The Chairman called the meeting to order at 7:00 P.M.
First on the Agenda was to hold a Public Hearing to consider a
request for a Conditional Use for property located at 1420 Elm
Avenue in a GC -2, General Commercial Zoning District, for the
purpose of trailer and equipment storage. Owner /representative:
Dennis Aa�gaard.
Jerry Harbin, 892 Silver Smith Circle, Lake Mary, was present for
representation and stated that at this time he would like to
withdraw the request for the Conditional Use on the advice of his
attorney.
Next on the Agenda was to hold a Public Hearing to consider a
request for a Conditional Use for property located at 402 French
Avenue in a GC -2, General Commercial Zoning District, for the
purpose of a parking area for U -Haul trucks, trailers and customer
vehicles /outdoor storage. Owner: Joe Waller; representative: Pat
C. Moore, Sanford Tire & Muffler Center.
Patrick Moore, owner of Sanford Tire & Muffler, 420 S . French Ave.,
with home address being 1716 Perch Lane, Sanford, was present for
representation. He stated that they have been parking on Gregory's
right-of-way and Sanford' s right-of-way for 20+ years. Mr. Moore
stated that Gregory had recently sold their property and now he is
out of room for doing maintenance and services on vehicles. He
stated that he does maintenance on U -Haul trailers and would like
to rent out U -Haul vehicles. He would like to have a nice and tidy
operation.
Mr. Valerino asked about the improvements that would have to be
made. Mr. Marder stated that the City requires paved parking
areas, paved storage areas, curbed islands, landscaping, etc.
Mr. Dyal asked why would Staff's recommendation for Item 1 be
dramatically different from the recommendations for this item. Mr.
Marder stated that this site will have 10' wide landscape buffers
on French Avenue because of the main highway with a tree every 25
Certain things are built in because of the location. Item one is
on a side street and had to be treated a little different. Mr.
Marder stated that there are several alternative standards that one
can provide in separating residential from commercial. For Item
One there would be pure storage, not connected with a use. This
item is part of a business, on a main street, different standards
are being applied here, fencing out front is not needed, etc.

Mr. Skat asked the applicant if he would be opposed to putting up
a fence to buffer the residential in the rear of this property.
Mr. Moore stated that there is an alley with oak trees along the
property. He is asking to park up front not in the rear. He
stated that there would be no more than 20 trailers, vehicles and
trucks parked at any one time, probably a little less. Mr. Moore
stated that he does not want to pave the parking area. There are
two driveways and all the curbs are in. There is a drainage
problem in the area.
Mr. Skat noted that there is not a configuration for parking. He
would like to see organized parking. Mr. Marder stated that Staff
would require that there be a site plan and that there be a
specific traffic circulation and parking pattern.
Mr. McClanahan moved on approval based on Staff's recommendations
with staff working with applicant to organize a parking pattern.
Seconded by Mr. Stogner. All in favor. Motion carried.
Item 3 on the Agenda was to hold a Public Hearing to consider a
request for a Conditional Use for property located at 210 -212
Sanford Avenue in a SC -3, Special Commercial Zoning District, for
the purpose of residential apartments in three of the 6
office /store suites. Owner /representative: Fred Cohen.
Fred Cohen, 5912 N. Dean Rd., Orlando, owner, was present for
representation. He stated that the Private Industry Council had
moved out of the building and that he has had a request from a lady
to have a craft store on the condition that she could have a small
apartment in the rear. Mr. Cohen stated that there are three
beauty shops renting the property now with one prospect for an
apartment.
Mr. McClanahan noted that the Planning and Zoning Commission has
never given approval for a business and a residence together. If
there is a second unit, one of the units have to be owner /occupied.
Mr. Stogner asked if the Commission could recommend that only the
tenants that run the business will be allowed to stay in the suites
if this is approved. Mr. Marder stated "yes ", reasonable
conditions can be placed on any conditional use. Mr. McClanahan
stated that this would be a law that would be impossible to enforce
and asked how this would be tracked. Mr. Skat asked if the
structure would be brought up to safety standards? Mr. Cohen
stated "Yes", everything will have to be brought up to code. Also,
there are windows in each one of the suites.
Carl Stairs, 208 S. Sanford Ave., was present and in opposition to
the request. He stated that he is'concerned with who rents the
units and what is going to be there. He stated that the previous
tenants had indicated that the structure would be used as a
recording studio but what the tenants were doing, on the weekends,
they would charge people $6 each to get in and have parties.
Alcohol was being served and other things. Mr. Stairs stated that
the tenants were open as late as 4:00 in the morning. He stated
that he had to call the Police and several times he was threatened.
He does not want this type of renter to end up here again.
Linda Kuhn, 308 Kimberly Ct., was in opposition. She stated that
she owns 305, 313 , 315 and 317 Palmetto Avenue and her concerns are
the same as Mr. Stairs. She stated that there are transient
problems in the area.
Charles Rowe, Community Development Director for the City of
Sanford, was present to comment on this request. He stated that
Code Enforcement is a division in his department. Owner/

