MINUTES PLANNING AND ZONING COMMISSION MEETING OF FEBRUARY 2, 1995 CITY COMMISSION CHAMBERS 7-WOO P .M. MEMBERS PRESENT: Lynn Stogner Ross Hobert Joe Dennison Mike Davis Ben Dyal James Valerino Helen Stairs Lean Brooks MEMBERS ABSENT: Cynthia Holt - Miller OTHERS PRESENT: jay Marder, Director of Planning and Development Bettie'Sonnenberg, Land Development Coordinator Russ Gibson, Land Development Coordinator Marion Anderson, Recording Secretary The chairman called the meeting to order at 7:00 P.M. The first item on the Agenda was to hold a Public Hearing to consider a request for a Conditional Use for property located at 2220 French Avenue in a C -2, General Commercial Zoning District for the purpose of automotive dealer sales. Owner: Bob M. Ball, Sr.; representative: Edward C. Link. Edward Links, 665 Harold Ave., Ste. F, Winter Park, stated that he is trying to relocate his business to Sanford. He now has a car lot in winter Par}. He stated that he would like outside display on the left side of the building and would like to mulch this area. Mr. Links stated that he will be renting one of the offices at this location and the lot is included in the rental agreement. Mr. Links stated that this is a good location for a car lot. There are two buildings with a parking lot in between. There is plenty of room for customer parking. He stated that there will be no repair work done on the premises, strictly selling. Mr. Valerino asked Mr. Marder why Staff was recommending denial of the request. Mr. Marder stated that there is a car lot between 18th and 19th Streets and felt that it would cause an unbalance at this section of French Avenue. He stated that there aren't any used car sales within an area of 5 or G blocks. He would like to keep it this way since there are areas on the north and south end of 17 -92 that are more suitable for used car sales. Mr. Marder stated that there are other car lots between 5th and 9th Streets with the rest of the car lots to the south from 27th Street or so. Mr. Dyal asked Mr. harder if he had any other concerns rather than the close proximity or would customers have problems exiting or entrancing this property. Mr. Marder stated that he had no other concerns and that customers would have no more problems than at any other car lot. Mr. Robert asked if there was something in the way of improvements that would change Staff's position to recommending approval. Considering 17 -92 as a whole, there are many used auto sales establishments. with the addition of this used car lot, 17-92 will have an unbalanced feature because there are not many used car displays in this immediate area. There are other areas that could be used for used automotive sales. Mr. Marder stated that if the proposed car lot was in close proximity to another ear lot, Staff would recommend approval. Mr. Robert moved for approval. Seconded by Mr. valerino . Mr. Dyal asked how many autos would be on the lot at any one time . Mr. Links stated that he anticipates 15 or ZD cars. He stated that there is plenty of roam for 2S cars or mare. Mr. Dyal asked Mr. Links if he anticipated a need for fencing. Mr. Links stated that he had given some thought to fencing and stated that possibly in the future he would like to fence. He stated that he plans on upgrading the building as far as painting and landscaping are concerned. Opposed to the motion was Mr. Brooks. All others in favor. Motion carried. The next item on the Agenda was to hold a Public Hearing to consider a request for a Conditional Use for property located at 819 West 1st Street in a GC -2, General Commercial Zoning District for the purpose of a two - family dwelling. Owner: Thomas and Blanche Wearer; representative: Blanche Weaver. Blanche Weaver, 1401 Dixie Way, stated that when they purchased the property, she was with the understanding that it could be used as a two family dwelling. She stated that the house was set up for two families. Mr. Stogner asked if any renovations would be performed on the house. Mr. Weaver stated that the tenant is moving and after he Moves, she will have it cleaned but that no other renovations are planned. Mr. Robert asked if the house would have any license other than with the city. Mrs. Weaver stated "no". Mr. Brooks moved for approval with Staffrs recommendations that required off - street parking spaces be clearly identified and provided. Seconded by Mr. Robert. All in favor. Motion carried. The next item on the Agenda was to consider a request for a Conditional Use for property located at 200 S. Myrtle