Cynthia Holt - biller James Valerino Helen Stairs Leon Brooks MEMBERS ASSERT: Joe Dennison OTHERS PRESENT: Bettie Sonnenberg, Land Development Coordinator Marion Anderson, Recording Secretary In the absence of Chairman Dennison, Mrs. Stairs called the meeting to order at 7:44 P.M. The first item on the Agenda was to hold a Public Hearing to consider a request for a Dimensional Variance for property located at 2397 S. French Avenue in a GC -2, Genera. Commercial Zoning District, to reduce the number of required parking spaces from 23 to 15, variance required - 8 spaces; reduce the required dimensional size of parking spaces from 10 to 9 variance required - 1'; reduce the minimum depth of the required landscape buffer of 10 ( French Avenue) and 511 ( 24th Street) to 0' and 4' , variance required - 10 (French Avenue) and 5 (24th Street). Owner: Farm Fresh, Inc. /Cash America International; representative: Bob Thomas, Embree Construction, Bob Thomas, 845 Airport Rd., Georgetown, Tx. was present for representation. He stated that they are proposing to add 1400 square feet to the existing building for storage. Mrs. Stairs requested- that the Agenda be corrected to show 5' on 24th Street for the landscaping buffer. Mr. Stogner stated that there are 14 parking spaces and one handicap parking space shown. He noted that there are two parking spaces with equipment displayed in them. He asked if the request is asking for the reduction of 8 parking spaces. Mr. Thomas stated that 23 parking spaces are required with the addition to the existing building: He stated that the request is for a variance of 8 spaces because the addition would be for storage only. Mr. Thomas stated that they would be removing parking spaces from under the canopy and relocating them. There are 14 parking spaces with one handicap space on -site now and this is what will remain. Mrs. Sonnenberg passed out a survey of the property. Mr. Dyal asked the applicant if he had had a chance to review staff's recommendations. Mr. Thomas stated "yes ", and that he would be resubmitting the site plan with corrections. Mrs. Sonnenberg pointed out that Mr. Thomas was talking about Staff's recommendations of the site plan, and not the variance. Mr. Dyal asked if the 9 parking space size was what the Commission had approved previously. Mrs. Sonnenberg stated "yes ", that the Commission had gone to a 9' width previously. Mr. Valerino asked how many employees does Cash America have. Jeff Bishop, area manager, 636 Dolphin Rd., Winter Springs, stated that they currently have a staff of 8 people. He stated that the maximum number of employees working at one time is 5 people. Some are part -time and some full -time. When the building. is enlarged it will require more i parking spaces. Mr. Dyal asked f the spaces that are there now, would present a problem with a full car lot. Mr. Bishop stated that sometimes there is a problem. Mr. Dyal asked if this business is in compliance today with the number of parking spaces. Mrs. Sonnenberg stated that it was in compliance when it was built but that she had not calculated the parking spaces for today's regulations. Mrs. Stairs asked if the addition to the building would have an impact on the parking. Mr. Bishop stated that he does not anticipate any more impact. Mr. Davis asked if on the proposed plan, does it show 9 parking spaces. Mr. Thomas stated "Yes". Ms. Holt - Miller stated that she had noticed that some parking_ spaces are being used for display and that most of the time the parking lot is congested. Mr. Bishop explained that they use one parking space for display and that this is normal procedure. Mr. Davis asked if the loading area is counted as a parking space. Mr. Bishop stated "no ". Mrs. Sonnenberg stated that the loading area is a walkway and that it is not the size of a parking space, that it is smaller. Mr. Stogner stated that he had noticed two parking spaces taken up with merchandise. Mr. Bishop stated that it is the company's intention to use the loading area for display. If this is a problem, they can certainly make some changes. Mr. Robert pointed out that in the letter from the attorney, that there is a possible solution. Mr. Bishop stated that he likes the idea and would look into using the property to the south for possible employee parking. Mr. Dyal asked Staff if the signage was confo ing to City standards. Mrs. Sonnenberg stated that there were no problems with the signage. Mr. Bishop stated that he had no problems with Staff's recommendations. In opposition to