CITY COMMISSION CHAMBERS CITY HALL, SANFORD, FLORIDA MEMBERS PRESENT: Helen Stairs Otto Garrett Lynn Stogner Mac McClanahan Ben Dyal Leon Brooks Ross Robert MEMBERS ABSENT: Jim Valerino Michael Skat SRS PRESENT: Jay Marder, Director of Planning and Development Russ Gibson, Land Development Coordinator Marion Anderson, Recording Secretary Mrs. Stairs called the meeting to order at 7 :00 P.M. The first item on the Agenda was to hold a Public Hearing to consider a request for a Conditional Use for property located at 609 W. 27th Street in a GC -2, General Commercial Zoning District, for the purpose of automobile dealer sales and service (auto wholesales and detailing). Owner /re presentative: Angelo Reali. Due to lack of representation, Mr. Dyal moved to table. Seconded by Mr. Stogner. All in favor. Motion carried. The next item on the Agenda was to hold a Public Hearing to consider a request for a Conditional. Use for property located at 3508 Orlando Drive in a GC -2, General Commercial Zoning District, for the purpose of mini - storage facility. Owner: Scotty's, Inc.; representative: Thomas C. Hartmann. Tom Hartmann, P.O. Box 593688, Orlando, was present representing the proposed owner. The owner has an option to purchase the property based on conditional use approval. Mr. Marder explained that this property is in the back of Sonny's Bar- be -Cue. Mr. Robert questioned whether or not there is a proposed mutual agreement for the ingress and egress at Sonny's. Mr. Hartmann stated that Scotty's is the owner of the property. When Scotty's sold to Sonny's, it became a cross access easement. William Wilkins, 105 Lake Dot Drive, was present representing the DAV. He stated that the DAV did not know if they have. concerns or not because they haven't seen any renderings or a site plan. Mr. Wilkins stated that they wanted to know exactly where the building would sit. Mr. Hartmann showed a site plan to Mr. Wilkins. Mr. Wilkins stated that they were in opposition to the request because the building would infringe on an area of parking that they have used for over 40 years; although they know that the property belongs to Scotty's. After a brief explanation that the Commission was considering land use and not site plan approval, Mr. Robert moved to approve as per Staff's recommendations. Mr. Dyal seconded. All in favor. Motion carried. Next on the Agenda was to hold a Public Hearing to consider a request for a Conditional Use for Lock -Safe- Self Storage located at 2650 W. 25th Street in a GC -2, General. Commercial Zoning District, for the purpose of truck rental. Owner: Montague - Betts, Inc,,,, representative: Dianne L. Lawson. Diana Lawson, 409 Crystal Lake Drive, Orlando, was present and stated that within the next year and half, they would like to have truck rental at this facility. Plans have not been finalized. MINUTES PLANNING AND ZONING COMMISSION MEETING OF NOVEMBER 7, 1996 PAGE 2 Trucks for rental will not be any larger than 24 She stated that the rear of property has 24 parking spaces. 15 of these spaces will be used for truck rental and the rest for recreational vehicles. Mr. Dyal asked why would they need a conditional use for truck rental if they can put recreational vehicles in the site. Mr. Marder stated that he didn't know if they could store recreational vehicles. He stated that they do not have a conditional use. Mr. Stogner asked if the vehicle parking spaces that are 10x30 and 10x20 will be used for recreational vehicles. Ms. Lawson stated "yes." Mr. Robert asked if it was Staff's desire to have this in perpetuity. Mr. Marder stated that a time limit would be a reasonable condition. Mr. Stogner moved for approval with Item 3 to be amended to limit vehicles to no more than 24' and limit the spaces to no more than 15 including spaces for RV's on the back of the property. Mr. McClanahan seconded. Mr. Dyal how asked how many recreational vehicles are parked there now. Ms. Lawson stated 6. Mr. McClanahan noted that the majority of RV's are more than 24' in length. Mr. Marder noted that he didn't recall how the site plan was approved but that it may very well have been approved with storage of vehicles. The storage area is walled off, can't see in. Mr. Stogner withdrew his motion and Mr. McClanahan withdrew his second. Mr. Stogner moved for approval to amend Item 3 of Staff's recommendations to include., for rental and RV's, no more than 15 spaces in the back of the building. Seconded by Mr. McClanahan. All in favor. Motion carried. Next on the Agenda was to hold a Public Hearing to consider a request for a Conditional Use for property located at 1701 Lowe Avenue (Derby Park) in an AG, Agriculture Zoning District, for the purpose of a telecommunications tower (166' monopole). Owner: City of Sanford; representative: Charles Rucker, American Portable Telecom, Inc. Jed Kruchten, 283 North Lake Blvd., Altamonte Springs, was present. He stated that APT is building out a wireless system. FCC has . granted additional licenses to promote competition. Mr. Dyal asked about landscaping. Mr. Marder stated that there are some well heads in the area and that landscaping would have to be decided on. Mrs. Stairs questioned the responsibility for removal. Mr. Kruchten stated that there would be a standard lease, agreement whereby if APT terminates the le -ase, they are responsible to take out the facility to like conditions, 2' below grade. Mr. Robert moved to approve per Staff's recommendations Seconded by Mr. Stogner. All in favor. Motion carried. Next on the Agenda was to hold a