Avenue in a SC-3. Special Commercial Zoning District for the purpose of automotive dealer sales. owner /representative: Joseph L. Abrams. Joe Abrams, Box 2 D 14 , Apopka, explained that the Division of Motor vehicles requires a sales lot with a space for one car if a person is going to auction cars. He stated that he is requesting the Conditional Use so that his tenant /auctioneer could legally sell a car at an auction. Mr. Robert stated that Staff is recommending opaque fencing. Mr. Abrams stated that this would not be a problem. Mr. Robert stated that there is a building immediately to the south and asked if it sets on Mr. Abrams' property. Mr_ Abrams stated that although it is very close, it is not on his property. Mr. Robert asked if the car storage would be immediately adjacent to the shed factory. Mr. Abrams stated that it would be next to the office. The auctioneer is on one side and the shed is on the other. The car storage will be rear the auctioneer's side. Mr. Robert moved for approval per Staff ' s recommendations that only one for sale automobile may be located on the premises at a time and that the entire open area,, i.e the southerly half of the site, be surrounded by an opaque fence similar t the wooden fence already located on the site or a similar material. Seconded by Mr. Brooks. All in favor. Motion carried. MINUTES PLANNING AND ZONING COMMISSION MEETING OF FEBRUARY 2, 1995 PAGE 3 Tha next item on the Agenda was to consider the Site Plan for the International Departures Building, an airport passenger facility located at the Central F lorida Regional Airport, in a RI -1, Restricted Industrial Zoning District. Owner: City of Sanford /Sanford Airport Authority; Central Florida Terminals, Inc., Lessee; representative: Nelson B. Blankenship, Jr. Steve Cooke, Director of Aviation, stated that a construction project has been on -going for the last year at the Airport for the departure and arrival terminal. He stated that completion is scheduled for April 15 with a grand opening in May. He stated that Central Florida Terminals, Int.'s proposal is to build a European style departure terminal for the leisure traveler. Basically, this facility will be for someone who arrives at the terminal four or five hours before their flight. Mr. Cooke stated that this will be the first facility seen when arriving at the Airport. Passengers will enter on the first level. There will be a security screening area before entering the second level. The second level will contain shops placed in a very comfortable environment while waiting for flights. Mr. Blankenship stated that the outside of the building will be the same as the existing building. Mr. Stairs moved to approve based on Staff's recommendations that the traffic data and a parking plan for rental cars, taxis and buses be submitted. Seconded by Mr. Dyal. All in favor. Motion carried. The next item on the Agenda was to consider the site plan for Seminole Paint and Body, a commercial use located at 2540 S. Myrtle Avenue in a GC - 2 1 general Commercial Zoning District. Owner /representative: Al VanNimwehen. Al VanNimwehen, 2540 S. Myrtle, stated that he is the owner of the property. Mr. Dyal asked Mr. VanNimwehen if he had any problems regarding the easement. Mr. VanNimwehen stated "no", but asked why a stop sign is required. Mrs. Sonnenberg stated that the Engineering Department has requested the sign for customers coming out onto Myrtle Avenue. Mr. Davis asked where was the 14' easement. Mrs. Sonnenberg stated that it is an active easement. Mr. Davis suggested moving the building further back so as not to have any problems. Mr. VanNimwehen agreed. Mrs. Stairs moved to approve per Staf f' s recommendations. Seconded by Mr. Robert. Mr. Brooks asked Mr. VanNimwehen if he was comfortable with the 20 setback of the building. Mr. VcanNimwehen stated that as long as he can get the building off the easement there should not be a problem. He stated that he would see where the easement is. Mrs. Stairs restated her motion for approval based on staff's recommendations that paint booths be protected with fire suppression systems; that a retention detail be submitted prior to issuance of a building permit; that stop signs at all three exits be provided; and to move the proposed structure from easement with the location to be approved by the Utility Director. Seconded by Mr. Robert. All in favor. Motion carried. The next item on the Agenda was the consideration of the request to allow chain link fencing within the required front yard setback