MINUTES PLANNING AND ZONING COMMISSION MEETING OF JANUARY 15, 1997 7:00 P.M* CITY COMMISSION CHAMBERS M MBERS PRESMiT : Lynn Stegner Otto Garrett Ben Dyal Jim Valerino Helen Stairs Mac McClanahan Ross Robert Leon Brooks MEMBERS ABSENT: Michael Skat- excused OTHERS PRESENT: Jay harder, Director of Planning and Development Russ Gibson, Land Development Coordinator Marion Anderson, Recording Secretary Mrs. Stairs called the meeting to order at 7 :00 P.M. The first item on the Agenda was to hold a Public Hearing to consider a request for a Conditional Use for Public Storage located at 2505 Orlando Drive in a GC -2, General Commercial Zoning District, for the purpose of a truck rental facility. Tax Parcel No.: 01- -20 -30 -512- 0000 -014A; Owner: Sanford Plaza, Inc.: representative: Paul Blackketter. { Al Carpenter, Conklin, Porter, and Holmes Engineers, 500 W. Fulton St., was present representing Mike carter Construction Company which represents Public Storage. He stated that Public Storage is constructing a new building at this address to supplement the existing use. They are proposing to conduct a truck rental business which will benefit their customers. Parking space is available on -site and there. will be no storage problems. Truck rentals will not be visible from the street. hr. Carpenter stated that Public Storage is proposing two truck spaces outside the fenced area, and 7 spaces behind the fence inside the secure area to store the trucks when they are not being used. Landscaping will be provided. Mr. Stogner questioned the type of trucks. Mr. Carpenter stated that Public Storage will be working with Rider type rental trucks which will be, at the most, 30 long. All maintenance will be done off -site. Mr. Robert moved for approval based on similar automotive uses already established in the immediate area and the location of such truck rental activities as depicted on site dimension plan submitted by applicant. Seconded by Mr. Dyal. Mr. Stegner asked if the motion included no more than 7 spaces. Mr. Robert stated "yes, per Staff's recommendations ". All in favor. Motion carried. Mr. Marder, stated that the City has been concerned with alcoholic beverage sales recently at the City Commission level. In a section of the City Code, outside of the Land Development Regulations, Chapter 3, Alcoholic Beverage Regulations, there are some distance requirements that Staff should have been cognizant of. For example: there is a 2000 separation standard between alcohol, beer and liquor. If not classified as ` a restaurant, a facility must be 2000' from schools and churches. Any applicant for alcoholic beverage sales for consumption on premises has to come before this Body and get an approval. whether they comply with those other things that this 'Commission doesn't have official jurisdiction upon or not, is something that is good to be knowledgeable about but is not germane to this Commission's decision. MINUTES PLANNING AND ZONING COMMISSION MEETING OF JANUARY 16, 1997 PAGE 2 Staff will screen out applications that are visibly within 2000 of churches or schools. Next on the Agenda was to hold a Public Hearing to consider a request for a Conditional Use for FSV Inc. of Deltona located at 930 and 940 State Street (Sanford Plaza) in a GC -2, General Commercial zoning District, for the purpose of alcoholic beverage sales for consumption on premises -AB -COP. Tax Parcel No.: 01 -20- 30- 512 - 0000 -0210; owner: Sanford Plaza, Inc.; representative: Barry Cunningham - FSV, Inc. Jim Hattaway, Hutchinson, Mamale & Coover, was present on behalf of West End Music Fair. Also present were Mr. Stan Smith of FSV and Barry Cunningham, who will be the manager of the establishment. Mr. Hattaway stated that Schedule B, Chapter 3 of the City Code describes the 2000' distance as when a pedestrian would, walk following the right -of -way from door to door. Altamonte Surveying measured the distances between this establishment and the churches and school. From Pinecrest Baptist Church there is a distance of 2730'. The Page School wasn't measured because it was way beyond the 2000' requirement. The Lutheran Church, on the north side, is 2303'. This is no longer an established church, it is shut down, and it is for sale. The hours of operations would be at times when the school is closed and the churches are not conducting services. The Plaza itself performs as a barrier. Mr. Hattaway stated that this request meets the goals of the City's Comprehensive Plan, the request does not clash with the City's Land Development Regulations, the request does not infringe upon the peace and tranquility of the citizens of Sanford, and the applicant will take all prudent measures to make sure that the patrons obey the law and respect the peace of the City. Mr. harder stated that it is not the Commission's formal authorization to consider the 2000 requirement because it is not in the Zoning ordinance, it is not under this Commission's authority. Stan Smith, 3220 Krider Ave., Deltona, stated that they needed the license to accommodate major acts. He stated that he had talked with the City Manager and that the City Manager had told him what survey route to take. Engineering Staff walked that same route and came up with a distance of 2282 Mr. Robert moved on approval. Seconded by Mr. McClanahan. All in favor. Motion carried. Mr. Dyal moved for approval of the December 19, 1996 Minutes. Seconded by Mr. Robert. All in favor. Motion carried. Mr. McClanahan moved for approval of the January 2, 1997 Minutes. Seconded by Mr. Brooks. All in favor. Motion carried. Mr. Stogner questioned the bright lights at the Shell Station at 25th and Park and asked that Staff check on this. Mr. Dyal noted that across the street, the shopping center, the northend of the parking lot, there is a great big sign and that this sign must go. Mr. Dyal questioned the Escambia Avenue property and Mr. harder noted that this is in Code Enforcement. Mr. Marder stated that the City Commission reviewed the Tower Ordinance and offered two. revisions: 1) they wanted the separation from residential to be the same for single family and multiple family. This Commission came up with 200 and 300% of distance for the single family and 100 for multiple family, so we just made it 200 and 300% for multiple family of the height of the tower; and, 2) we wanted words for collocation to include, specifically, MINUTES PLANNING AND ZONING COMMISSION MEETING OF JANUARY 16, 1997 PAGE 3 as a minimum that towers exceeding 100 would have to be engineered and constructed to accommodate a minimum of 2 providers i.e. 1 additional provider, that the City will have the authority to require /stipulate that communication towers be engineered in a manner that provides for 2 or more collocations as part of the conditional use and site plan process. As part of conditional use approval, owners of existing communication towers are required to permit, upon request, to another service provider, and for reasonable agreed upon consideration, additional communication service providers upon such existing communication tower. The consensus of the Commission was that they did not like the wording that Mr. Marder presented regarding the Tower ordinance. There being no further business, the meeting adjourned at 8:15 P.M. Helen St z s, Chairperson r. 116 r From the Director of Planning and Development January 10, 1997 TO: City of Sanford Planning and Zoning Commissioner -L� SUBJECT: Recommendations for Meeting of January 16, 1997 PUBLIC STORAGEIPAUL BLACKETTER - Request a conditional use permit to establish truck rental for property Zoned GC -2, General Commercial located at 2905 Orlando Avenue. Site is Zoned GC -2, General Commercial and contains various rental storage buildings and a storage office building that is currently under construction. Vehicles are stored on the site in a fenced area. The applicant has submitted a site plan (Sheet 5 of 7, Site Dimension Plan) that appears to depict seven (7) parking spaces for rental trucks. 2. Uses adjacent to the site include liquor sales and alcoholic beverage sales, automobile sales and rental, automobile repair and service and retail sales and service uses. 3. Recommend approval of conditional use permit to establish truck rental based on similar automotive uses already established in the immediate area and the location of such truck rental activities as depicted on Site Dimension Plan submitted by applicant.