occupational units would be very difficult to enforce. He stated
that currently his Department deals with approximately 400 code
cases each month with one inspector and one secretary to track
these cases.
Fred Cohen apologized to Mr. Stairs stating that he did not know
this type of thing was going on and assured the Commission that
this would not happen again.
Mr. McClanahan stated that if this request is approved, it will set
a precedent. The situation creates multiple busi.nes.ses with
residents. He stated that this is a request that needs to end up
at the City Commission level because this is setting a policy. A
policy change will be created.
Mr. Valerino moved to deny. Seconded by Mr. McClanahan. Mr.
Marder stated that if the Commission is inclined to deny this
application that it provide some reasons for it as far as what the
motion is based on. The City Commission looks to the Planning &
Zoning Commission for establishing this type land use policy. Mr.
Dyal stated that it is not going to be owner /occupied, commercial
and residential are being ble} ded together, and the owner of the
property does not live locall L Mr. Valerino stated that he had no

problems with the concept but that he could not see how this can be
enforced. It is an impossible situation to insure that the person
running the business is actually the person that is living there.
Mr. McClanahan stated that the Planning and Zoning Commission can
give directions or make recommendations to City Commission, but
this is an out and out land use policy change.' We have no guidance
and no indication from the City CommissIon that they want to go in
this direction or that they don't want to go in this direction.
Mr. McClanahan stated that the Planning and Zoning Commission is
asking the City Commission if they want this type of land use mix
in the downtown area, and if hey do, it gives us guidance in the
future to do a better job. Mr. Skat asked if a policy has been set
or some guidance as to downtow revitalization that is encouraging
mixed use property downtown. Mr. Marder stated that this is what
he had read into the Main Street materials. All in favor. Motion
carried.
Mrs. Stairs noted that the Commission does not agree with the
comparables that were used by Staff due to the fact that they are
all owner /occupied properties.
Next an the Agenda was to h ld a. Public Hearing to consider a
request for a Conditional Us for property located at 2604 S.
Orlando Drive in a GC -2, General Commercial Zoning District for the
purpose of an additional free standing sign. Owner: Harold A.
Hall; representative: Harold A. Hall, Wood 'N What Knots.
Wendell Stocksett, owner of Wood IN What Knots, 250 Art Lane,
Sanford, stated that the existing sign is 90' away from the south
end of the building. On the north end of the building, 44' away,
is a separate entrance. It is impossible to join with the far end
of the property for signage, which would put the sign 142' away
from his entrance. The bail bondsman would like to address his
business.
Mr. McClanahan agreed that another sign is needed on the north end
of the property and moved to approve. Mr. Skat seconded. All in
favor. Motion carried.
Mr. Skat moved to approve the Minutes as circulated. Mr. Dyal
seconded. All in favor. Motion carried.

