Mrs. Stairs called the meeting to order at 7:40 P . M. She announced
that Items 2, 3 and 5 were withdrawn from tonight's meeting.
Item 1 on the Agenda was to hold a Public Hearing to consider a
request for a Conditional Use for property located at 4210 Orlando
Drive ( southwest corner of Bush Blvd. and Highway 17-92) in a GC -2,
General Commercial Zoning District, to establish automobile dealer
sales (used car dealership). Owner: Bush Boulevard Partnership;
representative: Patrick R. Dinardo, Engineer, and Al Carpenter,
CPH.
Al Carpenter, Conklin, Porter & Holmes Engineers, 399 Lake Rd.,
Lake Mary, and Pat Dinardo, Straight Deals, Inc., Lake Mary, were
present for representation. Mr. Carpenter stated that there are 52
parking spaces on this one -acre site. The existing small building
on the site will be used as an office and the landscaping is in
compliance with City Codes. Mr. Carpenter stated that they are
asking for the use of this property as an automobile dealership at
this time. The site plan will come at a later date.
Mr. Stogner asked the hours of operation. Mr. Dinardo stated that
the hours would be from 9 to 9. There will be no body work and no
painting of vehicles. He stated that there would be routine
maintenance, i.e. oil changes and tune ups, but no body work. Mr.
Dinardo stated that the automobiles would be lower line models,
$7,000 or less. He explained that his auto business is presently
located at 17-92 and Hwy. 427. He would like to move the existing
business to this location.
There was no one else present to speak in favor of or in opposition
to this request.
Mr. McClanahan moved for approval based on Staff's recommendations.
Seconded by Mr. Stogner. Mr. Valerino stated that he will vote in
favor because the applicant is not adding a new car dealership,
just moving it. Mrs. Stairs asked that with the new building going
in next to this site, would the Commission be looking at a site
plan and if this site would have the same setbacks as the new
building. Mr. Marder stated that there is a 50' building setback
along this corridor. Mr. Carpenter stated that they would be in
compliance with the Development Codes. All in favor. Motion
carried.
Item 4 on the Agenda was to hold a Public Hearing to consider a
request for a Conditional Use for property located at 123 S. Lee

Avenue in a RMOI, Multiple Family Residential- Office - Institutional
Zoning district, for the purpose of a private school and fenced
playground. Owner: New Tribes Mission; representative: Ron
Hibert.
Scott Ross, New Tribes Mission, 1000 E. 1st St., was present. He
stated that he had been in contact with the County, which owns the
adjoining property, and that the County is in support of this use
and has offered the use of its lots to use as a playground. The
County also agrees that a fence should be installed. Mr. Ross
stated that they are proposing brick columns to dress it up.
Ron Hibert, New Tribes Mission, 1000 E. 1st Street, stated that the
existing parking on 1st Street is not being proposed for change.
Mr. Ross stated that the school will be for New Tribes Mission
students only. There will not be any additional traffic and it
will be fenced -in to the ten -plex.
There was no one else present to speak in favor of or in opposition
to this request.
Mr. Valerino moved to approve. Seconded by Mr. McClanahan. All in
favor. Motion carried.
Next on the Agenda was to hold a Public Hearing to consider a
request for a Conditional Use for property located on Maple Avenue
between 4th and 5th Streets in a GC -2, General Commercial Zoning
District, for the purpose of single family residences and side yard
setbacks. Owner: Central Florida Housing; representative:
William W. Austin.
William Austin, 115 Laurel Oak, Longwood, was present for
representation. He stated that Seminole County is active in
housing and in encouraging low and moderate income housing.
Seminole County elected to give Central Florida. Hands three parcels
of land which is a nonprofit group. The County gave Central
Florida Hands these three parcels with the express purpose of
developing low cost housing in conjunction with the County's SHIP
program. The deeds have been transferred to Central Florida Hands.
The application is to utilize five lots to build single family
houses. Central Florida Hands will make a grant available to
buyers in the amount of $8,000, the value of the lot. The
applicants will also be available for grants provided under the
County's SHIP program. The houses will be 3- bedrooms, 2- baths.
Mr. Austin stated that Medca is the contracted builder.
Mr. Skat noted, for disclosure purposes, that he and Mrs. Stairs
had discussed the property that the school sits on because it had
been brought before the Historic Preservation Board as a point of
discussion. Mr. Robert questioned whether the stormwater runoff
problem could be worked out with City. Mr. Austin stated that he
presumes the City requirement of the finished floor must be 12 or
18- inches above the crown of the road and assumes that this will
solve the problem. The builder will participate in what will make
it effective.
There was no one else present to speak in favor of or in opposition
to this request.
Mr. Robert moved to approve to establish 5 single family dwellings
per Staff's recommendations. Seconded by Mr. Valerino. All in
favor. Motion carried.
The next item was to hold a Public Hearing to consider a request
for a Dimensional Variance for property located at 1109 W. 9th
Street in a MR -2, Multiple Family Dwelling Residential Zoning
District, for the purpose of the reduction in front yard setback