Public Hearing to consider a request for a Conditional Use for property located at 700 W. 13th Street in a GC -2, General Commercial Zoning District, for the purpose of a telecommunications tower (132' monopole). Owner: Ice Enterprises of Mid Florida, Inc.; representative: Charles Rucker, American Portable Telecom, Inc. Jed Kruchten was also representing this request. The site is the northwest corner of French Avenue and 13th Street. Mr. Dyal asked about the landscaping and if the fencing would be vinyl. Mr. Kruchten stated that they have agreed to landscape in accordance with Seminole County standards.. Mrs. Stairs asked if the distances from residential property were acceptable. Mr. Marder'stated that the City is O.K. with this. Mr. Garrett asked about the recommendations for cleaning up the site area.. He asked if this is the entire area or just the site area. Mr. Kruchten stater; that the landowner has given them permission to do whatever they wanted to within the lease premise, but not to touch his stuff. Mr. Dyal moved on approval with Staff's recommendations as submitted. Seconded by Mr. Robert. All in favor. Motion carried. Orange Ave, Orlando, stated that they have addressed the three cross access points. Mr. Robert moved to approve, per Staff's recommendations.. Seconded by Mr. Brooks. All in favor. Motion carried. Next was the consideration of the Site Plan for Sun -Tech Windows, Inc., a proposed 9,000 sq. ft. office/ warehouse facility for manufactured windows located. at 450 North. Way in a MI -2, Medium Industrial Zoning District. Tax Parcel Number: 07-20-31- 300 -017R- 0000; owner: Fla Tenco, Inc.; representative: Don Fulsang - Harry Reynolds, Engineering Design. Harry Reynolds, Engineering Design, was present. Mrs. Stairs abstained, stating that she is representing the seller. Mr. Dyal asked the use of the land immediately west of the building within this property. Mr. Reynolds stated that this is the retention area. Mr. Stogner moved on approval. Mr. Dyal seconded. Mrs. Stairs abstained. All others in favor. Motion carried. Next was the consideration of the Site Plan for Andreyev Engineering Inc., a proposed 4,160 sq. ft. office /warehouse facility located at 105 Coastline Road in a RI -1, Restricted Industrial Zoning District. Owner /Representative: Nicolas Andreyev - Andreyev Engineering Scott Kavin, 819 Darkness Street, Orlando, was present. Mr. Robert asked if there are any chain link fences. Mr. Gibson stated.that there is, in the rear of the site for storage of vehicles. Mr. Robert questioned the drainage /swales in front of the property. Mr. Kavin explained that this is a common retention pond. Mr. Dyal moved to approve with Staff's recommendations. Seconded: by Mr. Brooks. All in favor. Motion carried. The next item on the Agenda was the consideration of the Site Plan for Towne Center Playa at Seminole Towne. Center ( f ormer Holiday Inn site) located at 251 Oregon Avenue in a PD, Planned Development Zoning District. (PD Rezone approved with conditions on 8/15/96). Owner: M.S. Management Assoc., Inc. c/o Simon Property Group; representative: Rick Merkel, Professional Engineering Consultants. Rick Merkel, PEC, 200 E. Robinson, Orlando, was present for representation. The next item was the consideration of the Site Plan for Alamo Rent --A -Oar Maintenance Facility located at 2101 E. Airport Boulevard in a RI -1, Restricted Industrial Zoning District. Owner: City of Sanford Lessee: Alamo Rent -A -Car; representative: Hartman And Associates, Inc., Roderick Cashe P.E. Roderick Cashe also represented this request. Mr. Brooks moved for approval per Staff's recommendations. Seconded by Mr. Robert. All in favor. Motion carried. Mr. Stogner asked when would the data on the telecommunication towers be ready for the City Commission. Mr. Mar.der stated that it is being held in abeyance until the other local governments are finished working as to how tower regulations all fit together. Mr. Dyal asked Staff to ask the School Board to cut grass on the School Board Site at 3rd Street and Holly Avenue. Mr. Brooks requested that a condemnation notice be. placed on the BP site at Celery and Locust Avenues.. Mr. Robert requested that the Minutes be changed to reflect Jerry Waller instead of Maller, on page 2, and moved to approve the Minutes with the noted change. Seconded by Mr. Brooks. All in. favor. From the Director of Planning and Development October 31, 1996 TO: City of Sanford Planning and Zoning Commission SUBJECT: Recommendations for Meeting of November 7, 1996 REALI - Request conditional use approval to establish automotive dealer sales and automobile and truck service (detailing) for property Zoned GC -2, General Commercial located at 609 West 27th Street. 1. Site is Zoned GC -2, General Commercial and includes various activities including but not limited to automobile and truck repair, storage, residential and off ice. The site appears to include several non - conforming structures and does not comply with the City's landscape and buffer requirements. In addition, the site appears to lack clearly defined on -site traffic circulation and parking. In addition, signage on the site may be nonconforming. 2. Uses located adjacent to the site include a shopping center, an elementary school and a veterinary clinic /hospital. 