the request was Mr. Ken Leffler, 2303 -11 S. French Avenue. He stated that he wants to see Sanford prosper because he is a part of the community, but at the same token, he does not want the expansion of Cash America to hurt his business. The area is congested. Mr. Leffler stated that if Cash America would, move the employee parking, there may be enough room for their customers. The other problem is that some spaces have merchandise in them. He would like to see something worked out so that it would be fair to Cash America as well as being fair to him. Mrs. stairs asked Mr. Bishop if it is possible to gain two employee parking spaces if the Commission recommended no display of merchandise in the parking spaces and if this would be acceptable. Mr. Bishop stated "yes ". Mr. Leffler stated that if this was done there would be more people willing to park in the designated parking spaces, and repair of the fence would help. He stated that may be cash America could consider off-street parking. Mr. Robert asked if it would be ruled out for Cash America to approach him for off - street parking on his property. Mr. Leffler stated 'yes ". Mr. Davis moved to deny. seconded for purposes of discussion by Mr. Dyal. Mr. Davis stated that this would be a 30% reduction in parking spaces for this business. He stated that cash America needed * to submit a plan or a solution to rectify the parking situation. Ms. Holt - Miller concurred and stated that they needed an idea for employee parking. All in favor. Motion carried. The next item for consideration was to hold a Public Hearing to consider a request for a Dimension Var ' ance for property located as the northwest corner of 3rd Street a d Myrtle Avenue in an Sc -3, Special Commercial Zoning District, fdr a reduction in the width of parking spaces from 10 to 9 variance required - 1 Owners /representatives: Charles.& Deborah North. MINUTES PLANNING AND ZONING COMMISSION MEETING of SEPTEMBER 15, 1994 PAGE 3 Charles North, 662 Marlin Rd., Winter Springs, stated that this is a vacant lot covered with concrete, and that he wants to put up a storage warehouse. Mr. Stogner asked if his plans identified 9 parking spaces. Mr. North stated "yes ". He stated that he will occupy the bay on the east side. Mr. Davis pointed out that the finished f loor elevation is not 16 with the centerline of the road, that it will be about 8" higher than the road. Mr. North stated that the entire property is impervious, that it is covered with concrete and that the drainage will not change. Mr. Dyal moved for approval based on similar approvals in the past. Seconded by Ms. Holt- Miller. All in favor. Motion carried. The next item for consideration was to hold a public Hearing to consider a request for a Conditional Use for property located at 121 E. First Street in an SC-3, Special Commercial Zoning District, for the purpose of establishing a multiple family dwelling use. Owner: Glenn M. McCall; representative; Helen Stairs. Helen Stairs, 1301 Seminole Bl., was present representing the owner. She stated that they would like to have 3 executive apartments over commercial. Mr. Dyal asked what is an executive apartment. Mrs. Stairs stated that it will not be conducive to family living. one apartment will be two bedroom, owner occupied, one - one bedroom apartment and a studio. She stated that she will be managing the apartments. Mr. Stogner asked Mrs. Stairs if she had met with the Historic Board. Mrs. Stairs stated "yes", and that she had to get permission to put in another stairwell. She stated that. they had to put in the original stairwell. She stated that the Historic Board is more concerned with the outside and that this request entails changes to inside only. She stated that the building is, structurally sound and would consist of extensive interior renovations. Mr. Dyal asked Staff if the historic group had made any comments. Mrs. Sonnenberg stated "no ", that she had not received any comments from the Historic Preservation Board. Chris Cranias, 8219 Via Bella, Sanford, stated that this is something that is in the Duany Plan. People can shop and live in the same area. He stated that the waterfront plans have the same idea. Mr. Cranias stated that Mainstreet encourages this. Mr. Stogner moved to approve based on Staff's recommendations. Seconded by Ms. Holt - Miller and Mr.