MINUTES PLANNING AND ZONING COMMISSION MEETING OF NOVEMBER 2, 1995 7:00 P.M. CITY COMMISSION CHAMBER'S MEMBERS PRESENT: Lynn Stogner Helen Stairs Ben Dyal Michael Skat Ross Robert Mac McClanahan Jim Valerino MEMBERS ABSENT: Mark Platts - excused Leon Brooks OTHERS PRESENT: Jay Marder, Director of Planning and Development Russ Gibson, Land Development Coordinator Marion Anderson, Recording Secretary Mrs. Stairs called the meeting to order at 7:00 P.M. The first item on the Agenda was to hold a Public Hearing to consider a request for a Conditional Use for property located at 531 N. Palmetto Avenue in an SC -3, Special Commercial Zoning District, for the purpose of outdoor storage and display. owner: City of Sanford; representative: Chuck Volk, Lake Monroe Harbour, Inc. - Lessee. Brian Volk, 107 Borado Rd., was present for representation. He stated that they would like to install a 6' chain link fence, in front, for boat sales. The proposed fence will be approximately 126'. The fence would be installed for security and visibility purposes so that they would not have to pull the boats out front and then back inside everyday. This will not be for storage, but rather for boat sales. There will be no barbed wire. Mr. Volk stated the area that will be fenced is completely out of the flow of traffic. He agrees with Staff's recommendations and stated that there is some existing landscaping in front and that they would do something similar to that around the newly fenced area. Mr. McClanahan asked Mr. Volk if the property in question is in his lease and in his control at this time. Mr. Marder stated that he was not saying either way because there may be something in the lease about an area of influence. Its part of the public lot that is still basically City of Sanford's that does not have a formal lease on it, like the lot the building sits on. Mrs. Stairs stated that she didn't see how the Commission could recommend anything on something that is not owned or leased by the applicant. Mr. Marder stated that the City Manager has signed an affidavit authorizing the applicant to make this application. Mr. Stogner asked if Staff had any input from the groups that are concerned with the waterfront. Mr. Marder stated that those groups are somewhat involved in different aspects, i.e. master planning. He stated that he did not think that they are of the mode in wanting to review site plans. Mr. Marder stated that he did not think that this request would either conflict with or be in support of the waterfront master planning. Mr. Dyal stated that if the lease is not there, then a decision would be null and void. F F i °'INUTES PLANNING AND ZONING COMMISSION MEETING OF NOVEMBER 2, 1995 PAGE 2 Mr. Dyal asked how many boats would be displayed. Mr. Volk stated that there would be S to 14 boats. Mr. Dyal questioned the landscape buffer on the north side of the building. Mr. Marder stated that this would be at the proposed display storage area, not at the building. Mr. Robert asked. Mr. Volk is he had considered a wood fence. Mr. Volk stated that because this will be for boat sales, they would need the visibility. Mr. Skat questioned the site, itself. He stated that a triangle shaped fence would look off and that a square would be better. Mr. Volk stated that the reason for the angle is because of the larger boats. The sharpness of the turn would be too tight. Mr. Valerino asked if the area is being used for storage or outdoor display and wanted to know what is there now. Mr. Volk stated that there may be a rack out there now. Mr. Stogner asked Mr. Marder if he was recommending denial or if he was recommending either A or B of Staff's recommendations. Mr. Marder stated that he was giving the Commission information to base its decision whichever way is sufficient. Mr. McClanahan stated that it Item A of staff's recommendation is recommended, and no changes are made, the fence is immediately killed because chain link fences shall be prohibited. Mr. Gibson offered as a point of information, a brochure on alternative commercial applications of fencing, a fencing material used by McDonalds and Walgreens around retention areas. Mr. Volk looked over the fencing material and stated that it looked good. He stated that one point would be to see if there is a large enough gate with this material. Mr. McClanahan moved for approval with Item A of Staff's recommendations and to allow the chain link fence. Seconded by Mr. Dyal. In opposition were Mr. Stogner, Mr. Valerino, and Mr. Skat. Mr. Valerino stated that he was opposed because of the chain. link fence. All others in favor. Motion carried. Mrs. Stairs requested that Staff hand out the fencing material offered by Mr. Gibson when someone comes in for application to erect a fence. She requested that Staff get an idea of the cost. Mr. Skat stated that he was concerned with the angular part of the fence. The next item on the Agenda was the consideration of the site plan for Alpha Flight Services, a catering kitchen for the Orlando Sanford Airport located at 1776 Hangar Road in a RI -1, Restricted Industrial Zoning District. Owner: City of Sanford - Sanford Airport Authority/ Central Florida Terminals - Lessee; representative: Thomas R. Colon, AVC Ltd. - Architect. Thomas Conlon, with AVC, Ltd., Coral Springs, stated that the colors will be the same as the terminal building and the roof will be flat pitched toward the middle. Mr. Dyal asked if there is an existing building on this site. Mr. Gibson stated that there is a building adjacent to this site. Mr. Conlon stated that this will eminently be a four phased project. The present