for a single - family residence at 212 Bradshaw Drive in a SR -1, Single Family Residential Zoning District: owner /representative: Deonarine Rambissoon. MINUTES PLANNING AND ZON=IN GOMMI SS ION MEETING OF FEBRUARY 2, 1995 PAGE 4 Deonarine Rarnbi s o on, 212 Bradshaw Drive, stated that he needs the fence for the protection of his family. Mr. Dyal asked Mr. R¢mb issoon if, by adding a fence to the front of his home, he would feel more secure. Mr. Rambissoon stated that people have broken into his home from the front and in the back. He has been broken into four times. Mr. Robert asked Mr. Rambissoon if someone had explained to hire that he could put up a wooden fence without permission. Mr Rambissoon stated "Yes but that he wanted to put up a 5' chain link fence. Mr. Ra mbissoon stated that the house at the end of the street has a chain link fence. Mr. Rambissoon stated that.he has lived at this address for 2 and 1/2 years. He wor during the night and his wife and kids are alone. Mr. Davis stated that there are a lot of fences in the neighborhood. Mr Robert asked what wou ld be the perimeters if M r . Rambissoon keeps within the buffer. Mr harder stated that there is a 25' building setback. The house is 30 from the property line. The applicant would have a fence 5' from the front wall. Mr. Dyal asked if the fence around the property now is sufficient and what would the fence do for the front. Mr. Rambissoon stated that burglars can now came in the front windows. Mr_ valerino moved to deny. Seconded by Mr. Dyal. Mr. Robert asked Mr. Valerino if he would be happy with a wooden fence. Mr. valerino stated " ". and that he did not see any chain link fences around the surrounding homes. Mr. Davis stated that if the total subdivision is taken in�.o consideration, a pproximately 30 to 50% of the homes have chain link fences in the front yards. Mr Stagner stated that every time a request for a chain link fence is considered, it is because of break -ins. Mr. Dyal stated that he did not know if a fence would make it safe or not, but the owner that has a sense that he feels more secure. In favor of the motion was Mrs. Stairs, Mr. valerino, Mr. Stogner, Mr. Robert and Mr. Dennison. Opposed were Mr. Davis, Mr. Brooks and Mr. Dyal. mot ion carried. The next item on the Agenda was the consideration to allow chain link fencing within the required front yard setback for a single family residence at 2509 elm Avenue in, a SR -1, Single Family Residential Zoning District. Owner /representative: Connie Buck. Connie Buck, 2609 Elm Avenue, stated that she has the fence partially erected. She stated that her neighbor has a fence in the front yard. She stated that she did not know she needed permission to erect a fence. Elm Avenue i a very busy street with a bar at the back of her home. The driveway is not fenced. The fence is even with the neighbor's fence. She stated that the fence will not go across the driveway. Ms. Buck stated that she is requesting to put up a 4 and 1/ 2 -1 fence . Mr Dyal moved for approval based on the fact that the neighbor has a fence and it is an adjacent property. Seconded by Mr. Davis. Mr. Robert, Mr. Dyal, Mr. Davis, and Mr. Dennison in favor of the motion_ Mr. Stogner, Mr. valerino, Mr. Brooks, and M rs . Stairs opposed to the motion. Motion failed. The next item on the Agenda was the consideration of the request to allow chain link fencing within the required front yard setback for a single family residence at 901 west 24th Street in a SR -1, Single Family Residential Zoning District. Owner /representative: Annette Peralta . MINUTES PLANNING AND ZONING COMMI SSION MEETING of FEBRUARY 2, 1995 PAGE 5 Anne�te Peralta, 901 W. 24th Street, stated that the fence is ai re dy In place and that she did not know she needed permission to inst 11 it. She stated that half of the fence has been up for 20 year , from one corner of house and to the back. She recently lost her ausband and would feel more secure with the fence around the front of the house. She stated that her neighbor has a 6 fence all around his house and that it has been there for 2 years. Mr. rooks moved to deny. Seconded by Mrs. Stairs. In favor of the otion was Mr. Stogner, Mr. Valerino, Mr. Brooks, Mrs Stairs, and . Dennison. In opposition was Mr. Robert, Mr. Dyal and Mr. Dav Motion carried. Mr. brooks moved to approve the Minutes as circulated. Seconded by ms's. Stairs. All in favor. Lotion carried. Regarding fencing, Mr. Dya. stated that his concern is that people has a right to security. If someone else has a fence