-Robert. All in favor. Motion carried. The next item for consideration was to hold a Public Hearing to consider a request for a Dimensional Variance for property located at 121 E. First Street in an SC -3, Special Commercial Zoning District, for waiver of off - street parking requirements for multiple family dwellings, variance required - 2 per dwelling. Owner: Glean M. McCall; representative: Helen Stairs. Mrs. Stairs stated, that this request is necessary because there is no designat d parking in the area which is conducive with Downtown. There are some areas that are n • at busy after 5. and in all probability., the tenants would not be using parking during the day. Mr. Dyal as�ed how many buildings downtown are similar to this request. Mrs. Stairs stated that this would probably be the second one. Mrs. Stairs stated that the tenants would be made to be sensitive regarding parking. Mr. Robert loved to approve. Seconded by Mr. Brooks. All in favor. Motion carried. The; next it�m was to hold a Public Hearing to consider a request for a Conditional Use for property located at 108 Magnolia Avenue in an SC - �, Special Commercial Zoning District, for the estiablishment of a multiple family dwelling use. owner: Glenn M. This is a smaller building and will have 2 one - bedroom executive apartments with one or two tenants. Mr. Dyal asked if the owner would be on -site. Mrs. Stairs stated that these buildings connect and that she would be managing both. Mr. Stogner asked if there were any comments from the Historic Preservation Board. Mrs. Stairs stated that the Historic Preservation Board has given them its blessings. She stated that she had to go before the Board to get the change for a door. Everyone is excited of what is being proposed. Mrs. Sonnenberg stated that she has had no direct communication from the Historic Preservation Board. This is an interior change of use, not exterior. Mr. Robert moved to approve. Seconded by Mr. Brooks. All in favor. Motion carried. The next item for consideration was to hold a Public Hearing to consider a request for a Dimensional Variance for property located at 148 Magnolia Avenue in an SC -3, Special Commercial Zoning District, for waiver of the off - street parking requirements for multiple family dwellings, variance required - 2 per dwelling unit. Owner: Glenn M. McCall; representative: Helen Stairs. Mrs. Stairs stated that this is the same scenario as the previous request. She stated that this building has a small garage which could possibly hold one car. Ms. Holt - Miller moved for approval based on Staff's recommendations. Seconded by Mr. Brooks. Mr. Davis asked how is the trash picked -up. Mrs. Stairs stated that there will be a janitorial service on both buildings. Trash will be placed at each door and taken down to the street where it will be picked up in the alleyway. All in favor. Motion carried. The next item for consideration was the site plan for Cash America, a commercial use, located at 2397 French Avenue in a GC -2, General Commercial Zoning District. owner: Farm Fresh, Inc. /Cash America International; representative: Bob Thomas, Embree Construction. Mr. Thomas withdrew the site plan from consideration. Mr. Dyal Stated that the Commission never hears anything from the Historic Preservation Board when items are on the Agenda concerning the historical district and asked if anyone on the Board receives copies of our agendas. Mrs. Sonnenberg stated "yes, they do receive a c6py ". Mrs. Stairs asked if Staff could check the old train depot because the commission had agreed that there would be no outside display. Mr. Dyal reported that at 25th Street and Sanford Avenue, the business was using an old car as a sign and asked if Staff could check on this. Mr. Brooks asked if the City could do something about the traffic light at Celery and Sanford Avenues because it is too long. Mr. Robert ,moved to approve the Minutes as circulated. Site is Zoned GC -2, General Commercial and includes a building with a pawn shop. Parking is located under a large overhang on the west and south sides of the building. The alley in the rear or east side of building is fenced and contains a large trailer. The north side /property lined is walled. At the time of review a dumpster was set outside the screened enclosure for same; the wooden fence enclosure was broken. 2. Applicant requests a dimensional variance to the number of parking spaces and proposes to provide 15 spaces instead of 23 spaces. In addition, the applicant proposes that the parking space size be reduced from 10 feet wide to nine feet wide. Further, the applicant proposes that the 10 foot buffer along French Avenue and the 5 foot buffer along West 24th Street be waived. 3.