3. Based on automobile - oriented uses already established on the site, recommend approval of the request to establish automobile dealer sales and automobile and truck service provided however that such uses shall be conditioned upon: a. Correction, to the maximum extent feasible, of site deficiencies and /or nonconformities including landscape, traffic circulation, parking and signage pursuant to staff site plan approval. b. All automobile and truck service, i.e., detailing, shall be conducted indoors. C. All automobile and truck repair shall be rearranged to comply, to the extent feasible with current LDR requirements. d. Parking shall not occur in the right -of -way. HARTMANN - Request conditional use approval to permit wholesale and storage (mini - warehouses) for property Zoned GC -2, General Commercial located at 3505 Orlando Drive. Planning Recommendations - Page 1 1. Site is Zoned GC -2, General Commercial, includes approximately 4.63 acres and is vacant at the present time. Site fronts U.S. Highway 17 & 92. 2. Uses adjacent to site include automobile dealer sales, a restaurant, a City park, tire sales and vacant land. 3. Recommend approval of the request to establish wholesale and storage activities in the form of mini - warehouses based on existing character of the immediate area at the present time with the condition that all storage activities shall be conducted indoors. LOCK -SAFE SELF STORAGE - Request conditional use approval to permit truck rental in a GC -2, General Commercial Zone located at 2650 West 25th Street. 1. Site includes a mini - warehouse complex with associated offices. The site fronts West 25th Street or County Road 46A which is scheduled to be widened to four lanes within five years. The site appears to be "walled in" on all sides. 2. Uses located adjacent to site include a community shopping center, a vacant landscape nursery, a veterinary clinic and vacant land. 3. Recommend approval of the request to establish truck rental based on self - contained nature of improvements already established on site and existing commercial character of area at the present time. Also recommend that the use of site for truck rental be conditioned upon staff approval of arrangement of rental vehicles per site plan requirements and that all off - street parking requirements be met. AMERICAN PORTABLE TELECOM AT DERBY PARK - Request conditional use permit to establish a communication tower in an AG, Agriculture Zone at 1701 Lowe Avenue. 1. Site includes a City -owned tract of approximately 25 acres that includes active potable water wells as well as recreational facilities primarily utilized for a soap box derby track. The site is bisected north /south by a 110 foot wide power line easement that includes two structures with multiple lines. 2. At the present time immediately adjacent property appears vacant. However, several single family homesites on acreage sites are located in the immediate area in unincorporated areas Zoned Agricultural. An undeveloped planned development known as Indian Trace is located on the easterly property line of the site. The Indian Trace Planned Development is approved for residential use with a gross residential density of eight (B) dwelling units per acre. 3. The "Missing Link" of the Seminole Expressway from 1 -4 to U.S. Highway 17 & 92 will be located on the north side of the site. 4. The proposed communication tower would be 166 feet in height. It is proposed Planning Recommendations - Page 2 to be located on the east side of the site. Recreational improvements are located on the west side of the site. In general, the east side of the site has poor access and is not well suited to many urban land uses. The proposed access from the south side of the site to the communication tower is not feasible due to conflicts with soap box derby improvements and elevations. However, the proposed tower location appears to be accessible from the northern area of the site. 5. Recommend approval of the request to establish a 166 foot tall communication tower at the City -owned Derby Park site based on existing public service structures in the form of power lines and support structures already located on the site and general compatibility with existing and proposed development characteristics of the immediate area. Also recommend that the conditional use approval be conditioned upon approval of a lease agreement between APT and the City of Sanford as well as agreement upon appropriate access to the tower location. AMERICAN PORTABLE TELECOM at 131th Street - Request conditional use permit to establish a communication tower in a GC -2, General Commercial Zone at 700 West 13th Street. Site includes several commercial /industrial structures, fencing and miscellaneous improvements fronting West 13th Street, Holly Avenue and the CSX Railroad. Said improvements appear to be in poor condition and general disrepair. Pursuant to the site plan submitted by the applicant, the proposed telecommunication tower is to be located on the easternmost portion of the site. The proposed communication tower would be 132 feet in height. 2. Several communication towers are located in the general vicinity of site including a monopole similar to that proposed by the applicant as well as a City Utilities Department guyed tower, a private business guyed tower, a telephone company lattice tower and a City Police Department guyed tower. 3. Various highway- oriented uses are located in the general vicinity of site. 4. Recommend approval of the request to establish a 132 foot tall communication tower at 700 West 13th Street based on similar public service structures in the form of communication towers already located in the immediate area as well as the existing character of the immediate area at the present time.
