existing plant, while he was there, there was no identifiable odor in the facility, Mr. Robert moved to approve per Staff's recommendations. Mr. Brooks seconded. Mr. Valerino stated that he is familiar with Mr. Whipple and the company he owns and that he knows Mr. Whipple will do everything to eliminate problems and that the evidence presented is honest and trustworthy and so he is in favor. Next was to hold a Public Hearing to consider a request for a Dimensional Variance for Seminole County Services Building located at 1101 E. 1st Street in a RMOI, Multiple - Family Dwelling Residential- Office - Institutional Zoning District for the purpose of reducing parking stall width: 10 feet required, 9 feet proposed, a variance request of 1 foot. Tax Parcel No: 30-19 - 31 -506- 0200 -0010; Property Owner: Seminole Board of County Commission; Representative: Glenn Semanisin. Glenn Semanisin, 1101 E. 1st Street, engineer with the County, stated that he was present tonight to request the reduction, by 1 -foot, the width of the employee parking spaces. What they are attempting to do is restripe the parking lot which lies on the south side of 2nd Street and also construct a new 22 space parking lot which would also face 2nd Street. The variance will help maintain the large amount of green space around this building. The 9' space will only be used for employee parking spaces. Mr. Stogner moved on approval based on Staff's recommendations. Seconded by Mr. Brooks. All in favor. motion carried. Next was the consideration of the Site Plan for Sanford Middle School Additions and Renovations Project located at 1700 French Avenue in a SR -1, Single Family Residential Zoning District. Tax Parcel No: 36- 19 -30- 300 -0440 -0000; Property owner: Seminole County school Board; Representative: Basem Ghneim, Project Manager. Basem Ghneim, 400 E. Lake Mary Blvd., Project Manager for the School Board, stated that they are proposing to demolish several buildings near 18th Street and replace them with a 75,000 square foot building. They are proposing to relocate the on- street bus route to an on -site bus route. Completion of the work is scheduled for the 98/99 school year. Mr. Ghneim stated that the facility would have one elevator and three stair cases servicing the building and that the windows would be operable. A 700 ton chiller system will service the facility and would be housed in its own building. Mr. Robert moved on approval per Staff's recommendations and final engineering plan approval. Next was the consideration of the Site Plan for two office /warehouse buildings for Lots 2. 3, and 4a, Keyes Seminole Industrial Park Replat located at 30 and 34 Keyes Court in a RI- 1, Restricted Industrial Zoning District. Mr. McClanahan moved for approval based on Staff's recommendations and subject to final engineering plan approval. Seconded by Mr. Brooks. All in favor. Motion carried. Next, the Commission held a Public Hearing to consider revisions to Sanford s Land Development Regulations amending Schedule Land Use classifications, and Schedule E Permitted Uses, combining alcoholic beverage sales classifications for each land use category - off premises consumption and on premises consumption. Mr. Gibson stated that the recommended changes reflect-the necessary alignment of the Land Development Regulations with changes to the City code. The LDR is recommended-to be changed to reflect a total of two categories, off-premises consumption and on- premises consumption. These changes will have no significant effect upon the conditional use process that the Planning and Zoning commission already administers. Mr. Robert moved to recommend approval to the city Commission that they align the Zoning ordinance /Land Development Regulations /and the Alcoholic Beverage Code, and the proposed changes to Schedule A, Land Use Classifications and schedule B. the Permitted Uses. Seconded by McClanahan. Mr. valerino was in opposition because of the time that this item was brought before the Planning and Zoning Commission - after City commission action. All others in favor. Motion carried. Mr. valerino moved to approve the Minutes as circulated. Seconded by Mr. Brooks. All in favor. Motion carried. There being no further business, the meeting adjourned at 8:30 P.M. 5 Helen Sta' s, Chairperson r� F k:� �IJ6 r. rrr I From the Director of Planning and Development June 12. 1997 TO: City of Sanford Planning and Zoning Commission SUBJECT: Recommendations for Meeting of June 19, 1997 REED - GREYHOUND BUS STOP - Request conditional use permit to establish a public transportation terminal in a GC -2, General Commercial Zone located at 503 East First Street. Site includes a one -story multi- tenant shopping center located on approximately one third acre. The site is Zoned GC -2, General Commercial and fronts East First Street and Cypress Avenue. 2. Adjacent uses include a senior housing complex, a shopping center, a museum and vacant land. 3. At the date of this review the site was functioning as a bus station based on an occupational license issued with conditions including the following traffic plan: Incoming traffic: Seminole Boulevard from the west to Sanford Avenue, south to Second Street East, to Cypress Avenue, then north to site; Outgoing traffic: From site travel East on First Street to San Juan Boulevard, turning north to Seminole Boulevard and travel west to U.S. Highway 17 & 92, then either continue to 1 -4 along Seminole Boulevard, or turn south onto U.S. Highway 17 & 92 to State Road 46 turning west to 1 - 4. The primary purpose of the above condition as established by Community Development/Licensing was to insure no further damage to City street signage, specifically based on the destruction of a street sign at the northeast corner of First Street and Sanford Avenue which was clipped by a bus. 4. A Lynx bus stop is located just west of the site on both sides of First Street. 5. Recommend approval of the conditional use permit to establish a public transportation terminal based on the similarity of uses already established in the immediate area and with the following conditions: a. That all bus routing and related traffic circulation within Sanford be specifically approved by the City, and; b. That the property owner shall financially reimburse the City of Sanford Planning Recommendations - Page 1 within a period of thirty days upon request by the City of Sanford for such reimbursement for damage to public infrastructure, including but not limited to street signs, street lights, street signals, pavement, curbs, drainage inlets, and/or other similar appurtenances caused by Greyhound buses. C. That the applicant shall agree to a., and b., above, in writing pursuant to a Developer's Agreement. CANTERBURY CONCEPTS. INC. - Request conditional use permit to establish paint manufacturing (hazardous materials) in an RI -1, Restricted Industrial Zone located at 130 Coastline Road. 1. Site is Zoned RI -1, Restricted Industrial and includes and industrial type building fronting Coastline Road. 2. The applicant proposes to establish paint manufacturing which will include the processing of hazardous materials. The applicant provides an explanation of the use of the building in a letter dated May 19, 1997 with attachments. The process will be conducted indoors. The applicant has met with City staff regarding the proposed use including the City Fire Marshall. 3. The site is located in an industrial park which includes various industrial, manufacturing and warehousing activities. Hazardous materials collection and transport activities are located near the site (Safety Clean). 4. Recommend approval of the request to establish paint manufacturing with associated use of hazardous materials based on similar uses already established in the immediate area and subject to approval of all state, federal and City hazardous material requirements including but not limited to approval of recommendations and stipulations by the City of Sanford Fire Marshall. SEMINOLE COUNTY DEVELOPMENT REVIEW - Request for a dimensional variance to parking space size for property Zoned RMOI, Multiple Family Residential, Office and Institutional, located at 1101 East First Street. 1. Site is Zoned RMOI, Multiple Family Residential, Office and Institutional and includes an office building, specifically the Seminole County Services Building. 2. The applicant proposed to reduce the parking space size for employee parking. The applicant cites the need for additional parking evidenced by customer complaints. The principal building on the site was constructed over forty years ago as a community hospital. 3. Recommend approval of the request to decrease the parking space size for employee parking by one foot in width based on similar reductions in other locations granted by the Planning and Zoning Commission as well as the existing characteristics of the site in question.