time warrants Phase 1 and Phase 2. Each phase will consist of a 90' wide, 100' deep building. Mr. Robert questioned the turning radius. for semi - trucks. Mr. Conlon stated that Hangar Road runs through the site itself. He believes that Hangar Road will eventually be done away with. Mr. Conlon stated that the existing slab consists of 12" of concrete with 12" of limerock. Mr. Dyal questioned the parking facilities.. Mr. Gibson stated that they have not provided for any on -site parking. There are some locations on -site that could accommodate parking. Furthermore, some employees will park at the terminal building and commute. Mr. MINUTES PLANNING AND ZONING COMMISSION MEETING OF NOVEMBER 2, 1995 PAGE 3 Dyal asked what a knox box is. Mr. Gibson stated that it is a box that holds a master key that permits the Fire Department to access the building without destroying the door. Mr. Dyal asked why didn't the Airport Authority comment on this request. Mr. Marder stated that we have to assume that they know what is happening. Mr. Conlon added that all office and clerical help and bookkeeping would be done out of the Orlando facility. Mr. Robert asked if the Airport Authority would allow parking on the grass because of the four parking space shortfall. Mr. Conlon stated that this was not considered. He stated that the company needs to be up and running by March 15, 1996 in order to fulfill the commitments that they have so far. Mr. Skat moved to approve with Staff's recommendations. Seconded by Mr. Dyal. All in favor. Motion carried. Mrs. Stairs stated that she has asked the City Attorney to comment on an item scheduled for the November 16th agenda because of the position that the Historic Trust has taken. There are 5 members on this Commission that are also members of the Trust. Mr. Marder stated that from a Staff standpoint, we have had a multitude of inquiries involving the November 16th agenda items. Also, on the agenda will be the redevelopment plan for the downtown waterfront area. This is on a fast track because we have to establish the CRA and go through all ordinances and resolutions by December 31. Mrs. Stairs stated that she had asked Mr. Gibson to provide an 8 1/2x11 sheet of the findings of facts. She asked that this be provided prior to the next meeting. Mr. McClanahan noted that the Minutes, Page 2, next to the last and the last paragraph, should reflect Mr. Robert instead of Mr. Ross and Elmer Rusher is spelled Reuscher. The Minutes were unanimously approved with the noted changes. There being no further business, the meeting adjourned. Helen Stair, , Chairperson From the Director of Planning and Development October 25, 1995 TO: City of Sanford Planning and Zoning Commission SUBJECT: Recommendations for Meeting of November 2, 1995 CHARLES J. VOLK/LAKE MONROE HAROUR, INC. - Request conditional use permit for outdoor storage and display of boats and related equipment in an SC -3, Special Commercial Zone located at 531 North Palmetto Avenue. 1. In general, the site is Zoned SC -3, Special Commercial and includes a commercial boating facility with storage, sales and service. A principal building encompasses a majority of the site which is a portion of man -made land generally known as the Sanford Marina Isle. An enclosed area on the west side of the principal building encloses various boats and equipment for sale. Outdoor storage and /or display is already established on the site's north and east sides. 2. The site is adjacent to public boat ramps, an office building, various boat trailer and automobile parking areas, a hotel, a restaurant and a boat touring business, all located on the Sanford Marina Isle. 3. The area proposed to be utilized for outdoor storage and display is located on the west side of the principal building of Lake Monroe Harbour, Inc. The property is City -owned land between public boat ramps and the building. The area appears to encompass approximately 3,000. 4. Question is one of policy regarding whether to permit outdoor storage and display to be located on the west side of the building, facing public use areas. 5. The following alternative recommendations are provided for consideration by the Planning and Zoning Commission, depending upon the consensus of the Commission: A. Approve the requested outdoor storage and display of boats and related equipment based on the existence of similar activities on the east and north side of the site and with the following stipulations and conditions: 1. Chain link, barbed wire fence and /or similar materials shall be prohibited. All materials shall be approved by the Planning and Planning Recommendations - Page 1 Zoning Commission. 2. A five foot wide landscaped buffer shall be provided around the northerly and westerly boundaries of the proposed display /storage area in a manner approved by the Planning and Zoning Commission. 3. A minimum ten foot wide walkway adjacent to the boat ramp shall be maintained for public access. B. Deny the request to establish outdoor storage and display of boats and related equipment at the Lake Monroe Harbour, Inc. facility. Outdoor display and storage does not already exist on the west side of the facility. Such permanent outdoor storage and display should be discouraged in the downtown and waterfront area. Such outdoor storage and display would detract from the aesthetic appearance of the main public access area to the boat ramp facilities and the Isle in general. In addition, the area in question should be maintained for public access in order to insure maneuverability both at present and in the future. Planning Recommendations - Page 2