SUBJECT: Recommendations for Meeting of July 11, 1996
AAGAARD - Request conditional use approval to permit outdoor storage for trailer
and equipment in a GC -2, General Commercial Zone located at 1420 Elm Avenue.
1. Site is Zoned GC -2, includes approximately 30,000 square feet and fronts
West 15th Street and Elm Avenue. Site is surrounded by chain link fence and
evidences equipment, trailer and materials storage.
2. Uses adjacent to the site include vacant land Zoned PD, antique sales,
equipment /truck repair and metal fabrication Zoned GC -2 and single family
dwellings Zoned SR-1A.
3. Recommend that outdoor storage be approved based on similar uses already
established in the immediate area with the following conditions:
a. A ten foot wide landscape strip in conformity with the City's landscape
and buffer requirements, i.e., trees and shrubs, shall be provided
adjacent to West 15th Street and Elm Avenue. In- ground irrigation shall
be provided.
b. In addition to the above- mentioned landscape, an opaque fence or wall
with a minimum height of six feet shall be provided adjacent to West
15th Street and Elm Avenue. Such fence or wall shall be set back a
minimum distance of ten feet from said streets. Chain link fence shall
not be visible from directly adjacent to West 15th Street and Elm
Avenue.
C. The above - mentioned improvements, i.e., landscape and fencing, shall
be maintained as long as the site is utilized for outdoor storage.
SANFORD TIRE AND MUFFLER CENTER - Request conditional use approval to permit
outdoor storage and display of rental trailers, custom vehicles and trucks for property
Zoned GC -2, General Commercial located at 420 South French Avenue.
1. Site is Zoned GC -2, General Commercial and includes approximately 19,300
square feet or less than one half acre. The majority of the site is vacant at the
present time although storage of used tires is visible.

2. The Sanford Tire and Muffler Center is immediately adjacent to the site and
includes an existing tire sales and automobile repair establishment oriented
towards Fifth Street.
3. Other uses adjacent to the site include vacant land, automobile repair
automobile sales, tank storage, appliance sales and a public park.
4. Based on a recent approval by the Planning and Zoning Commission, up to five
single family homes are planned on vacant property adjacent to the west
boundary of the site.
5. Recommend approval of the request for outdoor storage and display of
vehicles based on similar uses already established in the immediate area with
the condition that all requirements for landscape, buffer and improvements be
met.
COHEN - Request conditional use approval to permit up to three apartments to be
located on property Zoned SC -3, Special Commercial located at 210 -212 Sanford
Avenue.
1. Site is Zoned SC -3, Special Commercial and incudes an existing commercial
building with parking. Site fronts Sanford Avenue and Third Street.
2. Site is located in the Downtown Historic District and is therefore subject to
regulations thereto.
3. The Planning and Zoning Commission approved a conditional use to permit a
residential use in a commercial building (Duggar's Store) located at the
northwest corner of Sanford Avenue and Second Street. Another similar
approval for more than one apartment occurred on First Street and Magnolia
Square (Touchton's).
4. Recommend approval of the request to establish up to three residential
apartments based on the similarity of request with other approvals in the same
general area and the general policy to revitalize the downtown area through
encouraging mixed use development, i.e., additional residential use.
WOOWN WHAT KNOTS - Request conditional use permit to permit a second
detached sign in a GC -2, General Commercial Zone located at 2604 South Orlando
Drive.
Site is Zoned GC -2, General Commercial, includes various small buildings and
has frontage on U.S. Highway 17 & 92 (Orlando Drive) and Hiawatha Avenue.
There is presently one detached sign located on the south side of the site. The
site is approximately 25- 26,000 square feet or less than one acre.
2. The applicant has the ability per ordinance to request a second detached sign
based on the fact that the property has frontage on two roads.
3. One of the objectives of Schedule K, Sign Regulations, is to "encourage signs
serving commercial and industrial land uses to be attached rather than
detached or freestanding types of signs."
4. Uses adjacent to the site include offices, trailer rental, tire sales and other
commercial uses.
5. Recommend that the request to establish a second detached sign be denied
based on the above - stated objective of the Sign Regulations in conjunction
with the relatively small size of site, less than one acre, and the ability to
advertise two businesses on one detached sign.