requirements: 30' required, 25' proposed, a variance of 5'; and a
reduction in side yard setback requirements: 20' required, 10'

Molly Hudson.
Molly Hudson, 2809 Grove Drive, was present. She stated that her
company was awarded a grant by Seminole County to put up very low
income housing. She stated that they sought areas that needed to
be upgraded and purchased these parcels of land. In order to
build, they need these variances for compliance. Ms. Hudson stated
that they have already received part of the grant.
Mr. Valerino asked if it was their intention to restore residences
that are there or tear them dow. Ms. Hudson stated that there is
one old shack that will be torn down. Mr. Robert asked if some of
the units will be two story Iand some one story. Ms. Hudson stated
that they are all one story. There will be 2 -4 bedrooms, 1 -3
bedrooms and 1 -2 bedrooms. Mr. McClanahan asked if TDH and
Associates is a 501C3 core. or a for profit corp. Ms. Hudson
stated that it is a for profit corp. Mr. McClanahan asked if the
grant is SHIP money or CDBG money; and if the company will retain
ownership and these will be rental units. Ms. Hudson stated that
it is SHIP money and that this corporation will own the units after
15 years. They must rent for 15 years. She stated that expenses
are taken out of the monthly rental fees and that the money has to
be put back into low income housing.
There was no one else present to. speak in favor of or in opposition
to this request.
Mr. Brooks moved for approval based on Staff's recommendations. Mr.
Robert seconded. All in favor. Motion carried.
Next on the Agenda was to hold a Public Hearing to consider a
request or a Dimensional Variance for property located at 1211 W.
10th Street in a MR -2, Multiple Family Dwelling Residential Zoning
District, for the purpose of the reduction in side yard setback
requirements: 20' required, 10' proposed, a variance of 10 and
a reduction in rear yard setback requirements: 20' proposed, 10'
required, a variance of 10
Molly Hudson was present for representation. Ms. Hudson stated
that this is the same situation as the previous request.
There was no one else present to speak in favor of or in opposition
to this request.
Mr. Skat moved for approval. Seconded by Mr. Robert. All in
favor. Motion carried.
Mr. Garrett requested that Staff take a look at the three strands
of barbed wire at 135 Country Club, a single family home.
It was decided that the Commission would wait no longer than 1/2
hour to have a quorum; unless a Commissioner calls stating that
he /she is running late.
Mr. Valerino moved for approval of the April 18 Minutes.. Seconded
by Mr. Brooks. All in favor. Motion carried.
Mr. Skat noted that he was absent at the May 2nd meeting and Mr.
Stogner was present. Mr. Brooks moved to approve as noted.
Seconded by Mr. Skat. All in favor. Motion carried.