next door, he has a problem with telling someone "no, they cannot have a fence ". Mr Stogner requested that Staff do a little homework so that when people come before the Commissi the Commission can tell them the last number of fences that have been denied. Mr. Mar der agreed that there is a problem. He stated that when the policy was established, a doorway for discretion was created. There are so many places where the door has been wide open for so long. A workshop for the discussion of fencing was scheduled for February 16th at 6:00 P.M. I f rf jrj IT ol Z f January 27, 1995 of Planning and Development TO: City of Sanford Planning and Zoning Commission SUBJECT: Recommendations for Meeting of February 2, 1995 LINKS AUTO SALES - Request conditional use approval to establish used automobile sales for property Zoned GC -2, General Commercial located at 2220 French Avenue (U.S. Highway 17 & 92). 1. Site is Zoned GC -2, General Commercial and includes various existing buildings, paved and unpaved areas. Three paved "pads" are located in an area that appears to be proposed to be an automobile display area. The site sketch submitted by the applicant is of insufficient clarity to identify existing and proposed improvements on the site. 2. Various automobile- oriented uses located in the immediate vicinity of site include several automobile repair, tire and service facilities. The closest automobile sales establishments are located between 18th and 19th Street and south of 25th Street. The question is one of policy regarding whether to introduce automobile sales uses in the immediate area of French Avenue. 3. In 1987, prior to the present Land Development Regulations, the Planning and Zoning Commission approved a site plan to permit sales of boats. A conditional use approval would be required for such a use within the context of present regulations. 4. The Future Land Use Element of the Comprehensive Plan includes policies to discourage the proliferation of strip commercial, especially highway commercial uses involving display and sales of automobiles and trucks. The Plan recognizes French Avenue as an existing strip commercial corridor. 5. Recommend denial of the request to establish used automobile sales in the proposed location based on the lack of such specific uses established in the immediate segment of French Avenue and the policy to discourage display and sales of automobiles and trucks in those areas where such uses have not already been established. ABRAMS - Request conditional use approval to establish used automobile sales for property Zoned SC -3, Special Commercial located at 200 South Myrtle Avenue. Planning Recommendations - Page 1 1. Site is Zoned SC -3, Special Commercial and includez, an existing building utilized for auctions. Fabrication of sheds is being conducted on the south side of site in an outdoor area that is enclosed by a segment of opaque wooden fence and cyclone fence. The use does not comply with present screening requirements for outdoor storage and display. 2. Based on verbal information and the sketch plan submitted by the applicant, the proposal for automobile sales will be limited to one automobile. The site will not be utilized for typical walk -in retail sales typical of a used car lot. 3. Various businesses located in the general vicinity of site include automobile service, laundry, motorcycle sales and repair, a church and several single family residences. 4. Recommend approval of the conditional use request to establish used automobile sales with the stipulation that only one for -sale automobile may be located on the premises at a time and that the entire open area, i.e., the southerly half of the site, be surrounded by an opaque fence similar to the wooden fence already located on the site or a similar material. WEAVER - Request conditional use approval to establish a two - family dwelling for property Zoned GC -2, General Commercial located at 819 West 1st Street. 1. Site is Zoned GC -2, General Commercial and includes an existing residence. 2. Several buildings located adjacent to site along 1 st Street have been converted from residences into other uses including but not limited to offices, repair and service establishments and multiple family dwellings. 3. Recommend approval of the conditional use request to establish a two - family dwelling in a GC -2 Zoned based on similar changes already evidenced for properties in the immediate area with the stipulation that _required off - street parking spaces shall be clearly identified and provided.
