ADDENDUM TO THE AGENDA
1. Consider the Final Plat for Placid Woods, Phase One, an 88 lot residential subdivision

MEETING OF JUNE 20, 1996

The first item on the Agenda was to hold a Public Hearing to
consider a request for a Conditional Use for property located at
1420 Elm Avenue in an SR -lA, Single Family Dwelling Residential
Zoning District, for the purpose of trailer and equipment storage.
Owner /representative: Dennis Aagaard.
Dennis Aagaard, 2619 -B S. French Avenue, was present for
representation. He handed out pictures of the site. Mr. Aagaard
stated that he purchased this property as a storage yard and it is
in better condition than some of the neighbor's property. He
stated that there is no water nor power on the site and that it
would not be feasible to bring in utilities at this time. Mr.
Aagaard stated that there are no residences on this block. The
City's storage yard and diesel shop have the same exposure to
residences that are in the area. He stated that it is an unfair
burden to him to provide utilities to. his site without the
neighbors doing the same.
Mr. Dyal asked why this application was brought before the Planning
and Zoning Commission now. Mr. Marder stated that it came about
because of some type of code enforcement process and that it now
gives the City the opportunity for some upgrading.
Jerry Harbin, 892 Silver Smith Circle, Lake Mary, stated that the
property was purchased out of foreclosure. It has always been
outside storage. Mr. Marder stated that it gives the City the
opportunity to make modest improvements to the situation, and to
take the opportunity for others to do the same when something like
this comes up. Mr. Harbin stated that this arrived out of an
unsigned complaint because Lot 4 was trying to sell.
Mr. Aagaard stated that because of the complaint, they spent 4 to
6 days cleaning and that the property is in much better shape.
There are still some items that need to be pulled out. Their
intentions are to do routine maintenance from this P oint on.
Mr. Marder stated that this site consists of a corner lot and that
the chain link fence cannot be in the front yard building setback.
He recommends that the fence be pushed back 25', or that the
applicant chose the typical landscape buffer that could be 5' and
provide a landscape buffer. Outdoor storage tends to come and go
and change over time.

Mr. Harbin stated that there isn't anything in the yard that stays
on a permanent basis. Ms. Stairs asked the applicant what is he
willing to do to make site more appealing. Mr. Aagaard stated that
Lot 4 has its own amount of debris. He has done a lot of work in
cleaning up his site.
Bill Terwilliger, 209 W. 15th Street, was present and in opposition
to the request. He stated that he is concerned for the children
because of speeders in the area. He is also concerned with the
fence at the intersection regarding the site distance. The
property is not regularly mowed. Mr. Terwilliger stated that the
fence is like having a wall and it becomes a hazard.
Mr. McClanahan noted that a more active use could be at this
location because of the zoning. Outside storage requires a
conditional use on general commercial zoning. General commercial
is the highest zoning short of industrial.
Mr. Dyal noted that the four -way stop helps tremendously. The
City's side is more of a concern to him.
Leslie Lynn, 308 W. 15th Street, was in opposition to the request.
She stated that she is concerned that the site is an eyes,ore. There
is a lean -to shed and beams on the site. She stated that she had
a rat problem at her house and it was determined that some of the
rats were coming from this site. This is an old, solid
neighborhood and this site makes it unattractive.
Eugene Holcomb of 216 W. 16th Street was in opposition to the
request. He stated that this site defaces other property. He
does not want this as a storage area.
Mr. Skat moved on approval with Staff's recommendations. Seconded
by Mr. Valerino. Mr. Dyal stated that he does not see any reasons
for Staff's recommendations, but that he does believe the site
should be maintained. Mr. Dyal stated that he understands
residential concerns. He is not in favor of having the applicant
spend a dime other than for maintenance. Mr. Stogner stated that
he agrees with Mr. Dyal. This area has always been a storage area .
The motion carried by a 5 to 3 vote.
On the Addendum to the Agenda was the consideration of the Final
Plat for Placid Woods, Phase One, an 88 lot residential Subdivision
located at 300 Placid Lake Drive in a MR -1, Multiple Family
Dwelling Residential Zoning District. Owner: Orion Real Estate
and Development Co..; representative: Craig Rouhier.
Steve Dill, 744 Highland Ave., Orlando, was present for
representation. He stated that he was one of the two owners and
that this project is very similar to Chase Groves.
Mr. McClanahan moved for approval. Seconded by Mr. Valerino. All
in favor. Motion carried.
Mr. Dyal moved to approve the minutes as circulated. Seconded by
Mr. Skat. All in favor. Motion carried.
There being no further business, the meeting adjourned at 8:00 P . M.

TO: City of Sanford Planning and Zoning Commission
SUBJECT: Recommendations for Meeting of June 20, 1996
AAGAARD - Request conditional use approval to permit outdoor storage for trailer
and equipment in a GC -2, General Commercial Zone located at 1420 Elm Avenue.
1. Site is Zoned GC -2, includes approximately 30,000 square feet and fronts
West 15th Street and Elm Avenue. Site is surrounded by chain link fence and
evidences equipment, trailer and materials storage.
2. Uses adjacent to the site include vacant land Zoned PD, antique sales,
equipment /truck repair and metal fabrication Zoned GC -2 and single family
dwellings Zoned SR -1A.
3. Recommend that outdoor storage be approved based on similar uses already
established in the immediate area with the following conditions:
a. A ten foot wide landscape strip in conformity with the City's landscape
and buffer requirements, i.e., trees and shrubs, shall be provided
adjacent to West 15th Street and Elm Avenue. In- ground irrigation shall
be provided.
b. In addition to the above - mentioned landscape, an opaque fence or wall
with a minimum height of six feet shall be provided adjacent to West
15th Street and Elm Avenue. Such fence or wall shall be set back a
minimum distance of ten feet from said streets. Chain link fence shall
not be visible from directly adjacent to West 15th Street and Elm
Avenue.
C. The above - mentioned improvements, i.e., landscape and fencing, shall
be maintained as long as the site is utilized for outdoor storage.