SUBJECT: Recommendations for Meeting of May 16, 1996
CONKLIN PORTER & HOLMES BUSH BOULEVARD PARTNERSHIP - Request
conditional use permit to establish a used car dealership in a GC -2, General
Commercial Zone located at the corner of U.S. Highway 17 & 92 and Bush
Boulevard.
1. Site is Zoned GC -2, General Commercial and is vacant at the present time.
Site is located at the corner of U.S. Highway 17 & 92 and Bush Boulevard.
2. Uses adjacent to the site include a group of two - family dwellings, a bail bond
office and various used automobile sales establishments. Vacant land located
on the opposite side of Bush Boulevard is planned for a large office building.
3. Recommend approval of the request to establish a used car dealership based
on the similarity of the proposal with land uses already established in the
immediate area.
CURRIE - Request to establish alcoholic beverage sales for on premise consumption
of beer and wine only in a GC -2, General Commercial Zone located at the northeast
corner of State Road 46 and Park Avenue.
1. No recommendation provided for requests involving alcoholic beverages.
MARYANSKI - Request to establish a bed and breakfast in an SR -1 A, Single Family
Residential Zone located at the southwest corner of South Magnolia Avenue and
West Nineteenth Street.
1. Site is Zoned SR-1A, Single Family Residential and includes a two -story
residence.
2. Uses adjacent to the site include various single family dwellings located in the
area Zoned SR-1A.
3. The site is adjacent to an MR -2, Multiple Family Residential Zone which
includes various two - family dwellings.

AUSTINXENTRAL FLORIDA HOUSING AND NEIGHBORHOOD DEVELOPMENT
SERVICES INC. - Request a conditional use permit to establish five (5) single family
dwellings for property Zoned GC -2, General Commercial located on the east side of
South Maple Avenue between South 4th and 5th Streets.
Site is Zoned GC -2, General Commercial and is basically vacant at the present
time.
2. Uses adjacent to the site include various single family dwellings, a vacant
building, automotive uses, commercial uses and industrial buildings.
3. The City has been involved in several neighborhood drainage concerns in the
immediate area of the site. The alley located on the east side of the site drains
to an inlet on 5th Street. During extreme storm events there is localized
flooding. The City's Plans Review Committee expressed concerns regarding
the impact of additional development in the immediate area.
4. Recommend approval of the request to establish five single family dwellings
based on similar uses already established in the immediate area provided that
site planning for the site shall, to the extent feasible, mitigate stormwater
impacts in a manner acceptable to the City; A site plan depicting proposed
dwelling units and measures to mitigate stormwater impacts shall require staff
approval.
HUDSON - Request a dimensional variance to establish four dwelling units in an MR-
2, Multiple Family Zone located at the southwest corner of West 9th Street and
Pecan Avenue.
1. Site is Zoned MR -2, Multiple Family Residential and includes two and a half
fifty -foot wide lots.
2. Various single family dwellings are located in the immediate area of the site.
Many of the existing structures in the immediate area appear to be
nonconforming in terms of front and side yard building setbacks. In particular,
a number of the buildings appear to be located less than twenty feet from the
street right of way.
In general, the condition of many of the existing residences in the immediate
area ranges from deteriorated to dilapidated.
3. The applicant requests dimensional variances to front yard setback of five feet
and side yard setback of ten feet.
4. Recommend approval of the dimensional variance request based on the

existing character of the immediate area and the nature of the existing
buildings in the immediate neighborhood.
HUDSON - Request a dimensional variance to establish three dwelling units in an MR-
2, Multiple Family Zone located at the southeast corner of West 10th Street and

1. Site is Zoned MR -2, Multiple Family Residential and includes two forty -five-
foot wide lots. A dilapidated dwelling appears to be located on the site.
2. Various single family dwellings are located in the immediate area of the site.
Many of the existing structures in the immediate area appear to be
nonconforming in terms of front and side yard building setbacks. In particular,
a number of the buildings appear to be located less than twenty feet from the
street right of way.
